YEP!! ... not forgetting that the home owner was probably coerced because cops turned up wearing *BIG ARMOUR* and they were carrying *BIG GUNS* . @@maddog5814 80% chance he'd have been murdered by the cops, 10% chance he'd have been arrested and charged with (attempted) murder but let go because the police were acting inappropriately, 10% chance he would have been arrested and convicted of (attempted) murder. There have been cases where the courts ruled that someone had no way of knowing it was police entering their house (because the cops failed to announce) but _still_ convicted the person for shooting the home invaders. When it comes to police misconduct, justice is a coin flip at best.

I remember a specific case covered by attorney Steve Lehto, which talked specifically about a lady cop who made up a drug trafficking ring, joined the FBI on this case, and, I believe, got 13 innocent individuals arrested. The reason I brought that up is that, the partnership of the cops made it impossible to sue as apperantly you can't sue two government agencies (if I recall) allowing the FBI and her local precinct to claim innocence and point the finger at each other. My feeling is that the same tactics might be used in this case.

Should by law be able to defend his home. Doesn’t matter if it’s a criminal or tyrants. This is the problem. We have created and allowed them to have a elitism mindset. It’s not serve the community it’s enforce the laws ON THE COMMUNITY. A lot of these cops are people who have been bullied and had a tough time being soft growing up so they become cops to enforce their will onto others.

The reason they won't release bodycam footage is almost certainly due to what the cops would be saying to each other inside the house upon hearing him withdraw his consent. They'll be telling each other things like "Ignore him" and "keep searching", etc, which will be very damaging to their case.

Destroying the security camera, breaking down the door without a warrant, refusing to leave when told to get out, and also refusing to supply the body camera footage of the incident sure sounds like a home invasion trying to be covered up. These guys were acting more like neighborhood watch vigilantes than police officers. What an embarrassment to law enforcement.

Bastards, this happened to me by the Pima County Sherrif in Tucson AZ in 1999, they DID have a warrant to arrest a suspected drug trafficker. After they broke my door down into pieces and handcuffed me. The trashed my house with contents of drawers strewn everywhere, broken items they knocked over etc. I continuously demanded to see the warrant. They refused (this was before body cams). They found nothing and determined I'm not the guy they were looking for and released me. I told them who the hell is going to pay for the physical damage to my house and the trauma they put my wife through; One cop told me "thats not our problem have a nice night" Thankfully, I was able to afford some great lawyers. Weeks later my lawyers got a copy of the warrant and found they had the wrong address. The house they were looking for was the next street over! Needless to say i sued the county and received a sizable 7 figure settlement. Best advice, get a lawyer ASAP if this happens to you.

@@presidenteden6498 , the FBI did the same thing when they raided that safety deposit box company. The FBI asked the judge to allow hem to search all of the boxes when they searched the premises and the judge denied their requests. So they just searched the boxes anyway. And, I am a retired federal agent (retired 2010). What is troubling is I am seeing a lot of behavior that would have got us days off, or even fired, that seems to be okay and standard operation procedure these days. Lying on an affidavit used to be about the worst thing you could ever do. Now it appears that outright lying to get a warrant is treated like a scrivener’s error.

My literal exact thoughts. "We got a tip he was here and we wanted to show force." Followed by "yeah he has killed 3 officers so he is dangerous." The man they are looking for is a SUSPECT he hasn't actually been convicted of anything yet, and he wasn't gonna be convicted either. He wasn't coming out of that house alive, there wasn't gonna be a trial. They could have murdered a man, and then the following week another cop could have been murdered by the true culprit, and it wouldn't have mattered. They were gonna execute their form of "justice" regardless

@@markmixon1121 the fact that they broke in the door in without his consent, instantly made it a violation of the 4th. No matter how minor the damage was, as it's proof they were trying to enter knowing they didn't have a warrant. Funnily enough, if they were a few seconds more patient and let him open the door on his own, they'd probably "bully" him into giving consent and legally been okay to enter without a warrant. Even with his dementia

It sure counts for a lot, just not sold on how it trumps: 'they didn't just 'not have' a warrant, they were *explicitly denied* one' 'they actively attempted to destroy evidence, before they attempted their breaking and entering' and 'additional existing evidence is actively being withheld behind a 'shell-game' of, you must file the request at the department of the one of the 3 that was in charge'

I think your sentiment is correct, but I propose a shift in perspective. The fact that they started by ripping the camera off after failure to get a warrant shows criminal intent on their part. Every action after that should be considered furtherance of the crime of burglary. That's just the local authority problem that should lead to criminal prosecution for whichever one was in charge. The constitutional problem should lead to a payout for that man and retraining for the departments involved.

They didn’t have a warrant and started breaking his door down. But we would be naive to think these officers operated on their own. These cops definitely got the ok to do this by the department leadership and that’s the root of all our problems with law enforcement. There’s always someone behind these tyrants pulling the strings. And until we get rid of the puppeteers, they are just gonna train the next batch of tyrants and send them back on the streets to violate the constitution.

I've been studying police encounters for nearly 2 decades and this might be one of maybe 3-4 videos of someone actively withdrawing their consent to a search of their property, that I have seen. Just incredible, especially for someone with dementia. This guy did better than 95% of perfectly healthy individuals that would be put in his shoes at that exact time in that exact situation.

