This is the full uncut version with a the Constitution conversation with the officer. You can also watch the short version here: • City says NO CAMERAS -...
Gav Seim defies City of Moses Lake WA right in front of police. Details on the blog post: callmegav.com/2...
After Gav Seim challenged them for targeting campaign signs, the city put up a sign saying NO CAMERAS allowed thinking it might prevent accountability. Silly people. The Constitution is the real law.

I live on the other side of the Country from you, but thank you for what you are doing. I called Friday and asked that lady if the sign was still up and she said yes. I asked if they would be taking it down soon and she said NO. I told her I would call this week and check back. I pray we get our Country back!!!. Thanks Gavin!!!!!! your friend and follower from Florida.

18:03 They do NOT have to study Constitutional law in police academy?????? WTF???????????? REALLY??? SERIOUSLY????????!!!!!!!!!!! That is unbelievable. -That said, this officer is about as calm and cool as can be, he's really respectful, and has the patience of a Stoic. I give him all the credit in the world even if I disagree with him vehemently. We must give credit where credit's due and this officer deserves a lot of credit for his patience and demeanor.

2eelShmeal The cop only redeeming act in this video was the fact he did not stop Gavin from entering the office one last time without incident because he wanted to enforce a rule not a law. He knew he would be wrong in doing so. I am happy Gavin pushed the issue. It proves that he was right and the cop knew it and backed off.

Great work Gavin, love your videos! Something odd I took notice to, if it hasn't already been mentioned, was this: The sign was hung on the front of the door, yet there was a door stop engaged under the door which was holding the door wide open for anyone to freely walk in. That, to me, would suggest that it was indeed a public receptionist area first of all. Secondly, if the door was held open with a door stop, the sign wasn't visible for anyone to even read, regardless to the fact that it's illegal and unconstitutional anyway. This nonsense has to stop! Funny too, is how ridiculously long this talk went on for and what were the suggested means of resolution and actions to take, according to the officer...yet the simple solution to take care of this issue from any one of these public servants was to reach for the paper sign, remove a few pieces of tape and crumble it up and toss it in the trash can. Voilà! Would have taken a mere ten seconds, tops! Seriously though, this as all about law, liberty and freedoms. It's also all about principal and keeping those in check when things are unlawful and keeping coherent to the Constitution and of The People of which they are supposedly serving and protecting. Gavin often goes on verbally discussing Constitutional rights and laws in his videos to those who he confronts and I often sense that many public officials and law enforcement agents have the facial expressions and body language of having no clue as to what he's talking about most times. Some simply just ignore, stand there silent trying to be an intimidating bully, change the subject or pretend they are looking around or making/listening to important calls on their cb radios to weasel out of sheer embarrassment that a citizen is actually more intelligent than they about the Constitution and laws than they are and who actually has the balls to stand up and exercise his rights and not back down to this tyranny. Yet they are out there supposedly "serving and protecting", often enforcing unlawful acts, presumably without even realizing that they're in the wrong most often. That's simply sad!!!!!! You got it right, man... "Serve and protect, not harass and collect"

This is about like going to the city manager's office to address a city run program, like trash collection, and being told that you have to go to the dump ground and find YOUR trash collector to resolve your issue, after encountering a sign that says "NO CLOTHING PAST THIS POINT". They can put up a sign that says whatever they want to say in regard to requirements and restrictions to enter the office, but that doesn't make it THE LAW. And as for public access, anything on that side of the counter is publicly accessible. They can't legally have you removed unless you are doing something ILLEGAL which constitutes the LAWFUL definition of "disturbing the peace", etc.Good vid! You are very well spoken and clear on what you're trying to convey to these people and they need to learn to listen instead of thinking people are just peons they can ignore.

It seems as though so many of you fail to realize that despite the fact that the people Gavin was dealing with are public servants he is not the only citizen that they serve. Record all you want keep the cameras rolling 24/7 but when you know that your signs can be picked up at a different office but you chose to go to the wrong one anyway just to give them the privilege and opportunity to serve you the only thing you are doing is wasting the tax money paid by your fellow citizens.

