It's sad that a local attorney didn't step up and file a suite on her behalf. ▪︎ Overly aggressive arrest with NO articulable crime. ▪︎ Excessive force. ▪︎ Falsification of arrest report. ▪︎ She WAS off the property and not required to ID. ▪︎ Coerced by threat of additional changes to secure a guilty plea to a false charge. ▪︎ (9) days in Jail on false charges. ▪︎ DENIED Medeical care, or access to her medication. ▪︎ Local DA was complicit in the false charges ~ DA had access to full video and chose to cover for Officer and Department. NOTE: THERE IS ABSOLUTELY NO REASON FOR THE OUTRAGEOUS 💰 AMOUNT REQUIRED FOR FULL VIDEO ACCESS by the accused so they can seek legal representation. Injured badly and lost in action because I never had experienced such violence and to be honest I am still traumatized..... This woman's case is bad, but you have not seen the brutality I had to endure when the neighbor accused me of having been on his property (which was a lie)... I asked for the video footage as evidence, which they never gave me.... (Sheriff's office-happened last year in February 2023)... And maybe this case will be brought to the attention of the public with your assistance after all, who knows..... I believe in justice and I will stay focused but maybe it is you who will bring my case to the forefront to start the ball rolling because as of now I am awaiting a date for a trial for riding home on my bicycle - CRIMINAL CHARGES!! $2,000 for body cam footage of your own case that you as a defendant are legally entitled to to present any arguments in your favor even as a Pro Se litigant? Isn't that withholding evidence? Isn't that extortion by charging the person involved for that footage so they can prepare a case to defend themselves? They royally screwed her over big time and this needs to be handled by a real lawyer to get the appeals taken care of and file a federal lawsuit against them.

Both sides are to be informed as to what is being brought forth so both sides can prepare their cases properly. Charging someone like this for their own evidence is just wrong on so many levels. The video alone that was presented would exonerated her and they knew that so they deliberately withheld that until after the fact and even then in a highly limited and restricted fashion.

Thank you so much for your supportive comment for Darcy. I believe it would be very difficult for her to take legal action because they compelled her to plead guilty to obstruction and trespass by threatening her with more charges, such as resisting arrest, resulting in possibilities of jail time, a fine over $1000, and involuntary psychiatric hospitalization. She was terrified of the idea of being committed, and so she pleaded guilty under the advice of her public defender. It would be extremely difficult for her to file a 1983 lawsuit because of the guilty plea-- which I think one could argue is the reason she was pressured into the guilty plea. Also, states like Kentucky, Tennessee, and, I think, until this year, Louisiana(I think it is in courts now with ACLU), you only have 1 year to file a 1983 case. In Maine, you have 6 years, but most importantly, you have to not have plead guilty. (There should be a national standard of at least 4 years states shouldn't get in the way.) If you have a guilty plea, it has to be overturned by direct appeal, or you have to have another governmental form of completely reversing or nullifying the charges. The bar to even get into court for the lawsuit is high and then you fight past qualified immunity for police and I believe there is absolute immunity for Judges and Prosecutors so... it's one heck of a fight. - Thank you for taking the time to watch and for your comment- taya

@@therealnews You’re absolutely correct. Sadly, she lacked the wherewithal to hire a competent and compassionate attorney and more than likely has no legal recourse. As someone who has had an encounter with law enforcement that was less than fair, I was fortunate enough to be able to hire my own attorney who saved me from serious charges. That being said, the ability of the police to ruin people’s lives cannot be overemphasized. It is disturbing to say the least to know that law enforcement wields the power they do with little to no oversight. Sadly, I don’t see a solution in this country given the present circumstances .

I had the same question. When the DA had no evidence of trespassing to present, it should be easy to get the case dismissed. According to my Google search, Utah has a combination of legal services and public defender programs. Utah provides free counsel to defendants with income under 150% of the poverty line. Some states have a committed program, but others seem to be grossly underfunded, in cahoots with the prosecution, or incompetent. Maybe you could call the Utah State Bar and ask them: Should a defendant in these circumstances have qualified for a lawyer? Why didn't she get one? Criminal defense lawyers usually have good insights into how the system really works in their jurisdiction, and sometimes can be very outspoken. I used to think that you could always get a free lawyer if you're charged with a crime but can't afford one, but I did see videos where some jurisdictions didn't provide a lawyer for minor crimes -- with short (!) jail sentences. Is that possible?

That is a really good point; seeing this type of aggressive behavior against innocent members of the public is shocking. It sounds like a thing of the past. And it SHOULD be a thing of the past. Unfortunately, what I have discovered through my reporting is that this behavior of misconduct and abuse has been occurring for years-- it's just that when victims came forward, they were not believed. Often, police departments would give the newspaper the mug shot of the person and a list of any criminal history they had, even if it was just shoplifting at age 19-- this was used to discredit the person and sometimes would even prevent media from running any kind of sympathetic story. My colleague Stephen Janis has been covering police abuse for 20 years. He told me each and every time had to fight to get his stories published! Now, thanks to the ubiquity of cell phone video, CCTV cameras, and even body-worn cameras, we now have a chance for victims to finally be believed! And sometimes, people still will support the police officer and justify their actions even when they see the brutality with their own eyes. @@RonSafreedI saw a video earlier this evening just floored me. A 3-month rookie knew all the tricks, all the criminal attributes of a seasoned cop already and he utilize them all with precision. Obviously that's not means they are training this type of stuff in the academy because the recruitment level of civil and humanized participants had drive to a load that they cannot recover from if they don't hire miscreants

There is snow on the ground and water flowing in the gutter, I would venture to guess that is very cold outside, so the cop rolls her around in the ice water and soaks her clothing. How long was she left in those wet clothes? That, to me, is cruel and unusual punishment. For the cops it was not unusual, daily operating experience, normal. Bottom line, this is just plain old disgusting on the officers part.

I live in Salem Oregon and our police are just as bad. We were asked to leave an area so two blocks away the police stop up, beat the crap out of the two people i was with. They pulled my pants down and left me like that cuffed on the sidewalk. I made numerous complaints and I actually got laughed at by the police. We really need repercussions for officers who abuse their power.

I’ve seen videos of cops coercing a store manager into officially “trespassing” Someone who was a perfectly fine customer because the cop has a bad attitude. I don’t think the cop was responding to any complaint from the store AT ALL. He just rolled up and felt like screwing up someone’s life. Like any criminal, the cop preyed upon her because she was old and probably powerless to Fight the false arrest, in court.

Lawyers Doctors Nurses Get insurance to protect them from mistakes they can make that can seriously affect there patients. Police need insurance also and when insurances start to deny rogue officers insurance . Rest assured 75% of brutality and unlawful arrest will decrease. Police cams dropped 60% of brutality claims . This brings about the question of inequality, financial inequality in specific, the cops do not even bother you if you have money for the attorney anymore and they do target you if they think you can't afford the cost...
