Doctrine of Statutory Overreaching - Effect of Rights in Rem (Part 3) | Land Law

Subscribe to my personal channel for videos on how to study law effectively & efficiently: / @heygarethevans Overreaching operates to detach beneficial rights under trust from land on transfer, so that a transferee cannot be affected by them. On a transfer of trust land the beneficial rights under the trust detached from the land, which means the purchaser cannot be affected by them (so the purchaser takes free from the beneficial interest under trust). The rights then re-attach themselves to the replacement property that the trustees (the legal owner of the freehold) receive from the transferee (usually money). This property becomes the trust property in place of the land.

Does overreaching only apply to beneficial interests under a trust? Also, what is the difference between overreaching in registered land and unregistered land, or can it only happen in registered land?

3:00 there in simple trust can be a trustee and beneficiary but that doesnt mean there cant be more than one trustee and one beneficiary. just understand this concept
