There are a lot details that were left out. Both women he killed were mothers to his children and were victims of grooming/rape. He started messing with one when she was ELEVEN years old when he was a school resource officer in her school. There were multiple investigations but the state and city did nothing. Even after the child had his baby. He eventually left yakima PD only to start working at richland school district where the ex wife worked and the school district said they did a background check on him that didn't show the publicly available criminal investigations. He then murdered both women and all children are now orphans. All entities failed these women.

Depends on whether the institutions named did the required minimum to protect her or failed to at least meet their obligations under law to intervene. Example... if he is trespassed but you don't do your job of calling police to remove or arrest him. That is not asking for a personal security guard. That's expecting the school to do the simple job they are required to do and ensure he doesn't come back on campus by doing things like locking the doors and calling police when he is on the property. Your bias is showing when you offer exaggerated the family's claim. Lawsuits like this have been won many times before because the institution did not do the minimum required. I'm not a social media n\blowhard, so I can't say if it will be successful because i don't know the details of the facts in this specific case, but it isn't unreasonable to hold an entity responsible and many have been in court.

@@ElChingonFPV The trespass is already a part of the minimum. If the wife herself didn't know he was there, I can't expect the school to know. However, the lawsuit should bring out these details if handled correctly. Time will tell.
@ElChingonFPV20 күн бұрын
@@KingdomeBleachers Exactly where did you get your legal analysis on this issue? I am curious what legal rule you are applying to determine that issuance of a trespass is the minimal requirement. Can you share that? It defies the basic rule of torts action. As a former police officer and current attorney, I can tell you there are cases in which an entity is successfully sued because you have to "enforce" the trespass to make it work. The only one that can enforce it, is the owner (management) of the entity. A business could potentially be sued if they trespass a person but don't enforce it, and that person is subsequently harmed on the property, as failing to enforce a trespass warning could be considered negligence, depending on the specific circumstances. There is a "Duty of Care" rule that states, even though someone is trespassing, a property owner still has a basic duty to warn of breach of trespass. There is also a "Foreseeable Harm" rule that states that if a trespasser is likely to be on the property the entity may be held liable for not taking steps to prevent harm. All jurisprudential rules applied in previous lawsuits. Again, I don't know the specific details of fact, so i don't know if the school failed in any of this requirements, but they might have and could be held liable.

This guy is a waste, but suing the school district will not bring justice. Yakima schools are garbage to begin with. They have no money. Suing schools just makes the citizens pay for it. In cases like this, every single PERSON involved should be fired and sued directly. So the Chief who "failed to retrieve" his YPD gear, the school district Superintendent, etc. Fire them immediately and sue them directly. Take their pensions. This kind of stuff will be more aggressively avoided when individuals know the city won't bail them and let them keep their jobs.

Was dispatched to Everette NAVAL BASE to fix up a destroyer, and roomed up where covid slammed into the USA. My life was being stripped back home, when I went to u haul my things from a 7 year relationship the cops assisted. My ex started flirting with the cop , offering him beer, grooming officer Finnely's ego, he denied retrieving my Fender tube Amp, then came time to leave, she tried to keep my truck, I threw some trash outa the bed and emmediately he drew his gun and screamed at the top of his evil lungs, I barely made it out alive.I found my Amp in a pawn shop a year later, got it back."praise God"