Why are you demeaning with these people who mean us no harm? You probably have good intentions. To me, it appeared that the officer had such a great attitude and you treated him like a fool. Instead of using gentleness and entreatment, you used an attitude of arrogance and mockery. There are so many laws written that we ought to give eachother mercy about the ones we unwittingly break. Your words and attitude do not come off as polite, which seems to be your intention from what I've read in your own comments. I like your mission and you are very bright, but I'm disappointed in this execution.

The officer was trying to make the argument that the space was not generally open to the public... he attempted to trivialize the reason the door was open... maybe the space isn't actually open to the public but they wanted airflow, hence why the door was open... but if you go back... when Gavin wanted to make sure when she shut the door, that they wouldn't lock it... the woman was surprised that he would suggest that they would lock the door and the reason was because, as she specifically stated... "We are open," So... I'd take Gavin's logic that a space that is unlocked, and has a lobby where people can speak to people and get assistance (assuming the employees feel like giving assistance if you haven't offended them in any way), and the employees own statement that they are open for him (the public) to enter, as evidence that that is a public space.

Stop and read the sign ...... on the sign itself it says "Private offices and office space" "Please check in for admittance" ..... Putting up a sign that says it's a Private office area ...... makes it a private area ! It is probabbly true they put up the sign just for him , but they don't even need the extra sign because the engraved door says "Executive Office " ..... Executive offices are not public places they are private executive offices that are publicly funded but not public places.
@Chipwhitley274
@Chipwhitley274 10 жыл бұрын
MrGarnache Executive offices do not automatically mean "private". And the aforementioned reasons why it would logically be considered open to the public are more significant evidence of this. The woman even stated that they are open for him, and the lobby counter etc. Executive only means that you go their to address your concerns with Executive Staff.

MrGarnache The offices in the back are private offices, and he didn't go into the offices, he went into the front desk area, where you are directed to speak to the office staff for admittance into the private areas beyond. Or did you not read the part about checking in with the office staff? The check in area, is open to the public... otherwise how would the public check in, if the check in desk is also private? Or are you too stupid to understand that?

Whow, Gav, you're more bold than I would even dare be! I would have broken to their "you need to leave" before this. I guess I figure that there's a bit of different law for the insides of buildings -- more expectation of privacy than on the outside -- that reasonably prevents me from shooting video inside there. And, if I wanted some signs from the guys next door, I just would have gone over there myself. I'm sure I could've done that. However, I still like what you're doing -- to an extent. :-)

Our government does not follow constitutional law, hasn't followed it since 1933 after our government secretly declared bankruptcy. At that point, the international banks came in made an agreement with our government because they declared bankruptcy. At that point, the Constitution was null and void by the bankers who then set up a U.S Corporation and seized our national assets which included the citizens and their taxes as collateral. The United States of America was allowed to remain only in name, all previous laws and the constitution were changed as they saw fit. We are still in debt to those banks including the Federal Reserve. We will always be in debt if they continue to have their way with us. The nation, the states, and the cities all became incorporated under the U.S Corporation. We were conquered by the banks then as well as now. Using the constitution as an argument for laws that are now on the books is pretty much done so in vane. Sad but true. This can be researched by those unfamiliar with it. I feel bad for all of us. However, The Supreme Court did say that citizens can film in public areas as long as they are not trespassing private property. I don't think City Administration is private property, but then again...if we are all under a corporation, then the city property may be considered private if one were to push the issue. Not sure about that one.

You can film public officials in PUBLIC places ..... When their is a sign on the door that says " PRIVATE OFFICE AREA " you are no longer in a public space. You are in a private office area inside a public building. It would be completely incorrect to think that you have a right to record any meeting with any public offical under any circumstance. If you are in the Mayor's private office or the Judge's chamber and they don't want to be filmed you can shut off your camera or get kicked out. He fails to understand that taxpayer funded offices are not "public" places , they are private offices funded by public money , not public places. You obviously don't have some right to just wander into the Mayor's office uninvited or anyone elses office either , I only use the Mayor to illiistrate the point , the Janitors office would be the same. Don't confuse "public place" with "publicly funded place" they are not always the same thing.

wedonotlovethemhoes A door being open does not mean it can not be a private office area especially when their is a sign that says it is ...... public bulidings can have private office's and areas. Your assumption that every area you can walk into in a public building is a public area is simply wrong. Your assumption that every area that conducts public bisness must be considered a public area is equally incorrect.

