This is a classic SLAPP situation. There needs to be more penalties/protection for companies abusing the system to blackmail people to cease perfectly legitimate actions. First it was them abusing the copyright strike system in digital platforms now it's this. Unless there is consequences this will only keep escalating.

AND the system has been jailbroken basically since before it released, since they used off-the-shelf parts for it... And yet Mario Kart 8 has still sold 60 million units. Animal Crossing has still sold 45 million units. Breath of the Wild and Smash Bros has still sold 30 million units, and the list goes on. Reason for going against emulators is simple, 1. Switch 2 will have same arm architecture and even though gpu will be ampere, with some tweeks, current emulators will play them... But only top end pc will be able to handle that ampere as nvidia still haven't launched a true successor to ampere architecture in pc space.. 2. With the leaks of it having 12gb ram/1024 gpu cores from switch 4gb ram/256 gpu cores, development of games will take time and they might heavily rely on backwards compatibility... Having $300 smartphones running switch games for free won't help Nintendo backwards marketing when console will be $400 or more..

I only emulate or pirate once a console is discontinued. Like the 3ds. Nintendo isn't making then or selling 1st/3rd party games. Spending a inflated price for a copy of Star Fox 3D or A Link between worlds does not benefit Nintendo in the slightest, nor does downloading it off the H shop financially impact them in anyway.

From Nintendo's perspective, the ideal situation is that you spend that money on a new Nintendo game instead. Now, they know they can't get away with blocking used games till digital only becomes the norm. The next best thing paradoxically then is games maintaining high prices. Nothing sells a $60 repackaged ROM better than the original game going for $100+. High second hand prices effectively allow Nintendo to just keep re-releasing the same games over and over. This is the same reason why Nintendo avoids discounting their games unless it's absolutely necessary since the days of Iwata even, what Nintendo wants is to condition their customers into thinking the cheapest way to play their games is paying full price day 1. Other makers like Sony are also following suit.

Having recently looked into piracy circles this past year, Alex is right on about the "people who don't buy games *don't* buy games" point. There's a sizeable contingent of people in those communities who have completely spurned the idea of buying games at all, and if there's a game that is not capable of being pirated, they grouse about it and move on with zero intention to take the legal route there. In the days of wii/ds/psp where softmodding was easy enough for anyone to do, you would see a larger contingent of actual potential buyers going towards the piracy route to the point of noticeably eating into sales of games on those platforms. These days though, I think game piracy is once again primarily the domain of the shrewd diehards. Nintendo certainly isn't suffering in terms of game sales this generation.

If the Switch 2 is backwards compatible Nintendo will need to release updates for any games they want to utilize the new hardware effectively... So basically the games would need a patch for resolution boost and 60 fps. My guess is without the need to hack 60fps using a mod these backward compatible games will run MUCH better on emulators with these new Switch 2 backward compatibility updates. Just a guess... There's also the slight possibility that Switch 2 games will boot and run day 1 without much work on the emulator. Although that's a long shot... Just trying to wrap my head around it because if Nintendo doesn't plan on charging a fee for the backward compatible upgrades(doubtful) then they wouldn't be losing any money if people decided to emulate.

I haven’t tried Suyu yet but I have tried yuzu and ryujinx in the past, it seems as though as one closes another opens, and you can still get the last final builds of yuzu and ryujinx there just isn’t further updates

We need more legal protections from this sort of stuff, for starters. Also, the Switch may be underpowered, but Nintendo still need to make sure current games run fine - it's unacceptable that new, first-party games such as Echoes of Wisdom have major performance issues. It would also help if we knew what the next system will do, at least - if I buy a new Switch game today, will the next system be able to run it at higher resolution and/or FPS without patches, or should I just buy it on PC instead? The lack of certainty with the future of modern game libraries (especially from Nintendo) is concerning.

Content based companies must demonstrate consistent efforts to protect their intellectual property rights (IP). The courts look at what a company has done to defend their IP. This informs decisions based on whether an IP remains protected or supposed copyrights violations will go unenforced. Disney has gone after people who had a Mickey Mouse tattoo as copyright violations. Nintendo is dependent on their IP to sustain their business. Sony and Microsoft however, don’t have as deep a bench of valuable IP and are much more reliant on 3rd party support. Nintendo has historically been less friendly to 3rd parties and therefore more reliant on their own IP (Mario,Zelda, Donkey Kong, Kirby) to generate revenue. This is what sets Nintendo apart from their obvious competitors. This also explains their aggressive posture towards emulation, piracy, and anything that may infringe on their copyrights.

I hate Nintendos behaviour, but I do need to mention something ; I have worked for companies that have literally suffered and had their intellectual property stolen from them because they did not pursue it in court to an extent that a judge electively determined they as a result of not protecting their IP forfeited certain aspects of it. And so while I disagree with most of Nintendo’s behaviour companies do need to litigate as a matter of obligation in regards to their IP to themselves and their shareholders. It’s actually illegal in some situations not to not to mention the previously, erm mentioned, loss of IP etc.

