Well it is a trap. I mean she was telling the truth. The testing is just to provide them with evidence against you for the court. If they just have the amount you blew it is one data point, but if they have 3 tests and the BAC as well it is 4 data points. Note they are arresting you either way.

The funny thing is, I have refused field sobriety tests (because they absolutely are fucking traps) more than once over two states while also emphasizing my complete and enthusiastic cooperation with a breathalyzer or a blood test. I've never been hit with a "refusal." Blew straight 0s every time they actually followed through, and once the officer was just like "Yeah you're clearly not impaired, have a good evening." Every time it was late at night and I was the only car on the road, I assume I did some ticky-tack shit like touched a line for a half a second.

We had a local cop get drunk, commit a hit and run, then lie about it.... He got a 14 day suspension followed by 90 days of desk duty. IAB "investigated" the incident and that was their recommendation. Charges against him for the DUI and Hit and Run were both dropped claiming that the 90 day suspension was punishment enough. He was a "DUI enforcement officer".....

I agree. I also think that if the cameras are off “accidentally” or on purpose, no charges should be able to be filed. There’s just no reason to not be recording. While I do support the police in general, I also think there are some that lie and their word cannot be taken as reason enough for someone to go to jail. EVERYONE has a camera these days, so it’s an easy solution.

Yep, if they ask you to do FST'S, you're already going to be arrested for DUI/DWI/OVI. FST'S are just used for further evidence for the arrest being justified, as the breathalyzer is inadmissable in court.

It’s impossible to “pass” a field sobriety test. Officers aren’t actually looking to see if you’ll pass, they are looking for signs that can imply that you’re intoxicated based on their own “observations” heck even if you blow all zeros an officer can still suggest a blow draw because you may be under the influence of something else. The only thing that you can really pass is a blood draw

Not in all states, some states have no penalty for refusing the pbt but is an additional violation for the one at the stations. Im not a lawyer but Ive heard a few talk about if you have been drinking and it would go poorly it could be wise to not do them to give them evidence on you.

It is if you are drunk and you don't mind being arrested for now and then fight the case. Field sobriety test results are additional evidence, even if the cop is 100% sure you are drunk he will still tell you to perform those tests as it helps him build the case that leads to you being charged. If you refuse then you have one evidence less against you in court.

These first 2 female officers…. How do you get from speeding, which is frankly never going to stand up anyway without radar, to reckless driving? The indignant way she speaks to this woman is awful in and of itself not to mention the collusion between these 2 cops. Some people are not cut out for the job.

Eh, not true actually an officer can pace a vehicle determine speed and it can and often is found to be credible in court. In this case from what they're describing I'm not sure they properly paced her but radar isn't the only form of detection.

Drunk drivers, man. I know them well, as I was one. Two-time loser here. However, I never tried denying any of it, pleaded guilty, and, fearful of a third DUI and prison, I decided to be done with drinking. I'll have the blow device in my car for another 3 years (total of 5), and I'm really grateful for it. Keeps me sober and keeps me honest. Drunk driving is such a problem, and I was part of it for a long time. I do feel shame, but thank heavens the only person I hurt was myself (nearly died in a one-car accident).

Same here! I am so blessed that I never killed/ hurt someone or myself. I had a few close calls, jail time, the ringer. I am 28 days sober today and I am kicking myself that I didn't kick alcohol to the curb sooner. I am happy you are sober too! :)

Shoot that's nothing new. I drive truck that's like the DOT they got a rule book the size of a freaking Bible if you give a long enough they'll find something to give you a ticket or a warning for during an inspection. Fortunately most of the time most of the cops are good guys just trying to keep the good drivers on the road while they take care of the drivers that are running absolute road hazards.

Got picked up for public intox in New Port News, I wasn't drunk I tripped over a parking lot curb in the dark while talking to my friend walking next to me, I requested a breathilizer at the time and the cop said "I don't have to give you one, if I say you are drunk you are drunk". Luckily I got to see a magistrate shortly after getting to the station and once I told him of my request he went off on the officer and ordered him to give me one, 10 minutes later he is literally yelling at the cop "You brought him in for public intox and he is still legal to drive! You release him right now, don't even taking him back to holding, you can do the paper work after he is on his way".

When I was severely mentally ill in my teens, my social worker told my dad that he had to call the cops on me every time I had an episode/breakdown, otherwise I'd be removed into care 🙃 If you wanna know how they'd find out, it's because the thing we had done a few times was call the MH crisis line for our area, but if we ever did that again and Social Services found out, I'd have been taken. This whole story gets worse, 4 months after that started, I ended up in care anyway because I was so unwell, and there wasn't a Mental Health bed for me. Cops and the system don't fucking care

People think this is a gotcha but if you have any understanding how law works you would realize that to be the case. Their responsibility is to the municipality that hired them and the laws there of. 60% of a city can believe X but until X is codified into law, it doesn't matter. Okay first of all, this is ridiculous that you’re siding with this guy. Yeah I thought it’s weird they called him drunk, but he has an attitude, refusing to talk to police, and said “this isn’t a traffic stop” and not providing his ID. He was driving a motor vehicle and got into a crash so yes he is required to identity himself he is being belligerent so my sympathy for him ended right then and there.