MrGarnache i'm not familiar with american law... and Im not defending mr. seim, I feel he like to provoke and incite... but I am curious what is the legal foundation for your argument the publicly funded places are not public places?
@MrGarnache
@MrGarnache 10 жыл бұрын
avito80 Thats a reasonable question because it does sound illogical or wrong. First off Some of course ARE Public places , so let's be clear on what I mean ..... Not all parts or sometimes even any parts of publicly funded places are "public places" ........ The Top Secret AREA 51 for exampe is not a public place but it is taxpayer funded , that would apply to ALL things military , an Aircraft Carrier is not a public place obviously. The Legal Foundation for things like that is Security of course. ..... Their are other places that are a Saftey concern that are funded by the public but not public places they may not be allowed to go ..... A dangerous ledge in a public park for example , most electric public utility transfer stations are fenced in with big signs saying no tresspassing and are not public places , for Saftey reasons, You can't just walk into a Jail and claim it's a public place just because it's publicly funded. Other places may be funded by the puplic but used for personal reasons by public employees , their offices for example are not public places , the office supply area is not a public place even though the public paid for the supplys. The walk in Vault at the Public buliding that holds items is obviously not a public place even though it holds public treasure. I'm sure I have shown that at least SOME places are not public at this point ..... the question you are really asking is what is a Legal Foundation that would allow or not allow something like a "no entry" sign or "no filming" sign ...... The Legal principle used goes something like this ..... All publicly funded places are considered to be Public Places if they are OPEN to the Public with no requirement for the need to conduct any real bisness .... like a park for example open during whatever hours it is open maybe even 24 hours. Areas that require permission to access like Area 51 or a persnal offices are not public places. The Lagality arises in determining what areas can be restricted and what can't ...... The General principle there is ..... Saftey , Security , Privacy of themselves and others , The restriction has to have some reasonable basis . some are pretty clear like an Aircraft Carrier ..... Others perhaps not like , the general office area with lots of desks doing IRS audits , that would not be a public place for the privacy of the people getting audited, You wouldn't want someone filming your audit would you ? The Social Security office doing Disability reviews would not allow filming for the Privacy of the Disabled even though it's a public buliding and the interview might be done in an open area with people waiting in the same room. That's were people get confused ..... They think, well I just walked in, their was no sign , so it must still be a public place . if not for the Private interviews it would be, but as they are taking place it becomes a private area and they can stop filming. That is pretty easy for most to understand because it involves a third party. But even on a first party basis the Private Mayors office is not required to allow filming because it's a restricted place. This guy got kicked out of the Police Chiefs office for the same reason .... it's a private office in a public building not a public office. If you have any more questions about a more specifc situation feel free to ask. The general defence people would like to use is ...... I know Some of the papers in plain view are private or other peoples conversations are private in this room but I will only film my own. It would be nice if that was the case but it's not because people can make accidents or do things on purpose so it's just not allowed to protect against that. As a side note you also must be using a public building for it's intended purpose or you can be kicked out ..... Sleeping in the Library for example rather than reading a book. Homeless like to go to publc hospitals thinkng they can just sit around with no need to see a Doctor because it's a public buliding and are forced to leave. Just because it's public doesn't mean you can do anything you want inside it. ..... including filming or even just sitting there minding your own bisness.

MrGarnache Well I love how you are commenting on a guy's video who knows the Washington state law and the constitution better than you ever would. The mayors Private office and any room behind the desk would be considered private. Where the general public goes and has public forum with government meaning the front desk it's in anyones rights to record and also the Law states you must let the person know you a filming. So before you decide to jump on and call someone an idiot. Know your own facts and know this guy doesn't just start shit for no reason. He knows his rights and that's why he films it.

