I'm a nurse, if a nurse does not follow the rules of nursing she can lose her license. At any rate that cop should go to jail himself. She MUST follow legal rules.

Lonnie Frank I really could care less about why they were trying to do anything. They didn't have a warrant, they admitted the patient was not under arrest, and the patient had never given consent. The supreme court has already ruled on this. Also you need to double check your facts....everywhere I looked it states the patient was a victim who was hit by someone the cops were chasing....wgich explains why the patient was not under arrest. Merely running from the cops is enough for them to place you under arrest. The Asshat cop needs to be arrested for assault.

Having been a nurse for many years, I can tell you that I would have done the same thing that this nurse did, advocate for the patient. I think her supervisor should have been there though before it escalated. As far as the brutality goes, there should have been an investigation. Since the orders came from the cop's boss, include him in the investigation and start disciplining him and go down the line to the cop. There was no reason for the cop to do what he did. That's my take on what happened to the nurse.

I got stopped at an illegal stop on an on ramp. I was having chest pain and tightness and started having trouble breathing, but not enough that I couldn't drive. It just took extra energy. I told the cop I was having a medical emergency and he laughed at me and mocked me. He kept me there for 10 minutes until the other cop told him he should have given me a ticket by then (for expired inspection), and he told him to let me go. I was so pissed. I was in distress and kept telling him I needed to get to the hospital and he kept smirking and being sarcastic while the other guy stood in front of my car so I couldn't even move.

Cops will protect each other, but judges will force the department to punish him if you take action. In the case such as this video, that nurse could have taken legal action and got the police officer at least punished or she could have had his job. The only reason they get away with it is because no one applies pressure to ensure they do there job correctly. I should know I have had to do it in the past. When an officer thinks that he is right simply because no one has ever said he is wrong he would more easily beleave that it is because he is doing his job right. When usually the truth is further from the what he thinks.

I'm an EMT and I had the same argument with a cop once. It's common practice here that when administering an IV, we also collect blood (unless the patient objects). That sample however is for medical reasons and is given to the hospital lab on arrival to quicken a full anamnesis as much as possible. It is decidedly unlawful for us to give these samples to ANYONE but the lab. We can't even give them to nurses in the ER, we have to deliver it ourselves to the lab (collection point is within ER, but still...), much less someone not in the medical field like a cop. Thankfully the cop then did not arrest me, because his shift buddy talked him out of it, but it was kinda scary to have a cop tell you to do an unlawful thing "or else..." I wanna stress however, that this is the major exception with our police force. Most officers in my city are super polite and take their job seriously. They never arrive on a scene faster than on the rare occasions of an ambulance panic button being pressed. Working a scene with fire, police and EMS usually feels like having one big team on the job. That's why the exceptions stand out so much.

The PO needs to be FIRED!!! FIRED and FIRED!!!!! As Nurses, we are mandated by HIPPA and we take an oath to protect a patient's right to privacy and right to dignity. Pt's have a right to refuse to any procedure, and we as Nurses have to respect a pt's right to refuse and legally, we have to respects a patient's rights. If, we did not follow HIPPA's rules and regulations...we as Nurses, can loose our licenses. Also, if a patient is NOT conscious, it is the Nurses obligation to protect that pt. Also, any invasive procedure such as, a blood draw needs a Doctor's order or a Court order that directs us to do the procedure. This PO literally, assaulted this Nurse.

As a RN for decades this is horrific! Nurses work their behinds off and most nurses get no retirement benefits, despite patients taking nurses' lifes in their hands daily!... I had patients toss chairs at me, bite me, etc! While cops get retirement and most do not require education for their jobs. This woman should sue this cop for assault.

When multiple police officers witness an obvious failure to meet the legal requirements for a lawful blood sample and do nothing to stop an unlawful assault on a nurse, its not just one bad apple, it's systemic incompetence. Nationally US police forces have shown they lack the ethical capacity to justly use the powers entrusted to them by law. These powers need to slowly be removed until they realise the responsibility required for their use. US citizens deserve better.

I know the type, most of us know the kind of ignorant cop who believes he is above the law, just because he has a badge and a gun on his waist, that nothing applies to him, that he can harass people with threats of arrest, this guy has a backward mentality and he forgets that every corner there is a camera ready to expose those bullies and then he only counts his ridiculous excuses as if they justified what we witnessed, I want to see one of these men raise his head and admit what did, assert that I was wrong and accepted the punishment, and stop hiding behind excuses.

That would be extremely risky. If he saw you pulling your gun, he would go for his own gun. Than you have a messy shoot out in a hospital. If you get the drop on him, then there are still more risks. If he goes for his gun, do you shoot him? If his partner draws on you, then what? If you escalate to violence or potential violence, then according to The Art of War by Sun Tzu, you want to have overwhelming irresistible force on your side. In this situation, you would probably want at least 6 individuals with guns to be able to successfully oppose the arrest. but even then, the police can still escalate to bringing in SWAT teams. Opposing the government with violence, any government, is always extremely risky. Opposing a government with non-violence is also risky, but maybe more effective if it builds sympathy against the government.

If you look at the full video from one of the cop's body cameras, which includes Payne's boss talking to her in the car, two things are pretty clear: 1) they were fishing for some leverage on the victim of the accident to mitigate their liability. 2) They handcuffed and detained her as an intimidation tactic. They refused to talk to any of the higher-ups at the hospital because they knew they couldn't bully them into doing something illegal; the nurse was a softer target.

E Brown if that's true, it's even more serious. Still say that she was in restrains without cause. So, she.was kidnapped. That merits a penal accusation against cop and whomever took part in it, such as he's superior

Check the other channels, the full vid is about 20 minutes. In that one, Payne's boss tells her that she should have just given them the sample and IF it turned out to be illegal (he KNOWS it is) it would "just be a civil action." Yeah, except she would be fired for violating hospital policy (and I doubt they'd give a damn) and on the hook for breaking the law. You can also hear him asking if anyone knows if the victim has a UT drivers license so they can do a background check. On the VICTIM in an accident?

What an insane abuse of power and he got away with it. He didn't get what he wanted so his first instinct is to arrest a person doing their best to follow the laws the police are supposed to uphold.
