Everyone has a left a key under a door mat, rock, inside a pot, etc. At some point or another, i don't do it habitually but if you know a guest is coming and you'll be gone during their arrival. Dropping a key off for that occasion doesn't seem as dangerous. That being said if you leave a key their permanently that's a problem.

Years ago a car like mine parked next to me while my friend was in the store. He got in the wrong car with a lady still sitting in it. They both had a look of horror on their faces. She was forgiving after realizing he meant to get in my car. We both laugh about it now.

Actually 3 years ago someone made that 911 phone call for real in my town. Just like this story a cleaning company found an open door and cleaned the wrong house. When the owner came and finds her spotless house she called the police. The TV station released the conversation she had with police dispatcher. Police, what's your emergency Lady, my house is clean!!! Police excuse me! Lady, someone broke my house and cleaned my house!! Police, is anything missing Lady, yes! a lot of dirt and dust with LAUGHTER!🤣

No, he wouldn't have been charged with burglary even if those neighbors were not understanding. It's trespassing at best, and only negligent. No sensible prosecutor would charge him.

To get convicted, intent to commit a felony would have to be proven. Clearly there was no intent to commit a felony, there was no criminal intent at all. No prosecutor would waste resources on a case like this and risk getting recalled over it.

Gosh, leaving your key under the mat is one thing, but when it's an apartment complex and that's the only possible place you can hide a key under... kind of makes it easy for people to walk in anyway, don't need to look that hard. Good thing they only got a good surprise!

FYI to all the people that leave keys under their mats or near their doors, your insurance will NOT payout a claim if they find out you do that and that's how you were robbed. They will consider it YOUR negligence. Leave your spare key with a friend, family member or hidden in your car. (NOT the glovebox next to your registration with your address on it though.😂)

If you’re in a house and not an apartment then you can get a little lockable box and put it out of view. That’s what we do and it’s saved me so many times. It might be hard for people to find a place to hide it though as they’re quite bulky.

He technically did break in. Granted he did it very easily, but it's still a brake in. If I opened an unlocked door that would also be breaking in. I think what he did was breaking and entering without the intent to commit a felony.
