If the department rules that no wrongdoing was committed by attacking someone for refusing to accept a piece of paper advising them of a court summons, it would mean that if you ever try to serve a cop a lawsuit summons, and he refuses, it would be lawful to pepper spray him for it.

It doesn't even sound like they trespassed to begin with, the ticket wasn't even valid. Never asked them to leave.

How was the ticket not valid??? The representative for the club did not allow anyone on the roof, where he clearly and admittedly went, and therefore did not want him to come back to the club. A trespass ticket prevents you from returning to the property. They refer to it as you've been "trespassed" from this property, meaning that you're not legally allowed to return.

@@jenniferdragonetti1345 where did you see that? Did you go to the establishment and look for signage? Were you there and heard security tell them not to go there? In order to be cited for trespassing you have to refuse to leave AFTER you've been made aware you're trespassing. Seeing as they left and security followed them, they were by definition, not trespassing. Use some brain cells bro.

No, that is wrong. Nothing will change until DA's decide prosecute cops that commit crimes. You should really look up what qualified immunity is. I will tell you what it is not, it is not immunity from criminal prosecution. What is it? It means you can't sue the officer in a personal capacity if it's granted. Chauvin had qualified immunity (The city paid the Floyd family), he is in jail now. QI is not the problem, District Attorney's are.

Maybe I’m ignorant but he was taken to the ground, handcuffed on one hand then both officers pulling his arms and at the 7:15 time stamp the cop says “stop or force will used on you.” So what was everything before those words a Dance Off?? The problem here was he was critical and available. If they had to look for the assailant they’d have gone home empty handed. He was there and available.Unbelievably Dangerous when you have to go to these lengths to create a crime.

Which further emphasizes the fact that cops are actually cowards. They'd rather spend as much time as possible handling a situation where there is absolutely no chance of danger or risk to themselves, instead of doing the job we actually pay them to do. But just to make sure their fragile egos get stroked, they gang assaulted the guy with a burrito. What bravery!!

What was SO CHAOTIC that justified the bouncer or bartender to follow a few PAYING CUSTOMER because .God forbid...they went up to a closed rooftop area but left without causing any trouble. They didn't steal, fight , or threaten anyone. What was the point of leaving job for nothing significant or of any consequence? You'd THINK he'd be glad he didn't have to use force and they were gone without you incident...he was THAT incensed for customers that for all be knew accidentally walked up there. Surely he's had to deal with REAL ISSUES like fighting and rowdyness that guy's peacefully leaving would be a welcomed blessing and he'd go on about his job. .

I grew up in a USA/Canada bordetown. A lot of lesser crimes were solved by bats tire irons etc. Off duty usually in 3's. Blatant brutality, guns from the US, strippers partying with the off duty bringing them for pleasure to a local club. Their cut of the proceeds. Everyone knows,drugs electronics nothing ever done. Still going on and probably always will

Thank you for this comment! I have to agree with you and that is one of the reasons it is so difficult to get meaningful reform. Public safety is of the utmost importance, but you cannot protect and serve the public if they mistrust you due to excessive force and corrupt or arbitrary use and abuse of power. Good community policing can be a God send, where the police dept respects and have a relationship with the community and the respect is mutual. I have witnessed it first hand! But bad policing can destroy a community financially, psychologically and even physically. Thank you so much for your comment. I am hoping that by sharing reports like this more people will realize, this could happen to you, police abuse is real, and has serious consequences and doesn't necessarily make your community safer. I am hoping slowly but surely people are realizing that unchecked power will be corrupted even when started with good intentions. -taya

This is a perfect example of what happens when you refuse the cops. They will tackle you to the ground, put all of their weight on your neck, back and etc. They will brutalize you. They don't try to help you, they prefer to escalate the encounter to abuse you. None of this encounter makes sense.

They are also good tell people to stop you are resisting arrest, when they have already restrained the person, with handcuffs, while policemen have pinned the legs, arms and knee in the back, and a chokehold all at the same time, three cops piled up on a person, after a traffic stop and have nothing on the person. So after they have abused the person, causing death or bodily injuries they make up a reason to cover themselves. They are the real criminals for the people today. I have seen so much corruption against innocent people’s families also. Even young children, who may be just riding their bikes.It’s really sad that these same cops have families of their own. If someone abuses their own love one’s, the whole force would go after the person, who caused that harm.

