I'm an attorney, I specialize in contracts and I write NDAs all day every day. There are plenty of ways to get out of an NDA, but here are the three main ways I think these two ladies could get out of their NDAs: 1. Whistleblower. I think Miss USA and Miss Teen USA should go with this one. Reporting illegal activity in the workplace, reporting sexual harassment, or participating in official legal proceedings as a witness all qualify as protected actions if someone speaks out and breaches an NDA. An individual who engages in such actions cannot face liability for violating an NDA if he or she reports a reasonable issue in good faith. 2. Unconscionable. The power dynamic is so one sided that the NDA is unenforceable. You said that the NDA was 25 + pages. So both these women are given these contracts, they're probably being told they have a very short amount of time to review them and sign them or they'll face some consequence, not giving them enough time to find attorneys. Sounds like the organization had all the bargaining power and those women signed under duress. 3. Misrepresentation. If their NDA was tied to their Employment Contract, they might be able to claim that the Miss Universe organization breached the contract first. The employment contract promised prizes and benefits etc. but ultimately didn't pay up right? Without looking at the Agreement, I don't know what the termination clause says, but most usually have a clause saying that a breach means you can terminate the agreement and take them to court to recover damages.

Dani has great relations with many of the State directors and would be great at meeting with all of them to work together to create a whole new system. Well the Noeila you speak about and the org forced and cornered her to choose two options that both have its negatives, had Savannah declined this then it would hurt her chances if she competes for Miss Universe Vietnam/Philippines since the orgs are intertwined and would hunt her down. Had the real Miss USA kept her crown and the org behaved then it would be smooth sailing for Savannah and won't be forced to choose.

The weird thing is that when I watched Noelia’s crowning during the pageant- I felt a negative vibe from Savannah when Noelia was announced the winner. So the fact that Savannah said “this opportunity was meant to me” kinda doesn’t surprise me but it did make me think back to that moment.

Agree there is no room for harassment, bullying, or toxicity in the workplace. I left my 13 year job a couple weeks before Noelia resigned for all those reasons and more. Zero tolerance. @@PungiFungi -- In reading different things and watching different videos I also got the impression that she accepted not so much for herself but for the state of Hawaii. As evidence, she was crowned by the governor of Hawaii, not Layla Rose or another pageant official. And as Dani mentioned, if you're Miss Hawaii for any pageant organization you're really given the royal treatment. And now that she has the Miss USA crown they will always see her as Miss USA regardless of the circumstances of how she secured the title.

She specializes in contract law, and reviewed the 25 page Miss USA contract post resignation. She expressed her shock, and all the ‘predatory’ fine print in The Crowned Voice podcast with Cynthia Preiss MacLean. I feel like if she was featured on your KZbin channel, more people would know how crazy this contract really is and that no, the girls cannot “just talk about their experiences anyways”.

This really appears to be a calculated move from the Miss USA Organization. By giving Savannah a great experience as Miss USA, she will have a contrasting story to publicly share. Sounds like a great way to discredit Noelia and UmaSofia who are locked up behind an NDA.... People are no fool thought. At this point, it seems unlikely that the future winner of the 2024 competition will have a great experience. Things are unlikely to drastically change in the long run.

I feel like she diminished Noelia's stance, basically saying she stands with her that Noelia needs to take care of HER mental health, but ultimately that it's Noelia's problem, not that she's standing with Noelia saying that the Miss USA organization needs reform. I don't think that the resignations will have been in vain just because Savannah accepted the crown. She's already started off as having to defend herself, and she will for the next three months. Also, even if her mom was telling the truth (which....I believe she is truly downplaying Noelia and Umasofia's stance....) the way she went about garnering support for her daughter and defending her choice was basically shitting on women who "don't actually have it that bad." So ultimately, that was ass, and regardless of the details of the situation, there are some shitty people involved in this organization. I DO feel like people see through it though and there is still hope that it can be reformed. I believe the truth finds its way out, and these systems built on horrible values cannot withstand....

The state of Hawaii treat their titleholders like they were already holding a national title, especially after Brook Lee won Miss Universe, and they used to compete at MU as a territory. I am not surprised Savannah would accept the title. Who knows if the CW will even air it though? They might still choose to air the competitions, but atm they're currently reevaluating their relationship with the Miss USA Organization. @@kristasoyyo As a jaded corporate marketing crone, I feel very comfortable saying that's all lip service from the CW. The network is not particularly profitable and the ad slots for a national event are already paid for, possibly even in three-year deals. There's no way they're canceling, but they'll absolutely put a statement out saying they're having "conversations" (I'm sure there's been A meeting) and assume that most of the public will forget by August.

Just me, but this kind of reminds me of when Oksana was replaced as MU2002 and look who was at charge then, Paula Shugart. It was handled so much differently BUT Oksana was not "silenced" and was able to speak the reason(s) why she was stepping down as Miss Universe.

Nobody trolled Panama for taking over, because the general consensus was Russia's Oksana was absenting herself from events. In retrospect, was Oksana preserving herself by not turning up? (She felt blindsided being sent to be interviewed by Howard Stern for one).

