The plaintiff, a DJ, was hired by the defendant, but he claims the guy still hasn’t paid him in full, so the plaintiff is suing. The defendant says he gave the plaintiff a list of 70 songs to play for a party, but he only played one of them. The defendant decided to deduct some of the plaintiff’s payment because his services were inferior.

This was a BS verdict. So the defendant got rewarded for purposely violating the contract. No way there wasn’t video footage from the party. If the party was so bad because of the music then the judge should have made him prove it.

Not BS, he did not fulfill the contract, not paying the rest of the pay as per the contract. The defendant was the loser for not fulfilling the contract as stated. He had to pay the rest of the money due as per the contract. It pays to listen.

In my experience, DJs rarely take requests. If you do one request, you’ll start having to take everyone’s request.

Well I have a huge family and they've never charged for any kind of party. Then again, it helped that the venue was owned by family...lol

@@serenity7394 Yeah, that definitely contributes to it lol. If someone's holding an event in an expensive place and/or with expensive attractions/food then I don't see anything wrong with charging people if they want to attend. It's not the same as just throwing a party in a park or at home.

At the end of the day, it was a straight-up breach of contract. And you know what the DJ should've done when he didn't get paid upon arrival? Turn around, and walk right back out the door....

I'm surprised at the judge not honoring the contract. If payment was stated to be paid upon arrival then the payment should have been paid upon arrival. I'm curious to know what the rest of the contract stated.

The plaintiff waived that part of the contract when he decided to DJ the party despite not being paid upon his arrival.

I agree. She should have made her judgement based on the contract. Did the contract require him to play whatever requests come whenever they come? Did it state in the contract that he would play requests at all? She's usually such a stickler to rule based on the contract. Suddenly she doesn't. She's emotional and is often biased. I get that his statement that all he had to do was pay him to get his requests played does kind of say he wasn't playing the requests because he wasn't paid according to the terms of the contract. But I don't know if that supersedes the contract.

....But that statement the DJ gave, dug his own grave, I believe he wasn't playing what they wanted because he had not been paid in full. The defendant is an uneducated blockhead for not knowing how to act in court, that smile and sticking out his tongue just shows the type of jerk he is... but I think judge got it right.

It’s very common for DJs to not take requests after a set list have already been made. You don’t “play songs twice” it’s not as simple as switching tracks there is an art to it and a vibe that has to be created. I get that it’s the defendants party but at the same time he has to trust the professional. That’s ignorance on both the judge’s and defendants part. The defendant in general just seems like he didn’t want to pay for the services.

As a DJ myself, I completely understand what he was saying. I avoid playing songs twice because it ruins the mood. People immediately notice when you replay a song and it throws off the vibe of the party. I do take some request but I can't just take all request when I have a set list planned as the songs have to flow to the next, though you can just abruptly change the vibe assuming the crowd wants that. Regardless of that, the contract was to play songs and be paid on the spot, he played songs and didn't get paid. Very surprised he lost.

He lost because he had a chance to mitigate his Damages by choosing to DJ without being paid as stated in his contra. I also understand there is a science to DJing but him not taking a request from the defendant is like a DJ not taking a request from the owner of the club.

@@Mannymoco239 the customer is the person who is paying for the event, not the guest. The customer needs to have requested the songs in the rotation beforehand since you have no idea if the DJ has those songs on hand. Either way, the DJ works to put those songs in, but it isn't guaranteed to play and I've never had a DJ set contract that said I needed to play any request made during the show, only that it's preferred since most people understand that someone having a reggae theme party shouldn't just play a random rock song that the customer didn't even request, just because it's a request.

The DJ should have never gone on until the remaining balance was paid. That would’ve solved everything. However, there is very much an art to DJing and you definitely don’t play all the popular songs at the beginning of the night. Any real partygoer knows that.

You are 100% correct and the contract was to be filled before and defendant didn’t pay so why should the plaintiff get punished by the judge when he headed his end of contract he showed up but wasn’t paid as agreed he could have lefted but he chose to get ve the guy a chance to pay him which after the 13 guest he had money to pay hom and he didn’t so why should he fully preform for what he wasn’t paid for ? I disagree with judge verdict and what really put the icing on the cake is the defendant and witness lied and laughed their tails off as the verdict was decided wrong by judge on verdict...

The problem with being paid *before work is performed* is that now the DJ has no incentive to do his job to completion. Maybe 50% before and 50% after? It's like when you hire a contractor to do work on your home. You *NEVER* pay the full amount upfront.

⁠”Never pay the entire amount in advance” is good advice, but that’s not what the contract stated. The defendant signed a contract that he did not agree with and that’s where the problem started. Then the plaintiff messed things up by not insisting on having the terms of the contract followed - he should not have started working without receiving the full payment up front since that is what the contract called for. When he agreed to start working before he was paid in full he should have at least added a line to the contract that stated when the new payment deadline and amounts would be AND had the defendant re-sign the contract.

I think she didn't honor because it was such a small amount and he was being stubborn. However, either way you're right. Truly he should have been paid at the beginning and if they didn't like it they could have sued. But... if it meant that much maybe he should have left.

I’m a DJ myself and reasons why we don’t wait till the end to get paid is bc promoters like this one stiff you in the end. Just like he said… you get paid depending on tickets. We ALWAYS get thought about last ! Plus he should’ve hired a DJ that he’s familiar with not someone you have to give 70 request too. This DJ was giving him the benefit of the doubt and learned a big lesson. STICK TO THE CONTRACT !

