The plaintiff claims she brought it back a second time, and when she tried to pick it up, the defendant told her it was gone, so the plaintiff is suing. The defendant insists he fixed the plaintiff’s phone the second time around, called her to pick it up, but the plaintiff never showed up. The defendant says he waited over 60 days, and his policy is clear: Merchandise left over 60 days is considered abandoned.

Plaintiff went back multiple times asking for the phone, but it was never ready. Plaintiff didn’t have to prove the entire case, they have to prove the phone was taken. No proof needed, because the defendant admits he took it. Now the burden is on the defendant to prove he had justifiable cause to destroy someone else’s property. No evidence, no defense. If someone steals your car and admits they took it, your burden as plaintiff is done because you agree on the facts. Defendant now has to show they have a right to the car. If they don’t have the title and the car is registered to the plaintiff, the car is the plaintiffs. If the car is missing, plaintiff is getting paid. That said, both parties wrong here. Plaintiff wanted to roll the dice on a payday but picked the wrong judge. Defendant doesn’t keep records to backup his standard practices.