I once had the police thumping on my front door, one Monday morning at around 6.30 am. I leapt out of bed to get to the door, and when I opened it, they were all there. About 8 of them, 3 vehicles plus a dog handler, plus the guy with the door smasher. They were probably no more than 10 to 15 seconds from having my front door in when I opened it. I opened the door, to be met with one hefty looking cop asking if this was ( my house number and street). I said " you've got the house number right, but the street you want is 150 yards down the road"....... I went back to bed..... Sherlock Holmes they are clearly not.

I have heard of cases like these. The disgusting part is that the officers and even the police department aren't held liable for damages in these cases. There was a poor woman that had her front door totally destroyed and had to foot the bill herself even though the police were obviously at the wrong location.

My late ex-mother in law had dementia and she knew she had it, cause she told me in a conversation over the phone. You'd think though they would also face charges of elderly abuse. I think it was in Texas, but this happened to someone: Cops performed a no-knock raid, and the resident blasted away at least 2 cops with a shotty before realizing what was going on. Nothing ultimately came of it because of the no-knock, AND being the wrong address.

I saw this clip on another platform. Kudos to the home owner for standing up for himself and confronting these incompetent so called police officers. They were denied a warrant by their local judge which tells you a whole hell of a lot that these cops on scene along with their police captains, training officers and direct supervisors need to be fired man. This is piss poor and incompetent police work. Right after the homeowner withdrew his consent and to get these idiots out of his own home these cops on scene need to be arrested for a B&E because they no longer had permission from the home owner and not even valid probable cause. If the roles were reversed do you think a citizen searching a cops house then withdrawing consent then ignoring the cop do you really think that would turn out exactly as this video did? You are right and the answer is hell no and if the citizen avoided getting the shit kicked out of him and for some miracle dodged a taser and a gun just sit back for a moment and let your mind contemplate that thought for a moment. Yep that’s right if the citizen avoided getting shot he would still have an uphill battle and would probably be staring down a 10 year to 15 year sentence. I sure hope this homeowner finds legal representation and sues everyone on scene in this clip then sue them again for compensation. Good luck to this man. It was horrifying to see cops not giving a shit and taking advantage of this man chasing down someone shitbag crime stoppers tip. No warrant, no entry. I had an interaction with a small town police department's officers about 10 years ago. I was with a friend and we were walking down a sidewalk in the town. Suddenly, 2 squad cars pulled up rather hurriedly and stopped. The two officers got out of their squad cars and identified themselves. They then said that I matched the description of someone that had been ringing doorbells and then running away, a few blocks from where we were. We just stood there for a few minutes and they then thanked us for our time and got back into their squad cars and drove off. They never asked for ID from either of us. They apparently had read the Bill Of Rights.

They started kicking the door in to gain entry after being denied a warrant. I would like to think that qualified immunity would be denied given such an obvious violation of the law. Hopefully this man receives a large enough settlement to ensure he lives the remainder of his life happily while receiving the highest quality of care for his medical conditions.

They also knew that if the person they were looking for was there and apprehended, the case would likely get thrown out of court. They were hoping someone, anyone, would make a suspicious move so they could shoot them and brag to anyone who will listen how dangerous their job is. What a disgusting display of power and assertion of ego. This is one instance where "ignorance of the homeowners' mental state" can not and should not have been ignored. As soon as this man Todd them he was a dementia patient, they should have asked for his caregivers' info and ceased all search activities. They took advantage of a man who has a mental health condition. Aside from that, the way they were entering his home would scare ANYONE. I am appalled at their total disregard of this man's rights and mental health state. I hope he can get compensation for his distress, and I also hope he makes a speedy recovery. I seriously doubt it would have mattered here. They started breaking down the door before even getting consent. They went inside before getting consent. They didn't care one iota about consent, that was just their excuse afterwards. They only bothered to coerce consent as a CYA because they knew they were breaking the law. If he'd refused consent they would have kept searching, and if he hadn't opened the door they would have finished breaking it down and searched anyway. The fact they went there with SWAT after having their warrant denied shows their intent was to violate his rights from the start.

In this case, they only coerced consent as a way to make it harder for him to sue, though it was so blatant that it won't matter if it goes to court.

I know exactly what is going on in this video. I am a warren county resident. at the time, there was a man from new york who murdered his girlfriend and arsoned her car. this man is named michael durham who is now in custody after a week long man hunt after escape. at the time, he went through a 4 month multi state manhunt that ended in south carolina which an old couple was kidnapped. its unfortunate because its possible that there possibly was a missighting and this incident was the result. i feel so bad for this man.

A new door, a decent one anyway, will cost on average 2k and up in general. That is if you buy a fully steel door with only a peep hole in it, nothing fancy, no designs and fully secured. You know the type right? It is the type of door that even ammo piercing bullets can't get through fully. I'm talking about the type of door where they would have had to have blown it off with a darn cannon. That's the type of door folks need along with windows that have steel bars on them. It looks like prison, but is a very safe option. The next option is moving into a fully incased underground bunker if you're able to do it. It is unfortunate, but it is the route some folks have to take, especially when breakins are prevalent.
