A letter Erik wrote to his cousin that may confirm the abuse 8 months prior to the murder which could eliminate the “they never told anyone” argument stating they made it up for the trial, and a member of a boy band, Menudo, that worked with Jose came forward stating that he was SAd by Jose. Those are the two biggest pieces of evidence that have come to light with no extra hype :)

I feel the Menendez Brothers would not be sentenced the same today. They'll need support on the outside. Our Justice system could use a few tweaks to deal with fresh evidence and reconsideration for the lives of possibly innocent citizens. In some states, they're allowed to be executed.😢 Also, the cost of incarceration is Huge, compared with rehabilitation and integration. I believe they deserve a chance.

Re Menendez bros. It was the first trial that was televised and also the trial that included details of SA, including both brothers testifying. That resulted in a hung jury. The 2nd trial was not televised, and the judge didn't allow SA as motive, nor allow immediate family members to testify.
@quEEnbItch99912 күн бұрын
The judge should be charged for his blatant prejudice against the brothers. Disgraceful behavior.

The Menendez brothers need to be released. Their stories of SA haven't changed in 35 years. If they were girls, they would have only been charged with manslaughter and been released long ago. In the 80's/early 90's male SA wasn't discussed and certainly wasn't believed. They have been exemplary prisoners and never received a mark on their prison records. They served their time.
@kiraina2512 күн бұрын
I don't think I can agree with that. It's true that society still has a hard time "believing" that men can be r*ped, but it's very common for women who retaliate against their abusers to be charged to the fullest extent of the law, even when they have a credible claim to imminent self defense.
@LovetheLed12 күн бұрын
I don’t believe that the Menendez brothers represent a danger to the public. They have been in prison for decades so maybe parole would be appropriate for those reasons. I NEVER believed that they killed their parents “for the $”, as a motive. A crime like that doesn’t happen in a vacuum and the brothers were very spoiled financially already. The emotion that they exhibited during their testimony was very believable to me. Using financial control was a huge part of their dad’s mental manipulation.

I would like you to review all the motions entered by David Conn and Carol Najera and accepted by Judge Weisberg for the second Menendez trial that ripped out their evidence, plus the fact that when all the corroborating evidence was disallowed, the judge then barred the defense form arguing imperfect self-defense. Also maybe cover all the people who have since died since the trial, including Andy Cano, cousin, the lead detective Leslie Zoeller and the (IMO at the time) horribly pompous and ridiculously vengeful second prosecutor David Conn. Also defense attorney for Erik in second trial, Barry Levin who died from suicide. Most of all I'd love it if we could hear from Leslie Abramson on all this, although it seems she is retired from public life.
@carol576312 күн бұрын
Also that once the prosecution was able to keep corroborating evidence out, Conn got up and argued during closing that there was no corroborating evidence! I'm enraged to this day about this.

I have decided to listen to the 1st Full Trial that resulted in not 1 but 2 hung Jurys. Each brother had their own. The resulting second trial, from everything I can tell, gutted their defense which I believe led to an unfair 2nd trial. I am still torn as to whether I believe they should be released or not and am hoping listening to the 1st trial will help me land on one side or the other.
@amell.54616 күн бұрын
I doubt I'll change your mind but I'll try in my bad English. I'm a French lawyer and I can't believe your legal system is so unfair. These kids were r @ped by their father since the age of 6, they experienced horrendous abuse, and the father forbade the younger brother to talk about it to the elder while convincing the elder that he had to comply with his demands or he would attack his little brother. The mother knew and thought that they had to take it because they had money. The murder happened one week after the youngest confided to his older brother and told him that his father wasn't allowing him to let him move to the University dorm. Imagine the same story but 2 strangers kidnapping the kids, how would you feel? They've spent their whole life either being abused or in jail. It's been 35 years, and there's no legal reason to keep them jailed. The father was very influential and had total control over his children's lives. He threatened to kill them several times and used a knife to force them to comply. He was a powerful music executive who abused other children (singers). A member of the group Menundo recently testified about it. I genuinely don't understand why you would be torn about their release, it's the human thing to do. Besides they were very young, 19 and 21 years old, and sentencing young people to life in simply inhuman., especially when they've been victimized their whole lives. If you watched the Netflix tv show, you must know their depiction is false. Ryan Murphy admitted that he wanted to intentionally create doubt in the viewer's mind.
@nikkie59125 күн бұрын
Interested in how newly discovered evidence comes into play so many years later. I'm guessing it falls in the mitigating circumstances that then plays into length of sentencing. But the legal implications of it all would be helpful.

i remember the trail. At that time male sexual abuse was unheard of and I think it was hard for juries to grasp that. Today we are not shocked when this type of abuse occurs. I think if the trial had been more recent, their sentencing would not have been as long. It is not unlike the Francine Hughes trail for killing her abusive husband. by setting his bed on fire. It was groundbreaking trial and defense in acknowledging spousal abuse.