As soon as Echoes of Wisdom leaked there, it was obvious it was going down. Nintendo seems to take down emulators that either 1) try to make money out of it (Citra) or 2) allow users to play their newest releases (this and Yuzu). They don't seem to touch emulators that don't fit these criteria (look at Dolphin, for example). I'm all for emulation as a means of conservation but I am not sure why people are mad at this case in particular.

It seems that EoW leaked and was being emulated and played through Ryujinx a good two weeks before the game actually launched. (Screenshots have been posted on Twitter and the like). I genuinely don't know what people expected from Nintendo otherwise and I'm surprised and disappointed DF didn't point out that... pretty massive bit of detail. Look, I'm all for emulation inherently, especially game preservation but this isn't a simple "MEH NINTENDO BAD" moment again. I'm disappointed DF pretty much portrayed it that way... Ryunjinx isn't the one that leaked Echoes of Wisdom though. they have nothing to do with that. Echoes literally is by the same third party Dev with the same engine they made and used for the links awakening remake. so if that already worked before on emulation, echoes worked too.

You could pirate the game with a hacked Switch and do the same. Should Nintendo shut down the Switch while they're at it? Go after the leakers or pirates, not the emulators. Also, Nintendo had a demo for Echoes of Wisdom available at PAX but not on the eShop. Being a rather unique Zelda game, there was no way to try it outside of PAX or piracy before buying it. The game is good but it would have helped highlight the performance issues, as well as helped people to decide whether they liked the new gameplay or not. Nintendo basically invited this on themselves.

It is also crazy that people think that emulation and piracy of a CURRENT platform is morally superior; look I don't think you're bad if you emulate or pirate CURRENT content, but lets not pretend you're a hero or a victim here. My point is the argument for game preservation on currant generation hardware means people were lying/ being dishonest when they made that argument for unsupported consoles (like the Wii U and 3DS) Emulating a current gen console is on his face unethical.

Emulation is definitely (unfortunately) the only way some games can be preserved. A lot of these popular games are not even given the remaster/port/remake treatment on a modern console. Sure Nintendo is technically right to sue these emulator companies. But they're making themselves look bad. Another problem is (as mentioned) the Switch is underpowered and games can't even run at locked 60 fps. I 100% agree that Nintendo needs to have good backwards compatibility with Switch 1 games.

The whole coverage of this story is pretty frustrating if I'm being honest. EoW leaked and was being emulated and played through Ryujinx a good two weeks before the game actually launched. (Screenshots have been posted on Twitter and the like). I genuinely don't know what people expected from Nintendo otherwise and I'm surprised and disappointed DF didn't point out that... pretty massive bit of detail. Look, I'm all for emulation inherently, especially game preservation but this isn't a simple "MEH NINTENDO BAD" moment again. I'm disappointed DF pretty much portrayed it that way... I ditched all consoles and brought a chinese vivo android tablet with Dimensity 9300 processor and it emulates everything. Sure haven’t tried PS3 emulator yet but thats the future and android games are good priced compared to console and pc some games like Streets of Rage 4, Aces Squadron ..many nice games. I expect Sifu to make it to android…That’s the future. You don’t need a $1000 iPad. $400 tablet and $10 games and everything! Its amazing. Switch is already done for it does nothing productive. Probably I am a different bracket but right now I expect my device to provide entertainment and productivity at the same time and negates usage of windows or mac. Its perfect. Its still early days but its great. I recently started playing 3DO games on emulator and damn what an era!

I get that piracy is bad and Nintendo doesn't like it as they wanna milk as much money as they can like any other company, I get it. However, when my OG PS3 died that can play ps2 physical games and my old original Xbox 360 died due to red ring many many years later after a company stops manufacturing these units to buy and stop selling physical media and then you have to go out and buy used units and media and hope you're getting lucky enough to trust someone that isn't lying to you that it works great......it doesn't matter if you buy a unit, it's a finite piece of hardware that doesn't last forever and then 10 years from now when you still have to buy from the used market and hope the unit works and also risk paying an outrageous prices as these units get more rare to buy as again they have been out of production for years. Same with physical media, they are not made anymore and have to find and pay a way higher price for them used years later than the MSRP they were originally at when they first launched. Not only that, your media that you currently have can be lost or damaged or you may have a house fire like I did a long time ago and lost my 64, GameCube, PSX and Dreamcast and all the games I had for them. So THAT is when emulation is needed as they will not produce these units and physical medias forever for you to buy once they stop manufacturing them. It's a damn if you do and damn if you don't. So honestly, fuck Nintendo. They don't have your back once they stop manufacturing the current Switch and physical media for it in a few years and you have a lost or damaged unit or cart or something happened to your home and everything is destroyed and it get rare to find anything on store shelves and have to paid ridiculous prices for used media and units to build your collection up. I do believe in preservation but Nintendo hasn't been that great at it, once a new gen starts that will eventually shut down the servers of the previous gen's and you can't even buy digital on those systems anymore or they will say your account can't be used from the last gen system to bring any of your purchased content over to the new system but we'll just sell it to you again. I hate that I can't bring any of my virtualware content over from my WiiU and 3DS......they outright discontinued it to use on the Switch......It's again, damned if you do and damned if you don't. You never know how shady Nintendo will get in the future on if they will support backwards compatibility or not. The Switch successor probably will but what about the unit after that?

