So much of what she says is total non sense. They may not cause mayhem in the nice leafy inner city Auckland suburb where Marie lives (Ponsonby) but it happens everywhere else. Ask anyone in Wairoa, Hastings, Rotorua, the list goes on. And yes Marie, they cause a lot of havoc at gang funerals with their burn outs and intimidation of other road users. So while you work inside with them inside the system, your contact with gang members inside the system is when they come to you for help and no doubt, always polite with you. You are NOT the front line cop dealing with them at street level. I was a front line cop in Wairoa, so I too worked inside the system and can tell you they do not all come from bad homes, most of the ones I dealt with actually came from good homes with siblings who were 100% law abiding and had no time for gang antics. The gang patch law is not designed to rectify whatever upbringing these criminals may have had, it is designed to give Police the another power to help them get on top of the gang (organised criminal) problem and stop them intimidating hard working, law abiding AND taxpaying members of society. Marie is never one to shy away from the opportunity to get in front of the microphone to defend these criminals that cause so much misery, and why would she? She makes hundreds of thousands of dollars a year (as do numerous other KC's) looking after the interests of criminals.

It's a real life Saul Goodman defense strategy on display here. The general public aren't interested in why someone joins a gang, they are interested in the safeguarding of their own peaceable existence, the protection of which is a concept that lies at the very heart of law across all Western democratic nations. It takes quite a weasel to say that all of Western law is focused on the wrong thing here. A horrible upbringing is indeed a terrible thing, and might go a long way to explaining what might motivate an individual to join a gang, but it should in no way be offered as an excuse for the horrific violent offending they commit when they are in the gang.

Self responsibility would be a place to start. They dont give a stuff about the mayhem they cause. I dont see how pandering to the gangs is in our best interests. If they do the crime, they do the time, but thats not going to deter the next lot from joining a gang.

what if i put you in a box to stare at walls, surrounded by abusive and antisocial behaviour controlling your surrounding. and if you want to not be around it, you get but in 24hr isolation with 1 hr a day to walk around a larger concrete room. albeitstill on your own. how long do you think your healthy brain would stay optimum? your willpower, fortitude.. once its gone, theres no interventionary program. if your still in the public you become fully suspetable to abuse, control & acclamation. if you are on your own. ohwell sit there with your broken head for the rest of your stay. we dont fund mental health services adequately on the outside, best believe they're more lacking inside. on release day if your not so broken we can release you back into the public without having to put you under the health act. go be free, lets see how recidivism goes.

I just cannot believe how dumb people can be. Everyone acts according to the habits that they have "picked up" as a result of not controlling the way they think. Why is it that some people are allowed to continue with the same lifestyles of serious crime and anti-social behaviour against hard working, tax paying people with good work "ethics" caused by THEIR OWN DECISIONS to develop productive lifestyles ? This "defence" Lawyer is just another example of someone who had developed bad habits of ignoring the FACTS. And if you want them, go get them and see for yourself.

She is the one not looking long term. No gang patches in the short term causes friction medium term the gangs go patchless and try to continue activities but numbers slowly reduce. Do the gangs disappear? no! does one of the large draw card get taken away and less people join? Yes then with lower gang numbers is it easier for police to monitor and catch the criminal actions further reducing numbers? Yes! Long term net benifit works

If you watch the examples from every other country around the world. Pretending the gang members are victims only makes the problems worse. The only places that have made improvements are the ones who draws hard lines against them. For example Nayib Bukele from El Salvador cleared up their gang problems in a very short time frame.

If the max sentence is six months in prison, the that maximum sentence is well short of the two years sentence that is the threshold to be home detention

Why do the people “ who work within the system” keep talking on dichotomous terms. What is needed is a spectrum of approaches that do offer consideration for the causes of gang affiliation and a tougher approach that keeps innocent kiwis safe fe harm abuse and other criminal activity that wrecks generations of lives. Let’s cooperate with the police here and still look at making society better( which most police are already doing in their day to day activities anyhow)

The example Marie uses of Australian gangs moving from Western Australia & Queensland to Canberra to escape the tougher controls on their activities holds no weight here in New Zealand. She appears not to be able to see (or hopes that we will not recognize) that in New Zealand we apply laws across the entire country. We are not a collection of States with differing laws. We have universal laws. Let me put it this way - Where can a gang member move within New Zealand to reside where there are a different set of laws relating to gang activity? Yes, you can move to different States in Australia to make your life of crime more advantageous but I gather that the folks in Western Australia & Queensland will not miss the gang presence. And what does it tell you about a group of people that are motivated to move States to avoid laws to protect the citizens of the State they are currently in? It would suggest to me they are not motivated to change their criminal behavior.

As a general description, any lawyer who uses loopholes in the law to get off a criminal does a disservice to the victim. Let's be clear: She does this to make money. The infamous shoplifting ex-Green MP Ghahraman justified defending political leader Joseph Nzirorera in Rwanda, who died before he could be convicted of genocide, with something to the effect that " Everyone needs a defence lawyer." Every criminal gets a defence lawyer, most of them paid generously by the Tax-payer. More criminals getting caught breaking the law more money for the Lawyers so it is in the best interest to look after your business for bread and butter.

Both rehab and long prison sentence is needed. Most people would not know what harm to hard drugs of today will cause. How these drugs are made to get people addicted and to harm them. Some use pot and other drugs for self treatment. Just look at the USA zombie states thats how it will be if no one is educated around the damage drug's do I'm sure no one what's to be like that. videos of these people in the zombi states should be shown in schools on how drugs will make you be. I strongly object to this weasel's argument. For starters, she doesn't even attempt to hide the fact that it is predicated on the notion that she is the expert and that we, the general public, are a bunch of idiots who just don't understand. There are plenty of ways to find community and kinship without resorting to violent criminal offending. Dyhrberg is suggesting there are none, which is not only patently absurd, but plays the public for gullible fools. Really begs the question of how much money this woman has taken as a criminal defense for gang members, because she is most certainly offering a defense for them in this interview.

In Australia these laws simply made it look like the politicians had cleaned things up. The reality is before you could easily see who was a gang member ,now their still active but not so easily identified ! Good luck with what your trying to do? We all accept that SOME gang members have experienced difficulties in life BUT there are many people having similar or worse upbringing have not resorted to joining gangs but instead have turned their lives around and made something of themselves. Marie - you present this as an "either", "or" situation. That is not the case - both approaches should be adopted - as well, here is a reasonable proposition, some people are just "bad code" and some people are simply "greedy and/or narcissistic" - so this either/or approach is ideological rather than operational. Ban patches AND have the programs. As well, I do not like the phrase "we know" - it sounds haughty and elitist... hubris.