Just because a cop asks for your ID doesn't mean you have to give it to them no questions asked, but that is not what they even arrested him for. They said he hit her after the female officer said she was going to search him, which was a lie. From the body cam footage, she didn't say a word and just touched him. If I was him I'd push her off me too. And on top of that, they just said he was drunk. No tests, so yeah, he has a right to be pissed. And they LIED to his girlfriend, making it seem like he was the aggressor. The definition of belligerent is to be hostile or aggressive; in this case, the most emotion he showed was irritation.

However, you are completely incorrect about him not being required to provide his identification. Driving is a privilege, not a right, unlike what some people seem to think, and the requirement to provide your identification is enshrined in law and tested in courts. They have reason to believe he was driving and therefore he has to provide identification. It’s that simple. He called them, he admitted he was driving and he is at the scene standing beside the car. Sorry, but you are wrong. Yes, the police made errors and could have handled it better, but the driver is being a complete jackass and made a fool of himself, further escalating the situation. Everyone on here keeps asking why they haven’t heard about any discipline being brought upon the officers. Maybe watch the video without a blind bias and hatred towards police and then you’ll see why .

Thank you for being honest enough to inform people of how police officers conduct themselves. If not for the camera footage those two women officers would have changed that story completely. The scenario they acted out is all to common. Again, there is a culture that makes them feel they are allowed to do this. MOST but NOT ALL, officers think they are above the law and I honestly think it is a part of their training. There is no way this behavior would be so prevalent without some kind of network of support.

You know what sickens me the most? By being that empathetic to 'their own', they admit that they treat citizens worse than they could. So anytime you hear that screachy "get on the ground" or a person being slammed against their car when being cuffed .... they KNOW it's abuse and excessive and do it anyway. On the opposite side, I applaud any cop who is equally tough on every person they control/investigate (protected and vulnerable people excluded, of course).

Where any ordinary person would have gotten months up to a year? The system really is corrupt. Treating their own officers by placing them on a cushion. What a shame..

It's nauseating listening to the arresting officer say that he can't help them because "everything's recorded, my hands are tied". Obviously he would let them off if there was no video record of the encounter.

I've seen so many videos where so many criminals say "I can't breathe" after being taken down to the ground, long before George Floyd. "You are breaking my arm" "I have a medical condition" the list of things they lie about and overexaggerate goes on and on. 49:55 that officer might have let them go if there were no cameras. God bless who ever came up with body cams. She would have pressured him and used her position. He keeps mentioning the camera. I do feel for him in a way because he is probably way down the ranking but integrity is very important. I think there should be an automatic prison sentence for officers who abuse their position especially when they are under the influence. Edit: Just watched the rest of the video. The idiot said “regardless I won't charge you for the gun". Extremely weak from him. He should also be investigated.

There are good cops, just they don’t get as much attention as the bad ones. I do believe each cop should have a body cam and dash cam that they can’t turn off, and if it’s discovered they didn’t have them on for whatever reason they have to prove a good reason why or get fired there and then

And yet even then they still show blatant favoritism towards other cops, like the one who ignored the more serious firearm while intoxicated charge for both those drunk cops. It's honestly scary to imagine how bad things were before body cams, especially with how hard they fought against them.

The reality is there's probably a significant group of them (I am not willing to say a majority, but a significant minority) who say that, but are secretly very thankful that everything is recorded. It means that they don't have to deal with the "thin blue line" and "blue wall" shit anymore, because....everything is recorded. If they get hassled about taking in another cop, they can just shrug and say "Hey, everything's recorded, what was I supposed to do?"

This is why their body cams being worn and on are important. We all should know our rights and the laws. It’s scary what they think yo they can do to us without any evidence and just their belief or power tripping delusion. The cop saying “it’s all on camera” is scary. Imagine what he has let slide that wasn’t caught on camera.

It's really frustrating here in Germany some cops have body cams, but they decide when to activate them! They are officially for THERE protection, that's no joke like THEY need to be protected by the camera. So sadly they only show things that help the cops. But at least it's far far less common to get shot by them then in the US.

@@Paulina-dn4zj The thing about body cams is that in their ideal form they are exactly that. Mutual protection. The police can use the footage to protect themselves against spurious allegations from angry defendants, while also simultaneously protecting the public from police misconduct. However they are not implemented in their ideal form. The fact that they have mute buttons and on/off switches that can be triggered by the officer as opposed to being on a triggered system like police dash cams used to be (they were originally activated by the sirens in the old days when storage wasn't cheap and plentiful) or just continuous record with dumps at the end of shift. As for the "but poo poo and pee pee" argument- lots of jobs have crappy aspects, if you are that concerned over the remote possibility your post taco bell toilet bowl destruction will be leaked, then don't become a police officer. Chances are you wouldn't have been very good at it anyway. Also ideally police would not be the keepers of bodycam footage. It should be someone independent of both the police and the prosecutor's office- such as a records custodian, we've seen how the police and prosecutors will delay releasing bodycam footage as long as possible especially when there's civil liability involved as well as criminal liability. Which shows that there are effective ways to kill a case with solid bodycam footage that don't involve malicious destruction.

Im glad to see the officers being held accountable. I wonder, how many cops let other cops slide? It's nice to see other cops upholding the law. I have a lot of respect for all law enforcement.