You are correct, Justine was not trolled because Paula didn't allow it but letting Oksana speak and not being held to a NDA while allowing Justine to feel welcome as the new MU2002. There’s a major contradiction in the new Miss UsA’s speech saying she wants to use the Miss UsA platform to spread her advocacy but how can she if they don’t even get control of the social media pages and attend worthwhile events .. but also she’s a self proclaimed mental health advocate but totally dismissive of the reasons for the twin resignations .. so I would question her integrity and ability to speak on this issue alone

Just trying to remember from my employment law class (New Zealand based but might have the same principles in the US considering both jurisdictions follow the common law tradition). Because the contract of Miss USA is technically an employment contract, NDA's are usually overrun by Whistleblower Laws. Maybe it's a legal path that both UmaSofia and Noelia could consider in order to break free from the NDA?

Great point, NDAs definitely can't be used to conceal criminal behavior in the US. But, I think it'd be complicated to prove in a court of law. I'm sure these same contracts are deliberately vague in what they will actually deliver to the titleholder, and it seems like the most damning harassment claim is hearsay. (This doesn't make it not evidence; it just makes it harder to prove.) I suspect both Noelia and UmaSophia are being advised by lawyers, so let's hope this avenue has been presented to them if it's an option.

Thank you Dani for this video. I hadn't read that statement from Savannah or the ones from her mom, so it was really informative. Also, thank you for bringing out how Hawaii treats their queens. It is understandable to me now why Savannah may have felt she should accept this duty as it could mean doing it for your State... Regardless, hearing her statement later makes it evident she is becoming a puppet. But you said, none of us can really know what's in The heart of the contestants, so I'm not going to assume I know her true motives. One thing has become obvious to me though. The organization is not speaking up about their side of the story and the other side has ironclad NDAs, so this is never going to get resolved. Everyone could resign, and it's not going to do much... Afterall, it's become clear this is really not about women empowerment, but just a business for profit. The only way to get any movement is if something really affects the profit part of the business. As far as i can see, only sponsors hold the power now. If sponsors start to back out, then Ms. Rose would have no choice but to resign and MUO would have to investigate and truly see whom they appoint as successor. The new direction would of course have to have resolved the NDA and other crap going on before being able to assure new sponsors that this time things will work.

I have so much to say! First, it is clear the National Director thinks SHE is Miss USA. She is behaving like a narcissist who wants the spotlight on themselves! The Tennessee situation is a perfect example along with the Miss USA billboard with her face on it not Noellia’s! Second, its crystal clear there is not the proper amount of money allocated to support these titleholders and this organization. The winner of these titles and everyone who competes has expectations of being treated like a queen. Laylah Rose is the queen and these title holders are meaningless to her. Thats clear. She flies to Hawaii but cant send her Miss USA to KY. Crazy. Third, like many others I am sure, my daughter just backed out from competing in our state pageant after 3 years being in Top 5 of our State. She decided this because its clear there is nothing to gain from it anymore. The Miss USA title is tainted and as long as Laylah Rose is the director it will remain so. Im sad for my daughter giving up on her dream because a narcissist took over and decided to destroy the organization for her own self promotion! How many others dreams did Laylah Rose destroy? MUO I hope youre paying attention! This whole system is crumbling. Young women no longer see the value in it! The crown is tarnished!

I was hoping that Miss Hawaii or any other 2023 class of Miss USA would stand together rejecting the title like the Teens, so that they would push Laylah Rose to change her dictatorship over the organization, and eventually both Noelia and Umasophina would regain their titles in a respectful manner. Now that Hawaii has claimed it, i'm afraid it would be unchangeable now for both Nelia and Savanah. One would be a resigned Miss USA, and the other the official Miss USA 2023 but fans won't approve and whom people would always question her integrity of sisterhood. Sigh~~😤😤😤

But I also believe, MUO should be proactive in addressing the issues because it can totally ruin the Miss USA brand. There are also rumors circling around that they may change the name of the pageant from Miss USA to Miss Universe USA.

SO MANY THOUGHTS! 1. Savannah singing Laylahs praises felt gross and also a bit tone deaf. It would’ve been nice for her to at least share “in my experience…” because it feels very dismissive of what Noelia and UmaSophia have shared. 2. LOVE the Teen USA girls sticking together!! 3. How the heck did Laylah get this job in the first place? Do we know? 4. I said it then and I’ll say it again now, we should have NEVER gotten rid of Crystal Stewart!! Were there optic issues? YES - that should’ve been a learning experience. Get rid of her husband of course because IMO he was the real cause for concern! But Crystal loved the women and the directors and this program SO MUCH! She had industry connections! I wish we could’ve seen a true Crystal Stewart era. I think she could’ve done amazing things

That's true about Savannah getting the ultimate treatment until the Miss USA 2024 finals. PR is hugely needed for the organisation. I think it will take a long time to recover. I also agree with Savannah to compete at Miss Universe 2024, and Miss USA 2024 will compete in the next edition.

To be fair, Savannah’s mother said “*We* heard directly from a former employee, a parent, and Noelia herself” and later specified that it was Savannah who talked to Noelia. I don’t think it’s necessarily a lie or falsehood since she said “we” rather than “I” and mentioned Noelia as part of a list of several people who she and/or Savannah talked to.

love this! and i wanted to bring up that when i competed in teen nj in 2021, the contestant agreement stated that the 1st runner up Must take the responsibilities of the queen if she steps down - i was wondering if national runner ups have their own contract that bound savannah to stepping up, and if so, there was probably the loophole for stephanie in that she was a minor when she signed on to the role and is now an adult so her previous contracts were not legally bound?