I do have to say... that while I don't agree with the logic of the officer... and really the implication that he would enforce the sign... when push came to shove... he didn't prevent Gavin from entering the area to ask for a statement while filming, the officer didn't arrest him him for exercising his right... so I respect the officer's restraint in this instance.
@MrGarnache
@MrGarnache 10 жыл бұрын
He would not arrest him for filming he would remove him for tresspassing , as he has done before over the same issue. All they need to do is give him a tresspass warning over the filming and then they would arrest him for doing it again.
@Chipwhitley274
@Chipwhitley274 10 жыл бұрын
MrGarnache "All they need to do is give him a tresspass warning over the filming ..." A person cannot be trespassed from a public space because they are exercising their rights. And the officer does not get to decide who is trespassed, only the owners of the property, which makes it very debatable the legitimacy of doing it at all in a public facility, as it is owned by the public. But even if there is a legitimate reason for trespassing from a public space, such as a person being violent and combative etc... that does not change that exercising one's rights can *_never_* be the justification for a trespass... at least not legally.

Its a long watch... But what if found extremely interesting was the exchange that took place between you and the officer from minute 41 to 41:30 .... You made countless reasoned arguments.. However the only one that registers on his face was when you tell him that the camera is for your own safety... the same as his police cruisers camera is for his and everyone elses safety.... You can tell he wants to contradict the comparison but his face at 41:16 tells you that the lightbulb finally goes on and he makes the connection.

lady authoritarian...."I'm gonna have to ask you to stop" Seim..."no" haha and the officer says it's a policy...which I interpret as it can only legally pertain to city employees. The city manager or office manager cannot make law

Hey Gavin did you notice he doesn't care, and he really isn't listening. He will let you go on then continue his day when you tire and go home. You are talking to the wrong guy. You have to get the bosses to change their ways through election.

This seems trivial to some, they see Gavin as being argumentative for no reason. The thing is, when allowed, Culture is as culture does. It rarely progresses to the good on it's own unguided course eg, that's why there are laws. An attitude of indifference as to what is expected of public officials has created a sense of secured superiority among those same officials. This is the type of thing that should be taught in public school. It would help the citizen/pupil understand that every single person has a certain responsibility to maintain a part of this social structure which is built on law. Ignoring the law is this, ignore ance of the law. Any time a person is in a debate, and has no real fact to back up their case, the first thing they do is make the claim the other person is being confrontational. The smug attitude of these Moses Lake employees is no different than what you will find within any hierarchy, acting on absurd notions of what is acceptable. In a business, one of the most common issues is employee rights and compliance by both employee and employer to act within those laws already written. To explain to your employer you have a written law to justify your action, is to argue with the king in his self appointed dynasty. In short, you will be labeled confrontational and probably be fired, even though there were laws to allow your first action, and laws to protect you from being harassed for that action. once you mention, as is your legal right, that you have a legal right, you are the asshole, goodbye. . I appreciate the fact someone is exercising their rights, taking these officials to school, and helping to spread a little knowledge among us sheep. Some people see this as anarchy, it is the exact opposite. Everybody is losing personal liberty, one ignorant official at a time. It is our culture, we can change it just by understanding current law. No revolution needed, Good job Gavin Though to a certain mind set you seem ego driven, I understand that is not the case, you are knowledge driven. Simply dealing with ego driven individuals makes any person ''confrontational''. I say keep it up.

‘Well we may disagree’... sorry, law is absolute. It either is or isn’t lawful. More so, the office in question is a fricking fish bowl open to the main atrium but you can not record past the open glass door... that’s BS on a whole other level. Shameful on the managers part, shameful on the officers part as well, policy CAN NOT trump law and a law enforcement officer should be the FIRST to recognize this elementary fact! Deplorable training and performance on each of these public servants parts which speaks volumes to the lack of integrity of them and their superiors. All policies are required to be LAWFUL other wish what’s preventing Burger King from setting a policy that all female patrons must show their breast before they will be served. It’s like people don’t even hear what’s coming out of their own mouth. SHAME! SHAME! SHAME! PS, Gavin, you should be wearing tights and a cape!
