Longtime fan of this channel, but this video stands out as very unusual for you. Where in the video does an officer lie? Can you point to a timestamp? Why do you claim that Mr. Ortiz "maintained a calm and collected demeanor" when he responded to an officer who calmly (and, according to you, correctly) states "I'm just letting you know what the vehicle and traffic law is" with "No no no no no no...." Mr. Ortiz maintains a needlessly argumentative tone throughout the encounter, denying things that, as far as I can tell, are never alleged by anybody, while the officers not only politely assist with his request to file a complaint but also take the extraordinarily courteous step of speaking with his *mother over the phone*! Where's the "lying officer" and how did Mr. Ortiz get "saved" by his dash cam? As far as I can tell, the video's title is false and defamatory.

Yeah, but the whole stop could be avoided if the driver had just said "Ok" when the cop told him the law. I'm not saying the cops weren't in the wrong, I just like to avoid making talks with the cops *ANY LONGER* than they have to be.

@@NathanTeaches whole stop could’ve been avoided if the officers weren’t blocking traffic...or didn’t pull over to accost the driver...or if he just ended the conversation by driving away...or a million other things. The cops have all the discretion here. We need not point at the one mistake the driver made and use it as justification.

And to get his name as a way to intimidate him. Like saying, look I know your name, and where you and your family sleep at. Cop should lose his badge IMO. He not only continually escalated the situation with the respectful citizen, but lied about his actions and also did the classic pull over in retaliation move. Bet he's the type to pocket money and plant drugs on people too. I mean, who's to say where he draws the line. Clearly doing all this even after being told he was being recorded didn't even phase him. So he must be hella currupt.

Let's not forget NYPD have been known to stop traffic to catch motorcycles lane splitting... Also known as lane-sharing. These cops were well across the line and sharing a lane.

He was talking pretty strongly, but I don't know if that was yelling. Officers talk in stern tones, and they can be mistaken for yelling. Both of the guys were kinda loud, and that may have been because they were in the middle of traffic talking between two cars. I don't think people recognize that some people just have strong voices.

*It depends. Something like this, no, the CCRB could care less. On the other hand, when I was still a NYC resident in the early80's, a friend of mine was a cop there, and when he got off duty he walked up on a little shit late teen holding his mother at knifepoint. He took it away by going hans on (which is fully authorized under NYPD rules), and the little shit filed a complaint of excessive force - the CCRB upheld it! Like with Democrats everywhere, if you are a criminal, you're good to go, otherwise, don't bother and **_know your place_** when dealing with their police!* *The NYPD earns their hate, every single day.*

How is it that 2 drivers talking to each through their car windows WHILE driving is NOT unsafe? If 2 citizens were doing this, they would certainly be ticketed. Honking your horn is legally justified in this situation.

It was not. Him honking in this situations was unnecessary. Sure I do not agree what cops did after they scolded him but I would side with the cops on what they said about using the signal. In EU and the reason i side with this statement is that tons of new drivers get mentally pushed on the road because they are thinking before they act while more veteran drivers find it annoying that the newbie taking their time on the road. So what happens the inpatient driver honks at the newbie, the newbie thinking he/she doing something wrong accelerates and hits another car or what not. In this case if its recorded the honking car will be liable for the damages done and arguing in the court that the car behind honked and the newbie got stressed is more than enough to get out Scot-Free. Again going slow is NOT an argument to honk. You never know what is happening in the car in front of you. A light tap MAYBE.

They don’t have to use lights and actually are pretty much exempt from traffic laws. For example If they’re responding to a robbery they arent always going to use their sirens and allow the perp to know they’re coming.

@Uncomfortable Truth I don't know. Blocking traffic at night is quite likely creating an imminent danger. Car is coming up on that road won't be expecting vehicles to effectively be parked in the middle of the road

My biggest issue with this episode is learning that it's illegal to even tap your horn to notify the driver in front of you that they should take a short break from TikTok because the light has turned green.

​@@broheme8922 I actually am a lawyer. That could easily cause an accident. If a car is coming to an intersection and sees a green which has been holding for a few seconds he could easily become distracted and rear-end the car at the end of the line, which may well have already taken his foot of the brake and started crawling forward. Such a thing happening is unlikely in any one scenario, but given the millions of miles driven daily in this country you get huge aggregate numbers from such low-percentage happenings. Now, would that qualify as "imminent" in a New York court? I've no idea--I'm not licensed there. But it is far from a frivolous argument.

Every encounter I had with NYPD cops was always aggressive in the way they talk to you, they don't let you talk or they talk over you, even one told me I should address him as SIR. I said to him, I only address older men as SIR and I could be your father. Their attitude changed when talking to Mom cause they don't know how high on rank can she be. And that basically save him from a ticket or several.

That's so subjective! Who needs to be in danger? What's the threshold of annoyance? Possible situation: pregnant wife in back about to give birth becomes the one in imminent danger rendering a honk for recklessly impeding traffic.

Absolutely. The absence of the term "imminence" in the actual law is important as well. Even in a case NOT in an intersection, but on a regular roadway, blocking traffic presents a danger to the vehicle obstructing traffic as well as other motorists. Any cop would certainly say as much if they happened upon a random motorist doing this.

I've been to NYC exactly once. While I was there, we were the second car stopped at a red light. There was no room for the car in front of us to go even if the light was green. None of that stopped the guy in the car behind us from leaning on his horn. In my life, I've never seen that level of impatience anywhere else.

