I understand a number of people online, including me, are covering the trial of Theranos Founder, Elizabeth Holmes.
Our team has insights that can only come from enduring a government investigation, including facing a federal sentencing hearing and time in federal prisons and federal prison camps all across the country.
Given our experience, we want to help others, including Elizabeth Holmes, better understand what happens following a guilty plea or conviction.
Some of these steps include:
1: Pre sentence report (PSR) - Beginning the investigation:
In federal prison, the pre-sentence investigation report will be the main document administrators will use to make assessments, especially at the start of the journey.
• Case managers will use the document to consider the severity of the offense;
• Counselors will use the document to determine who can visit the offender;
• Educational administrators will use the PSR to determine whether the prisoner is required to participate in programs;
• Psychologists will turn to the PSR to see whether the individual is eligible for beneficial programs; and
• Medical personnel will turn to the PSR to determine whether the prisoner merits medical attention
2: Personal narrative and character reference letters to augment the sentencing memorandum:
In our view, the narrative and letters will strive to accomplish the following:;
• It will help the judge see and understand Elizabeth Holmes as an individual
• It will help the judge grasp influences that led the Ms. Holmes (or any federal defendant) to the current situation
• It will help the judge see aspects of the defendant’s life that could not be conveyed by the defense attorney’s eloquence alone
• It will help the judge see the defendant in her own environment
• It will help the judge learn what other people in the community think about the defendant
3: Preparing for federal prison, including:
Step 1: Prepare to Document the Journey
Step 2: Establish a Primary Point of Contact
Step 3: Understand Financial Implications
Step 4: Create Deliberate Reading Lists
Step 5: Create Journaling and Writing Plan
Step 6: Prepare Personal Belongings
Step 7: Understand Medical Preparations
Step 8: Develop Personal Communication Plan
Step 9: Create Your Quadrant Guide for Decision Making
Step 10: Engineer Your Release Plan
4: Master life in federal prison, including staying connect with her network, avoiding disciplinary infractions, and pursuing programs that may led to her early release from federal prison. One specific program, The Residential Drug Abuse Program (RDAP), can take up to 12 months off a prisoners sentence--it is the only early release program that exists in the Federal Bureau of Prisons.

Why is white collar crime less criminal, and less deserving of time in prison, than blue collar crime? If I stole $400 million from a bank I'd do 30 years. Holmes should do the same.

Because rich people, lawyers, politicians, and the white collar class made the laws. They were covering their asses, that's why. I am a foreigner, and it's the same everywhere for the same reason.

@@shatoyawashington7575 There is definitely some truth to the belief that lawmakers and others involved in the criminal justice system favor their own kind. Not only their own socio-economic class but also their own race. The justification for the disparate sentencing laws is often the absence of physical violence in white collar crimes. White collar criminals rob with a scam not a gun. I doubt that offers much consolation to their victims, however. Also, there are many different white collar and street crimes so it's hard to generalize. I doubt the disparity is attributable to covering their own asses because very few would ever expect to become criminal defendants. It is more about the value people place (or fail to place) on the lives of others.

Isn't it ironic that those who are celebrated for their intellect and innovation while their scams are flying high, are suddenly clueless when their houses of cards come tumbling down. To quote SNL's famous Church Lady, "How CONVEEEEENIENT!" I know one juror had to be excused from the panel when she disclosed that her sympathies for E.H. and the fact that she had a newborn baby precluded her from voting to convict her. The jails and prisons are full of wayward parents. The fact that Holmes chose to have a baby, KNOWING she was facing a criminal trial only point to her manipulative ways. The thought of that angers me beyond words.

Yes, jails and prisons are full of new parents. That said, she may be convinced of her innocence--regardless of what we think. She should have the right to live her life and that includes having a baby. Some will see it as manipulative, but as a father, I pray that is not the case here. Maybe on this point, I am naive and and am a "sympathizer" as some have called me. They may be right.

Well, for my part all I can say is when I went up for sentencing....I remember a few people before me arguing this and that, tough childhood etc. I had to be honest both with the court and more importantly, myself. Enough lying already. When the Judge asked me if I had anything to say I just told her.... I want to say how sorry I am to the victims. They didn't deserve it and they should be paid back in full as quickly as possible. For my own part, I have no excuse. I can't ask for mercy nor do I deserve any. I was raised by people who loved me and cared for me at every turn. I was encouraged to do the right thing and walk the straight path. I have shamed those who have gone before me and who showed me that example on how to live a life. My only salvation is that they are not here to see this. Your honor, I'll simply submit to your judgment. I got 15 months.

