Arkansas Game and Fish Officers observed a boat traveling near the Highway 70 bridge on Lake Hamilton with a passenger standing on the bow of the boat, outside of the railing. Before the officers could reach the boat, the passenger began hanging off the side of the boat with his feet and legs in the water while the boat was underway. A stop was initiated on the boat, and the officers observed the passengers attempting to hide items as they approached. Upon making contact, the officers detected the odor of intoxicants emanating from the boat. The driver of the boat had left the driver's seat and moved to sit in a seat near the front of the boat. The occupants were informed that the boat was stopped because of the passenger riding on the gunwales. The driver, later identified as [REDACTED], denied having consumed any alcohol. Upon closer examination, [REDACTED] displayed signs of intoxication, including unsteadiness on her feet and the smell of alcohol. Field sobriety tests were conducted, revealing further indicators of impairment. [REDACTED] was subsequently arrested on suspicion of Boating While Intoxicated (BWI) and transported to the Garland County Detention Center for further processing. Additionally, citations were issued for various boating violations, including riding on bow or gunwales, exceeding safe carrying capacity, and inadequate personal flotation devices.