I think she got this one wrong. The defendant breached the contract. The contract didn’t start until the plaintiff was paid so it didn’t matter what he played up until then.

The DJ should have never accepted the job until he got the full amount first. Also, the DJ can't just play the songs HE wants to play if someone give you a list of songs for THIER birthday party you have to play what they asked for. Another thing is if you can't afford a DJ then don't ask for them to attend an event get some speakers and make up a CD or hook up the playlist on your phone to a speaker and handle your music yourself simple as that DEFENDANT!

A good DJ is going to mix and transition songs in and out so you don't dance to the same song for 5 minutes. I do about 2 chorus of each song for about 2 minutes. There are "Spotify DJ's" out there and they are the ones that always have a hard time filling the dance floor.

I do side work as a dj and even though I’m not a professional one I still get it in writing that I’m paid when I arrive. If I don’t I take my equipment and walk out the door. I’m always willing to wait a few minutes if someone has to run to an atm or something but if you tell me I get paid depending on what they make off the door I’m out.

I am a DJ and I think the judge got it wrong. A contract doesn't say to play specific music. And most DJ's don't play requests at a party like that without a tip. Sometimes requested songs don't fit the set. Also, you never want to play the "Bangers" at the start. The DJ is right. You work the crowd to the floor. If it was me, I wouldn't have played until money is in hand, so lesson learned for the young DJ.

Wrong. I agree that the DJ should've gotten paid when he arrived, as agreed, but he also agreed to DJ a list of 78 requests. Instead, he copped an attitude and people were demanding their money back and leaving. Bad move. Bad business. And I doubt that anyone that was there for a good time, would ever hire him, and most likely put out bad reviews.

@@MyPOVvlogs Wedding and stuff, I don't use a tip jar. But small parties where I charge less, I put a tip jar out. People usually tip $1, but sometimes you get that $20 for a special song. You can even Venmo tips.

@@madmaxofspokane1691 My service agreement doesn't say what kind of music I will play. That is discussed in meetings and phone calls. The sheet I give clients has genres and must play songs. I find a way to mix as many of those into my sets. If you give me 78 songs, I will tell you just get a speaker and Spotify.

I have never had an event where the DJ didn’t get paid upon arrival. The DJ should have honored his own contract and left immediately after being told that payment would be contingent on something not previously agreed upon. That being said, the plaintiff comes across as an extremely stubborn jerk. That’s why he lost his case.

Really shocked he lost that !! He did play music and would believe he would have played at the time what he wanted but threw that statement in the letter to the judge out of anger after the fact !! Either way he still did a job and played music that wasn't elevator music !! If you have a contact in place, stick to it!!! The DJ should have refused to play because *per his own contract* money is due upon arrival. If they refused to pay him then he could have sued for breach of contract and sought compensation that way.

Okay so he signed the contract that said the money is to be paid up front. Like I've heard her say a million times, "This is a contracts case." So the defendant technically broke the contract first. Again she says, "If you're not happy with the service then don't use them again, but you can't just not pay." I get the plaintiff is kind of douche for acting like a petulant child, but im actually surprised the defendant got away without paying.... Kinda weird... If you watch Judge Judy then you know, "If you eat the steak, you pay for it!" 😂

I get why the plaintiff lost. He broke his own contract by continuing to play in hopes that he'll receive payment. Not only did he do that he purposefully sabotaged the party after the defendant took too long to pay by not even playing from the list given to him in advance (that he should have already included in the set to begin with).

His testimony was that he did play the set list. So what is he supposed to do... play for free? Seems like the defendant decided he was never going to pay. Not hard to get one family member to lie for you on the stand if you are a dick. The dude is a huge dick. He's gloating in here in the comments.

There’s an old Spanish saying that translates, “the person paying the violinist gets to name the song played.” The DJ should have just played whatever songs that the birthday boy wanted. With that in mind, what broke chump charges people to come to his own birthday party??? There better have been an excellent buffet and an open bar of nonalcoholic beverages!

. The statement that the judge didn't like was the actual truth because they breached the contract when they didn't pay upon arrival so therefore he was doing a favor.

I get her judgement but the part she forgot was at the beginning when SHE even said IN HIS CONTRACT, that he was supposed to be PAID BEFORE HIS SERVICE. So if he would’ve been paid already, none of the other crap would have happened🤷🏾‍♀️right??🤔

I'm not sure why the defendant won. If this is a 'contracts' case - then take a look at the contract. they both seemed to agree on the amount that he charged - defendant agreed to it. Now heres the problem - neither the DJ nor the defendant clarified what should be in the set list - or when it should be played. IF you are the defendant and have an expectation that the DJ play all your requests - then it should be a part of your contract. Admittedly I don't think I would have figured out do that.... so I'm happy I saw this so I will do it next time.

I don’t feel the DJ was wrong AT ALL. Not even for not playing rye songs the defendant wanted. The defendant was supposed to pay him upfront, he tried to play him.

The plaintiff shot himself in the foot with his own statement. For those saying the defendant breached the contract first, you'd be correct, except the DJ accepted a new contract when he was told he'd be paid with profits of the door and he still set up/played music.