There's also no doubt that people have the Right to petition government (and without being targeted, abused or "punished" for it). If a person has a problem with a cop or any person in government or any agency, that person has the Right to make those grievances heard.

This aggression by cops occurred in 2121 and the victim of the cops filed a complaint back then. The Pig Department exonerated the cop. So now he is filing a suit. An internal affairs investigator named Lynd found that “Internal Affairs does not believe that all the available nonviolent means had been attempted prior to the use of force." There is more in the report. The chief of Pigs Swoboda recently said, "We want you to see the entire incident. Our officers found someone committing a criminal offense in our downtown area who refused to accept a criminal summons and was taken into lawful arrest." That is an obvious lie as the pigs did not see someone committing a criminal offense, unless eating a burrito on the sidewalk is a criminal offense.

How is this a lie? He broke in into a roof, the police gave him a ticket but he refused to take it. Then the police arrested him. This is literally what the police is suppose to do. "unless eating a burrito on the sidewalk is a criminal offense" - he was trespassing aka breaking in. The cops tried to deescalate by giving him a simple ticket, would be probably just a misdemeanor with a small fine.

"Andru and his friends climbed the roof of a nearby restaurant to search for them, prompting a local security guard to call the police" He broke in into a restaurant and climbed the roof. It's private property, the guard called the police. That's criminal trespass. There is an eyewitness. You are saying the police shouldn't do their jobs!!!

With Sarah Schielke on the case, he will get some justice! I can only hope that this lawsuit will force the dept to decide to make REAL changes. But after this incident the officer received a "medal of merit" just two months after the assault so I am not hopeful. I think it will take public pressure and a big settlement to get them to seriously consider cleaning house. -taya

@@therealnews I'm at a bit of a loss here when you say your "not hopeful", they abused their authority, flat out lied about it in a sworn report presented in court as the bases of the incident and the chief covered for them, it's the same as lying under oath wouldn't think, and what's that called, perjury? and he gets a medal for that criminal offense? Might be time escalate this unlawful behaviuor "clearly presented here" (my personal views). Ah now I see, the bad cop has a history of "10 false DUIs" handed to him by his bar bouncer buddy. The same bouncer that followed the group and then called this cop friend of his long after they left the bar. Makes sense now.

Finding a decent lawyer can be hard enough itself...how many people who's rights were violated needed a lawyer but couldn't find one??? I live near a popular civil rights lawyer with a YT channel (like in the same town) & had two incidents I was involved in that were very similar or almost identical to things that happened in videos shown on his channel. But my phone calls & emails went unanswered. I tried the ACLU & out of everyone I tried to contact, they were the only ones who did respond...but the letter they sent basically says "we recently helped sue another PD for the same thing" seeming to imply that they won't take a case similar to a case they've been involved in before even if it was successful (& even though I have good evidence.) How ridiculous is that!!!???!!!??

I seen a video of a woman who got pulled over and was minding her business,the cop reached into the car and began to assault her,that was until he got sprayed in the face with bear repellent and got a taste of what he did to others……

They arrested him for not taking the ticket but in that state, a citizen is not legally required to a written citation from law enforcement. Law enforcement officers, especially these ones, love to escalate situations by yelling "stop resisting" bc they know their body cams won't catch what is really happening and as long as they yell out to stop resisting, they can get away with using as much excessive force as they want. Andrew's rights were violated right from the start of their interactions. He had every right to be standing where he was standing by those officers and when he verbalized that right to the officers they told him that he had no rights in that situation.

It’s as simple as qualified immunity being tossed out and being held personally accountable, but I doubt it will happen which is very scary. It’s gotten to a point where I’d be terrified to call them and will defend my family myself. There’s no situation they do no make worse, even as a victim. I’ve been there myself. I went outside had 3 children under 2 in diapers all I said to my neighbors was “can you please stop yelling”? It was 4am and had went on hours my kids kept waking up crying. A man about 6’2 240 and 2 females ran over and beat the snot out of me. I didn’t fight back just was shocked anyone would respond that way. Didn’t call the cops a different neighbor did who watched it all happen. I was treated pretty horrible decided not to press charges they told me unless I had cameras, even though witnesses and I was beat up pretty bad they said “the DA won’t prosecute” and the deputy said if they came back and assaulted me AGAIN to call and everyone has cameras nowadays they couldn’t do anything even with witnesses calling making reports saying they’d basically beat me to a pulp. All I said was “can you please stop screaming”? Apparently the male had priors for serious stuff. It was a horrible experience.. they talked me out of any attempt to hold them accountable and basically my fault for going out and couldn’t do anything without camera footage. Next day went and bought cameras and they shot pellets at my back sliding glass doors. Was told we can’t prove it was them. I’ll absolutely never trust them ever again. I had a tooth busted in half just a mom who wanted screaming to stop at 4am. I didn’t pursue it bc for sure I’d be called a “Karen” for simply going out and politely asking please be quiet