Is there a transparent guideline when to start developing an emulator? I don't know of such. Developers saw the opportunity and started development. If Nintendo was afraid specifically of timeframe of emulator development, they could've stated about it clearly, but instead they required to shutdown both Yuzu and Citra (which is emulator for discontinued console). Yes emulators can be used for piracy, but there is lots of legitimate reasons to work on switch emulator right now. One of reasons, why Switch emulation is viable now is running games on Mac/Android that don't work otherwise. For example, emulating windows version of Witcher 3 on android is very inefficient because of x86->arm translation. In case of Skyline/Yuzu Switch code is compiled for ARM and can be ran natively on Android Phones with good performance. As we can see Skyline devs specifically switched to PC emulation for Android, so we can say that end goal was brining games to android, not pirating Switch games.

These are the same type who justify always-online for single-player, buy season passes on predatory f2p shooters, support digital only taking away choice, and generally just stick to the newest and greatest AAA slop of the month after mentally discarding last month's. I'm old enough where the gaming industry can grind to a halt today and it's not going to bother me (needs a reset quite frankly anyway), as there's a near infinite amount of content already out there. So newer generations will get what they ask for, and frankly what they deserve.

The thing is even if you take that as being true (there's no actual figures on this), who's actually being hurt pirating a twenty or thirty year old system? Sure you could say that scalpers aren't benefiting, but screw those a holes anyway. Plus a lot of lost publishers have IPs completely thrown up in the air, which means nobody gets hurt. And then you have Nintendo charging people money for...emulating old NES and Gameboy games, which doesn't fund new games or creatively being made. Nintendo even has the gall to charge a subscription of it's users to...emulate Sega Mega Drive games! Nintendo is also charging fully money for GBA and GameCube half a'd remakes. Emulation has also added features to later genuinely released ports, like Age of Empires 2 (added unofficial expansion to DE) and Tomb Raider (Unfinished DLC I think?).

I'm only 5 minutes into this video, but it seems ya'll missed the point of Nintendo's attack. YOU DON'T EMULATE CURRENT HARDWARE! Only retro emulation is OK. Handing out free roms of Nintendo's current hardware is crossing a line. They have a number set in their head, a goal of how much money the Switch can still make for them in the next 5 years! Its when you wanna show something that exists elsewhere to prove a point, that point being that buying a game from a company does not actually perverse them, and in fact you are much more likely to lose than going the legitimate route than pirate route because they can remove the game files from your library at anytime for effectively any reason. Where as with a pirated copy you own it so long as you take care of it. Not saying this should be so, because with Valve this is not the case. Even delisted games you bought before can still be redownloaded. And Microsoft is an example because they don't even provide the data on the freaking disc let alone still have all the downsides of digital and none of the upsides for digital where at least you have the raw files on your computer like you do with Steam. I know this because its literally happened to me. With a game called Transformers War For Cybertron. I am able to redownload at anytime plus because people have access to the raw files from the game they have made mods and ways to play the game online again. There was even an offline mod for its wave defense mode that could be accessed by just going through the single player mode. Again, you don't even know what the freak you are talking about. @@SinisterPuppy I don't understand why you bought Switch to begin with if you can only accept top line performance. It's not like they marketed it that way. I also think you're exaggerating quite a bit - I've never seen a 20 FPS game on Switch. Now, it's possible that a handful of such games exist among thousands of titles available on the platform, but that's certainly not typical by any stretch of imagination. 640x480 would be extremely unusual as well, there aren't many games below 720p (in fact most run at higher resolutions than that in the docked mode). Most games run quite well, perhaps outside of a few overly ambitious ports for the hardware (e.g. Witcher 3), but it doesn't really make sense to run such games in an emulator when you could simply play a native version for PC.

@@boshi9 I am exaggerating a bit, although hyrule warriors AoC dips down to 10fps; not sure the resolution. Xenoblade 3 bottoms out at 540p (equivalent to 480 in 16:9) and can't hold 30fps. I bought the switch because 7yrs ago it was a compelling platform. Plus I've had a Nintendo system since 1986... Between their recent legal run and everyone here defending them.. I'm done. They lost a customer of 30yrs. The message I'm getting from these YT comments are. Don't even support Nintendo unless you're willing to accept they're happy to give you a crummy experience. The way it's meant to be played ™ Last game I'll ever buy is Metroid Prime 4 unless it's only on Switch 2.

Why?? With a decent PC running a Switch emulator and game mods I can get more FPS and stable frame rates at higher native resloutions than I can on the native console. The switch hardware offers an inferior experience than with emulation at least on my hardware which is why Nintendo is hellbent on shutting them down. Uninformed people against emulation or advocating for "just play on the Switch" are just cringe as hell.

@@djtomoyyou say it ironically, but I'd be amazing. And honestly at some point in humanity it will probably pretty much be the case. When there isn't even any point in manual labor anymore.
