I have dcs batteries in a canopy not in engine bay, I recall your review being on the most part positive with the caveat that they don’t really like under bonnet heat. Like all lithium batteries. Can’t see how they think they even have half a case. Hope as a community we can raise 100% of your costs to fight this. But there is no chance I won't buy anything from a company that sues a reviewer for an honest review after they sent the product for review. This is shameful! What a horrible company!

It is not illegal in Australian law to have “an opinion”. Considering that they sent the product/s to you for your opinion knowing full well that it was destined to be aired on KZbin, I can’t see how their case would last long in the court. The fact that this particular product did not receive the praise that they were looking for is not grounds to sue you for defamation.

That's not entirely correct. An opinion (also known as defence of fair comment) has to be honest which means it is "proper material” . For example, you can't simply publish "in my opinion product a is a fire risk" when you have no evidence or reason to state that. Your opinions must be honest and backed by some degree of research and fact.

I have been looking at going the lithium cranking battery route & DCS Extreme batteries were one of my two options I was looking at. Odd move by a company. Plenty of companies seek out reviews for exposure but they can't expect them to be the same as advertising. Cutting off a channel's access to review products is one thing (and also not a good look), but a defamation lawsuit is a whole other level. I’m not active in overlanding but your review of the Ecoflow Glacier - and your follow up review on the thermistor issues which are real and with further investigation appear likely to affect every unit drove me away from that purchase. I dropped a small $20 donation as I hate shill reviews of any product. Best of luck and hopefully you can recover most/all cost when you win as allowed by Australian law. I’m unfortunately familiar with defending bullshit civil cases. The US isn’t a loser pays system, so I was out $20k. Even if you do recover, the stress is terrible. Im sorry to hear. After being sued in tthe District court for another type of legal issue, I can vouch for the legal costs involved including barrister and expert opinion. I wish you luck and hopefully they're just trying to scare and bluff you (like it was in my instance). My only advice would be to try and understand what the other party wants early on in the proceedings before your legals fee's start to add up.

This will backfire on them I'm guessing. By doing this they have defamed themselves in the eyes of potential customers far more than anyone else ever could in a KZbin video. If they disagree with your review, they maybe should have contacted you and supplied another battery to test or try. They could have offered someone from the company come on your channel and explain their point of view etc. We are not the US and Australians won't take too kindly to the "just sue them" mentality. All they had to do was reach out and treat this as an opportunity rather than an attack and they'd have come out of this looking so much better.

I have always found you to be an authentic, honest, genuine, experienced, interesting, balanced and articulate advocate for safe and ethical 4WD exploration in remote Australia. Those qualities are what make your equipment reviews and recommendations so appreciated by the wider overlanding public. If the company involved in this legal action wanted some good PR... they seem to have lost their ethical GPS. They seem to have embarked on the most perilous track, the worst route imaginable. An open, flexible and consumer-responsive company keen to improve their product/service, might have taken a very different approach to your review feedback. They might have welcomed your perspective and found a way to improve. I wish their company well in the future, but I hope they have recovery gear on board, because they will need it. Respect and trust are so hard to get, so easy to lose.

As far as i know a company in Australia, or under australian law with 10 or more employees cannot sue for defamtion or slander under any circumstance, otherwise every company would do it. @@_bodgie Looking at their webpage (which I think they either just took down or due to being viewed so many time is now offline) their batteries and "Designed and Developed" in Australia. They are likely just Chinese batteries being built to DCS's specifications. I cannot confirm they are made in China, but there is no information given on country of origin that I could find and China is the largest source of lithium chemistry batteries in the world. How that works in reality, is that they pick and choose from options a manufacturer has available and they make an order. Doesn't take a large number of people to run a small warehouse and shipping department.

I had a problem with my DCS battery when it was about a month before warranty ran out last year. That could not have been more helpful. They paid freight to take it back interstate and sent me a brand new battery free of charge. Battery had been under bonnet the whole time and they knew that. Very good communication and contacted after they replaced it to see if I was happy. Had another mate with similar experience. Don’t understand why they gave you a hard time.

Your clearly a credible person and I would like to say the truth wins but it often seems whoever can afford the best representation gets there way sorry mate to hear your dealing with this. Joined your patreon. 👍 Best of luck. It's sad that some business expect super reviews for mediocre products or services. Instead of taking it as an opportunity to improve. Hopefully you will also decide to counter sue. Not for the potential monetary gain. To show them and other companies with similar business practices, that its just not cost effective to try to silence content creators for reviews that aren't as good as expected. Hopefully your legal team will help you update your sponsorship contract as well.
