Police can also discharge of an accused person u/Sec. 63 Crpc on his own bond or on bail when police do so they submit Challan where Magistrate if agrees with such report passes the order u/Sec.173(3) where he confirms such release and passes the order of discharge of bond.

Sir i have questions... 1. Is discharge only the power of magestrate or the sessions judge can also discharge the accused u/s 265 D when he is of the openion that there is ground to proceed with the trial he shall frame the charge against the accused BUT what if he is of the openion that there is no ground to proceed with trial,what will he do then? Discharge the accused or what? 2. As u told 247 and 248 applies in complaint case and if its cognisable and non compundable then he can not acquit the accused and the state will proceed the case in absence of complainant BUT as its in 265.A in all cases registed upon police report only,the prosecutor will conduct the prosecution which means in complaint case the prosecutor can not conduct the prosecution. so when 247 and 248 are applied in complaints only then how can/will the state proceed in this scenario in the absence of complainant?plz guide me
