Some patents like that are still around. In the PS3/360/Wii console generation a company (I believe Capcom) had a patent on minigames on loading screens, so very few if any games during that time had them.

There's never been a Did You Know Gaming episode dedicated to Super Mario 64? Hold on... (Does a little digging through the history of DYKG) Holy shit, there hasn't. That's... shocking... to say the least... We even got a Kirby 64 video long before Mario 64 got one.

I wonder if any of the new stuff added in Super Mario 64DS was some of the content originally cut from the regular Super Mario 64? That would be pretty cool if some of it was.
