This means that the fear must be something a reasonable person would foresee as threatening to them. Assault doesn't require a physical attack at all, that's *battery* which is the act of causing unlawful physical harm. Someone being threatening and getting up in your face alongside 2 other goons totally counts as assault per the legal definition.

I think the standard of behavior when a person is put in shocking situation is way off base. Not this case, this is just strange af, but if someone sticks a gun in your face who is going to react rationally? Maybe some hard core military guys or hard core police officers, but almost ALL of use would act irrationally because of the physiological response to insane situations. I think the guy in this case should have been more clear with a warning before shooting, but I've never had some idiot come after me in a mall food court so I don't know and that is why I think he deserves the benefit of the doubt in this case. As someone who has been mugged before, I can 100% feel Colie’s fear and anger, especially with Cook being much larger than him. I also believe that Cook targeted him due to his smaller size, not knowing he was armed and instead assuming that he wouldn’t retaliate. And as dark as it is, the footage of the incident is quite satisfying. Cook found a victim that wasn’t gonna put up with his harassing behavior and he was clearly shocked about it. The scary thing is that I was in a similar situation and I thought I was being pranked and it turned out I wasn't. Many years ago, I was riding my bike when I saw a casual friend standing. I approached him and we talked about stuff. Two large guys approached us and started to make weird comments. I though that they knew my friend and they were busting his balls. Then one of them punched me in the head and I fell down. With me on the ground they started beating my friend. I was in complete shock and when I regained my vision, I run from there. My friend was not so lucky and got seriously beaten up. I am not proud of running away and leaving my friend behind, but at that moment I genuinely thought that they were going to kill me. If the situation were ever to repeat I would not think that it was prank and I would believe that my life was in danger.

Even the jury were initially deadlocked, and then compromised by acquitting him of most of the charges, but still sticking him with a contradictory guilty charge just so that he could at least receive a smaller punishment. Just a note: I do not agree with that weapons charge. I don't personally think he's completely innocent, yea, but if you're going to find him not guilty of those first two charges, the guilty weapons charge makes no sense then. Yes, delivery driver's are on high alert to watch out for violent situations. You never know when the next customer might be dangerous, or you could be mugged or worse. Most people don't think it's a dangerous job, but it can be. That's one reason I always tip very generously. Plus, they're using their own car, paying for gas, and making way less than minimum wage, usually. People think the delivery fee IS the tip, but that money goes straight into the establishments pocket. One of my friends delivers pizza and he's got some weird stories.

Might have been excessive, but if a big dude blaring his phone directly in my face with two other goons with him, I'd be terrified what was to come next if they wouldn't leave me alone. And what of the other people around him who could have been accidentally shot by him? There were people walking around even in the video. Alan only cared about Alan in that situation and while I understand his fear and the reason for his reaction, I cannot condone is lack of situational awareness. That bullet could have hit any number of people in that vicinity and that to me is unacceptable. His safety wasn’t the only to consider in this situation.

I don't understand how platforms like YT can justify allowing these channels. The "subjects of these pranks" (aka victims of assault) do not consent to being part of someone else's attempt to earn income or to be part of someone else's online content. This needs to be made illegal. eta: The actions Dr. Grande describes absolutely qualify as assault in every state in America. Source: my first semester of law school, my work at numerous domestic violence shelters.

As so often happens, you've fallen into the common trap of confusing assault with battery! These two terms ARE NOT synonymous, despite ever-fallacious popular beliefs on the subject, & haven't been synonymous (in strict legal terms) for at least two centuries in the English-speaking world.

What people need to understand when it comes to 'pranks' is that the person being pranked does not know the intentions of the prankster. Sadly, the world is filled with situations where people are randomly attacked. Delivery people can be especially vulnerable as they could be carrying cash and whatever they are delivering. Approaching someone like that in a menacing way is looking for trouble. The delivery guy was much smaller than the prankster, making him even more vulnerable. If you are going to get into someone's face like that after being told repeatedly to stop, you are not very wise and looking for trouble whether you realize it or not.

A whoopee cushion is a prank - this is not. Some people seem to be looking for excuses to harass and assault others and think they can get away with it - even get _paid_ for it - by calling it "prank videos." They aren't. They're crime videos. This was bound to happen. I mean, don't get me wrong, I'm sorry it came to this for the young man to learn (I _hope_ he learned!), and I'm glad he lived through it. We ALL did some foolish things when we were 21. As for the shooter, yeah, he was pretty quick on the trigger, but he also had to work his way through the justice system. I feel bad for him, too - _especially_ bad for him. As the OP points out, there were several aggravating factors, he was at work, carrying cash, delivery drivers are known to be targets of robberies, he was outnumbered, the other guy was physically larger than him, etc. And then we can also see that the shooter did not stop attempting to move away from the threat, did not aim for the chest or head, did not mag dump into the bigger man assaulting him. My fear is that rather than learn from this, the perpetrator of the real crime here may use it to boost his (very negative) influence!

What the "prankster" did is not okay. However, pulling out a gun and shooting someone behaving strangely is ALSO not okay. YOU DO NOT HAVE TO CHOOSE A SIDE IN THIS. This is a perfect example of why it is important to carry more than one tool for personal protection. A gun was totally disproportionate to the situation, but a faceful of pepper spray would have been 100% appropriate.

Today I agree 100% with Dr. Grande. Tanner knows how much larger he is than his victims. He brings a posse with him which makes them appear to be a gang bullying a smaller victim. Getting into someone's face and following the individual holds all sorts of possibilities of many negative outcomes. Tanner has probably been a bully all of his life and apparently it has not bothered his parents one bit.

Part of sociopathy is insensitivity to punishment and impulsivity. One of the kids I worked with used to be UNABLE to refrain from pranking his peers, even after facing criminal charges and expulsion. The day after a police interview, the kid was back to stealing property and aggressively invading the personal space of others, claiming he was “just having fun.” This Tanner clown will likely be involved in a future incident unless he ends up arrested first for the good of everyone.

I used to fix my makeup at work behind my office door where my purse was. A couple of my co-workers thought it would be funny to scare me while I was behind the door. When the day came one of them snuck up on me and yelled something while popping up behind the door. I was holding my open compact at the time and my reaction was to smack him in the temple with it. He bled for a while and ended up with a permanent scar. I have never understood why people find pranks funny.

a prank isn't necessarily assault. Assault is specifically defined and is a physical thing that occurs to the victim. The shooter in this case was not assaulted, but had reasonable fear of imminent assault or robbery, which qualifies his actions as self-defense. Also, I don't think pranks necessarily need to be directed at friends or family, but they should end quickly and be totally harmless. If a 'prankee' is repeatedly telling you to stop and trying to get away from you and you won't let them, then it's not a prank anymore. It's harassment.@@kaufmanat1
