I practiced defense law for years, and I appreciate your thorough thoughts. The one thing I would say is that the impact of her actions go beyond those of a common thief- she also put potentially millions of people at risk of getting misleading test results through the shoddy product Theranos delivered. The impact of that is hard to overstate.

As always, a very thorough and thoughtful analysis! I have to admit that when I first heard about this case, I was leaning toward her innocence. I can be incredibly naive at times and wanted to give her the benefit of the doubt. You know, something like - she didn't mean to defraud anyone, she just really, really wanted her machine to work at some point. But with each passing day, it's looking worse and worse for Ms. Holmes. I hope she can take the advice you offer in this video, should she find herself heading to prison. P.s. one thing I didn't believe for a minute was that pathetic attempt to blame Mr. Balwani for abuse and control. Pfffhh. 🧐🙄

It was the Federal Prison at Elgin AFB in FL. I lived there in the late 1980’s, saw the prisoners running on the trail around the base. I also took college classes in the evenings 95% of the students were people of all walks of life - the other five came from the federal prison. There were many people unnecessarily damaged by false health readings...some life or death. It's very strange to me that people are openly saying they want her to "suffer" - what she did was wrong, but her suffering isn't going to change that one way or the other. If anything, we should hope that she has an awakening of consciousness and understands that the reason why she is in prison is not only because she defrauded investors, but because she lived in a self-maintained delusion that she could not or would not let go of... It will be a huge shock to her, because she's been quite patriotic, even optimistic about the side of America that she has known -- until now. She'll understand that she isn't in any way 'above' other people, but will she fundamentally change her core beliefs? I'll leave that to the psychologists...

I would like to know the vested/monetary gain bilked from earnest victims with the stress and future plans destroyed of those victims. I would like to know the homicide rates, suicide rates, family breakups, foreclosure rates, the overall medical and health issues associated with the victims to say she and others were nonviolent offenders. There are different ways to brandish a firearm and there are different techniques to use force for abuse of others. If we as a society say, ok, you as a victim knowingly went into this to better your own life and that off your family then there is procured violence in curing polio or any other disease. So where would it stop when society creates this windfall for the scammer to get rich and bilk those who actually have the funding support to cure diseases or fight debilitative circumstances? Do we say the American Heart Association, Cancer Research, diabetes Foundation or a host of blood born diseases are all defunct therefore our hospitals and pharmaceuticals are all broke because of "no more i vesting at all?" Because of people like elizabeth holmes? Where is the societal break-point for funding? On her? Bernie M.? Or a thousand others talking a good scheme? Break her. Break a thousand others like her. I assert what she did is not non-violent. The ramifications of her zeal "to go after it at all costs be damned" is far reaching within several communities of society. The depth and magnitude no doctor can rehabilitate, no hospital can fund. Yes. Club Fed needs to be re-thought.

Wait, "the Government doesn't care about intentions"? Isn't that the whole and only point of the trial, to demonstrate intent beyond reasonable doubt? Unless it is meant that, in order to achieve the first goal of indictment, the Govt. initially doesn't care about intentions, and only later during trial it is when they will make sure to prove intent. Am I getting this right? If so, that seems very, very wrong and unethical. It seems the order of operations is so unjust. I mean, in this and probably most cases one can immediately tell that she is guilty of something, but in general, it seems the process fails to recognize the humanity of the defendant and focuses more on getting the job done. I must be missing something; I am sure the philosophy of the point I am trying to make has been argued extensively and settled too. It's probably just my ignorance of the law so I would very much appreciate some light. This channel is great, by the way! Keep it up!

A lot of people want to see people who commit crimes punished with no special treatments because they are celebs or high profile/rich people. That does not mean we want them to suffer. We want equality given to the rich and famous for the crimes they are convicted of. So don’t represent everyone who wants equality given to criminals as people who want them to suffer more because of who they are. Then you said the people who should be .... are the victims and investors. Those people represent all of us!! Just like if someone is taped or murdered many people are outraged with that crime that may not be the actual victim. Many are upset with criminals whether they are the actual victim of the crime or not. Ugh 🤦🏻♀️. You don’t have to be the victim of the crime to be upset with the crime. Geeze!!

Gods commandment tells us he is the final judge, and that vengeance is his, this is a blessing to humanity since Jesus demonstrates that he who is without sin can cast the first stone. We are all but the blessed Virgin Mary born with our parents original sin. So, God will judge those born in original sin, by the way we treat the least among us. That includes death row inmates. Loss of freedom in humane conditions with no possibility of supervision or housing specifically for violent offenses and crimes against humanity will ever do. If you ask victims of violent offenders they pray God, these people are not released again to harm people, and that torturing the violent offerings means civil living humans buy into violent or inhumane punishment that is properly reserved for God. Forgiving evil doesn’t mean forgetting it just means humanely housings for violent people,... so that the victims that sent them to death row are their last on earth. And the victims are not just the abused but the whole earth suffers when a blind eye is turned to evil.