It was from a red light so it’s not that unsafe, it would be hard to legally argue that they were accelerating too slow especially in streets like those. They were in the wrong for doing that, but not as legally sure-fire law breaking as what Ortiz did, even if what he did was less unsafe

I had a cop honk at me and swerve his car towards mine like was going to wreck because I was going 57 in a 55, and I was keeping up with the traffic I was traveling in. Now these freeways have been increased to 65, in town, and everyone goes at least 80. I've had people drive up my tailpipe! I don't feel comfortable going 95 with everyone getting on and off every mile there's the major streets.

it's definitely a continuous hazard, but sadly that isn't what "imminent" means. Imminent is more like "I'm about to be hit or about to hit you if no action is taken.

Most of us can look at a given situation and will agree on whether or not a danger is imminent, and most of us would agree that there was no imminent danger in this clip. That said, I'm not really disagreeing with you re: the way it ought to be - I think the law as stated is a bit silly/restrictive, and honking at a hazardous douchebag is highly appropriate in my opinion However, our personal opinions on when it is appropriate to honk won't really change the way courts will interpret the word "imminent," right? The police will win that one every time.

And i know in NYC cops over look the minor things that goes on because they dont have the man power to cover it all. That's an excellent argument to bring up if this goes to court. It's generally useless to point this out to the police officer who is berating you for honking though, hence the point about staying silent. ANYTHING you say to a cop on the street is more likely to be used against you than accepted as justification for your actions. If you think a stop is unjust and you have evidence to prove it, just accept the ticket and bring your evidence to court. Or if there isn't any ticket, make a complaint, but be aware that your complaint is likely to be dismissed no matter how justified it is and how good the evidence you provide to support it.

The two officer’s tone tell a lot about their attitudes, egos, cockiness, shrewdness, etc... They are the reason the public mistrusts them. When police officers routinely "investigate ourselves and find nothing wrong", and police unions defend police officer actions regardless of the right or wrong of those actions, it's inevitable you'll get situations like this. And Qualified Immunity only makes that bad situation even worse. Police Officers should be held up as an example of how to obey the laws and behave in public, but if everyone got out of their car and berated anyone who honks at them for creating an obstruction, there would hardly be a reason to drive a car in NYC.

I love how when the cop tried to explain to the Mom how the honking of the horn was a violation, Mom said, "Oh, okay -- we'll go ahead with the CCRB complaint." Within 30 seconds she had had enough of the cop's b.s.

She knew it was true, and that's why she told her son to calm down, because if the cop wanted to he could have put the guy in court and won the case. After she heard that, she realized there was no point in arguing. It was just a matter of calming her son down so he didn't get in further trouble.

This is one of the clearest examples of a cop trying to intimidate someone. If it wasn't for the camera and his mom being a cop I guarantee they would have made up a reason to arrest him. Even with the camera and knowing his mom was a cop the cops lied. If they are willing to lie on camera to a cop, after blocking traffic in unmarked cars that easily can be mistaken for gang vehicles used in drive by shootings, they surely do far worse off camera.

It’s probably different where I live but in my driving lessons my instructor said if you don’t honk atleast once a day you are driving unsafe. He honks when backing out of parking spaces to alert pedestrians and drivers

Yeah, it's common practice where I live to honk when exiting an alley or parking garage especially when it's a very blind corner. If someone is distracted and not going on a green light, I think that warrants a honk. Like, I've never looked up the honking laws, but it's the only way to really communicate with other drivers so... if someone honks unnecessarily, just ignore it like everyone else. It's not hurting anyone

Hardly a fair comparison, Ortiz broke the (stupid) law when he decided to press the horn, and he didn't just press it, he HELD it until the blue lights started flashing before him. Getting him to stop was, as far as I can tell, unfortunately a reasonable move by the officer.

Yes, I had an officer pull me over saying I was going 65, I was not going 65, I was going 45, but I have no proof that I was going 45. Now I have a dash cam that also tracks my speed

"Hes got it recorded so theres no reason to lie" 'Implying if it was not recorded theres no reason to tell the truth' That's not how logic works- his initial statement only serves to render the mom comfortable in believing what he says(since she's unlikely to believe his side over her sons) given that it's all recorded so lying would be pointless and therefore she doesn't need to doubt what he's saying. That doesn't imply that when there's no recording, there's not a reason to tell the truth. That's like if I was an honest person and someone recorded me at a party when a murder occurred and the police say 'hey, you did it' and I say 'nah man it wasn't me look, theres a recording so no need for me to lie' Does that mean the police can say 'ah this sounds like hes implying if there was no recording of him, then he'd have no reason to tell the truth...' Does that mean they can think you're a liar for having been on video? Of course not. Some sentences sound good and this is one of them, but it's disingenuous for people to view it as a valid statement

In a similar situation, If possible, I would hold the fact that I have a dash cam for as long as possible, just to see if it gets to record some lies.

I was also harassed for honking at a trooper walking into traffic backwards, lol. Drove by, beeped so he knew cars were coming, went to car store. 5 minutes later hes in the parking lot with his hand on his gun. I really need to get a camera.

The officers should have received an "F". They were likely breaking the law when they were blocking the roadway. Then they tried to cite a civilian when they were the ones who broke the law.

Yes a F the stop was due to upset egos and retaliation. They wanted to write a ticket but realized the camera recording and didn’t. There was no need for the stop the 1st brief talk with the cops was all that was needed.

They were both impeding traffic. They were both sharing a lane. The car on the right went straight in a right turn only lane. They again impeded traffic to discuss the traffic law, prior to pulling him over. Yeah, they collectively had a minimum of 6 traffic violations before pulling him over for his 1 violation - if it was a violation.
