Sir for eg : if A claiming to be the owner of the property files a suit for eviction of tenant B and sub tenant C which is decreed ex parte by small cause court. C then files a suit in the civil court on the basis of title . A pleaded res judicata in light of the decree passed in former suit . Sir isme res judicata kyu ni apply hoga?

Because the capacity is different. 1st suit was filed on the ground of eviction and 2nd suit filled on the ground of ownership. Both the suits were different thus rj will not apply.

Double jeopardy is somewhere called resjudicata in criminal cases as no one can file second case which was decided by competent court which results either acquittal or conviction.
