Unfortunately, the Supreme Court ruled that a base can prohibit these type of activities on base property - even base property that is publicly accessible and property that is used as a public right of way. Read Greer vs Spock and US vs Apell

On all the military bases in the Hampton Roads area of Virginia, they have a broad blue line painted on the asphalt with the letters “U.S. Government Property” painted in white that clearly marks where their land borders end.

Military bases should be open to the public and just have restricted areas. Considering former and active military even with expired military ID, can travel through a military base. They shouldn't receive special treatment over the General Public.

The actual law against filming military installations is 18 USC 795, and it doesn't specify exactly what a military installation is, nor where you can record them. The police were actually derelict in their duties by not arresting him as a possible threat.

It always strikes me as weird that federal, military, etc. authorities initiate contact with auditors and then call municipal authorities in to continue with trying to con the auditors into handing over their meth, ah, I mean ID but then the municipal authority show up and take over to get the ID or to even arrest the auditor if they don’t give up the ID. Just calling in of the municipal authority to take over like they do always makes me wonder, if the auditor is indeed trespassing on federal property and/or committing the crime of photographing a military entry gate (which is not actually a crime except for Area 51 and a few other places designated by the president) then it makes no sense they would offload jurisdiction to the locals, other than it wasn’t really a crime but that they just wanted to get the ID so they can close the case.

LIMITED PUBLIC ACCESS If the public drives up to the gate and says, “Oh crap, I’m don’t want to be here-they are permitted to leave. That’s called LIMITED PUBLIC ACCESS. Absent a physical barrier, absent some other posted signage that conforms federal law, you are permitted to film as far as the physical barrier, as this is called LIMITED PUBLIC ACCESS. Here are the questions 1) Is the public permitted to come to the gate and as questions or for a specific person? YES. Is the public allowed to turn around there? YES Then THAT constitutes LIMITED PUBLIC ACCESS. The LIMITS are the physical boundaries of gates, guard shacks and fences. ABSENT that, not only are you allowed to be there, you are permitted to practice ANY Constitutionally protected activity there as well. If that does not conform to their desired secure facility outcomes, THEY NEED TO MOVE THE BARRIERS, NOT THE CITIZENS. Further, the matter of LIMITED PUBLIC ACCESS has been federally adjudicated to the Supreme Court level, and there is nothing whatsoever in Mass Accountability’s actions which change that, nor do feelings or perceptions of what is LIMITED PUBLIC ACCESS under that ruling, Flower v United States (1972) vitiate Mass Accountability’s rights therein. Period. THAT is why they had to let you go. Even a review of US v Apel (2003), though more current, isn’t on point, a more recent case, but lacking enough exact similarities to be considered more on point than US v Flower, also likely that in this case, the United States was invoking Albertini. For further reading on these matters, I recommend Erwin Cherminisky’s writing on the US seeking to invoke so called security zones around US bases, an idea which is further laughable in this day and age of dashcams and Google satellite images which are widely available and used by the public. The courts have been very clear as to the US Government’s limits in using 18 USC Section 1382, to punish citizens simply wishing to invoke their First Amendment rights under the United States Constitution, to punish those citizens.

I'm a retired MP and this makes me sick to my stomach! I wonder what the differences are between the amount of "sustained complaints" of DHS police patrolling military bases, compared to when the troops, the MPs, patrolled the military bases? I know first hand that we were held to a much higher standard as MPs back in the day. Because if the desk sergeant didn't chew our rear end out for being stupid (like in this video) we knew our platoon sergeant and our first sergeant would do it. We had too many eyes on us to get away with this kind of BS. 🇺🇲✌️🇺🇲✌️

Thanks for all you do. I live in vermont now but born and raised in Mass. Anyway, my deceased step father in law was an Admiral in the Navy. An in law through marriage is a captain. Many times we had events in the naval base that we had to go to but unable to go in without them. We could stand just outside the gate with no issues. They didn’t know who we were. The base in Georgia is wrong. Starting a mile or more before NAS Pensacola there are warning signs that you are approaching a naval base. Large clear signs. You were 150% in the right. I was getting all fired up thinking they were going to hand cuff you. Also, I was raised to respect authority in law-enforcement with no questions asked. I no longer do that. Cops have become so bad. My late husband was a retired sgt in Florida. My sons father is retired Mass State Trooper. I have no respect for the police anymore unfortunately. I don’t think they do either. So sad!!

If you can, go look up the property lines survey. And if possible print it off. You might be able to do it on a phone, don't know for sure. I don't know where the property line is exactly but the base can extend out from gate, setting up check points, & barriers,etc, out to or close to the main road.