In this case the security guard had a role to play in asking them to leave the roof terrace as it was closed to the public, they appear to have left the roof terrace. If he was unhappy with the interaction regarding the roof terrace he could ask them to leave the night club, they left the nightclub. They were no longer on the property of the nightclub when they were cited for trespass. Normally the police have to remove you from the property for it to be a citable offense. It seems that in this town on the word of a security guard and without observation or investigation of a crime by the police you can receive a citation.

This info that bouncer left the bar and called 911 after the guy left the bar. Which brings the question of which the guy went to the roof if the door to roof is open the guy looked to street and left the bar . Then went to another establishment. So if he left hes not trespassing. The cops aren't even checked the bar to see if theres sign that states not to enter. Or that its secure area. The door being locked would've been a idea but it wasn't cops never investigated. The cop that fired the oc to face should be in jail . Second he had no reason legally to put hands on guy that is second reason for jail, throughing guy into ground with intention to maiming third reason for jail. Oc to eyes as stated under three inches intentionally maiming and blinding another reason to go to jail.

I was. In Canada. A psycho and high (as a kite) new neighbour came up to my home, uninvited, and BRUTALLY attacked me. I have Chronic Kidney Disease, and two slipped discs in my neck. She beat me, whipped me around, and THREW me, by my hair. When she started kicking me, I briefly used a small pocket knife in self defense of my very life. This woman, half my age, even broke in my door during MY 911 call, after I ran from her once. She also pulled out my hair, beat me, and kicked me. The cop didn't even ask me what happened. But was she arrested???? Nope, I was. For aggravated assault (possible 14 years in jail). Even though I just defended myself enough until I could run away!!! Most of her injuries were self-inflicted - she impaled her arms onto the knife REPEATEDLY, while she was beating me, and I was on the floor, covering my head, while I was still holding the small knife, showing how crazed she was. But if she wouldn't have done that, I wouldn't have gotten away. My charges were EVENTUALLY dropped, after the prosecutor tried to force me into a plea, and after I was forced out of my home & town, and the stress plunged me into End Stage Renal failure! ALL the evidence backed ME. Except my attackers statement! But he NEVER investigated prior to arresting me. Psycho (in my opinion): Brianna-Lee Atkinson, Port Elgin, Ontario, Canada. Police officer: Constable Ian Clarke, Port Elgin, Ontario, Canada.

I truly hope and pray everyday that by doing this work and helping show people that real meaningful reform is needed that people will be galvanized into taking action to making their communities safe in a healthy way and to really work to end corruption and abuse from government entities- police being one example. I know it can seem hopeless, but our country has been worse to it's citizens and slowly we have improved. We can get better and make this a better country for all of us, but we have to work together to push back against these powerful forces that benefit from the dysfunction and division. I need to ask a question because I don't not understand, how is the cop even justifying a trespassing ticket under CRS? As the group of three were paying customers at the bar where apparently the bar roof was not open at the time, but unlock allowing customers access. I did not hear in the story where security Karen approached the trio and told them to leave but even if that had occurred the trio had left the bar and proceeded to the eating establishment, therefore an impossibility of committing a trespass under Colorado statute? Rather leaving two much more serious crimes of assault and battery while dereliction of duty in their not investigating the original assault on the female to then perpetuate assault and battery at the very least on this poor citizen and his friends

I often hear the comment that even the lawyer states in this case. They are supposed to be above bad language and so on because they are trained. THEY ARE NOT TRAINED. ON AVERAGE THE TRAINING TAKES 6 MONTHS!!!!!!!!! That's not by any definition trained. Hairdressers, secretaries and all the other diploma's society often looks down on take much longer than that.