It is much easier to get carried away in the moment and do things we regret later then we like to think. The Jan 6 event was an example of that. Many people got carried away, so lets move ahead with a certain amount of compassion.

The baby is a mitigating factor at sentencing, but not enough to keep her out of prison--presuming she is convicted.

The juror who was recently released said she couldn't bear being responsible for sending her to prison. It only takes another juror with a similar reservation to hang the jury and a mistrial. Being a recent mother is a very powerful deterrent for her being convicted. Celebrities convicted in the college scandal got a slap on the wrist even though their actions were patently fraudulent.

There is no real comparison between the college scandal and the alleged conduct of Elizabeth Holmes. The government in the varsity blues college admissions case acknowledged in filings there was no financial loss or victims. Elizabeth Holmes allegedly defrauded investors of nearly $1 billion and put patients lives at risk. Further, parents in the college admissions case accepted responsibility, or at least most of them did. If there were a mistrial, the government would retry her, of that I am sure. The fact that Holmes is a WHITE mother may sway some jurors; but when you look at the incarceration statistics, those who would sympathize with Holmes aren't quite likely to be so sympathetic when defendants with darker skin face trial, criminal conviction, and jail or prison time. Jails and prisons are filled with parents.

I was a straight-A kind of student, and if someone who hadn’t worked as hard as me but had rich parents took a place I could have had, I think I would have felt pretty hard done by. That’s my take on that one - bright, deserving people were denied extremely valuable opportunity in favour of rich people.

I gather from this video, If you are going to do crime show up at your local bar regularly act wasted and show a pattern of alcohol abuse. If you get busted claim you didn't know what you were doing because you're an addict.

Thank you for your comment. Our team, of course, never encourages people to lie or make up that they have a substance-abuse issue. That said, many people actually do. If they disclose it properly, they can get treatment and also get out of prison early. To your point, however, I am sure there are some defendants that fabricate a problem simply so they can get out early. Most, however, get caught and the consequences are significant.

This has been a very useful video. There is a lot in the justice system that is unknown until you break the law. Young people should be taught laws and penalties since I believe it will help them to avoid problems and also not make things worse when they do screw up. For instance, running from the police after committing a felony can get you shot! How would you know that you committed a felony unless someone told you. So, your video is fantastic at explaining this pre-sentencing/ probation interview process. Thank you.

Thank you so much. I appreciate your words and insights. And I agree. In my case, I dismissed lessons on laws and the consequences of bad choices since I never imagined I would get into trouble. I didn't know people that got into trouble. I was naive, stupid and wrong! Kids must learn the consequences, yes. But more important is developing the right value system, then finding value in holding yourself accountable. Again, thanks for insights.

I believe that Probation should be the start of a process of objectively looking at what has happened in the context of Criminal Psychology in general. If the defendant can start to understand why what he or she did was not acceptable then they have the opportunity over time to make changes in their behaviour.

I think that those of us that have been through this, can help others, not see a flawed system, but to rather accept accountability and then come to terms better with the BOP DOJ system and what we're will endure. Ok city transfer was a wakeup call as was "con air" the three times I had to be moved. There is more than one way to depart from sentence atleast one our female side there was.

I think people who are guilty can both accept responsibility (or accountability, as you call it) and also acknowledge this is a system that perpetuates failure and extinguishes hope. Recidivism rates in this country easily prove our systems of corrections is not working.

@@WhiteCollarAdviceOfficial yes I understand I've done a lot of speaking on the topic of Recidivism to employment agencies and probation and parole meet ups on the topic of employing ex offenders, as well as disabled ex offenders. I was more on the helping side of those adapting while re entering society that didn't go in with expensive Federal Defense layers, but rather useless Federal Public Defenders, such as I had, getting my own time reduced as I did on my white collar crime. I helped many and volunteered to different agencies as well as mentored females re entering society and trying to get their children and their rights back.

I enjoyed the description of what a prisoner experiences on entering the prison system. I admit to being biased, but hope Elizabeth Holmes gets to see how some other folks live. She put on a pretty good show thinking the health care industry was easy to reform while she was without any medical degree whatsoever. Her good looks get her a long way.

You seem to think Holmes here do not really have a ghost of a chance...as I think the defense so far do not have any real defense. But it appears a lot of everybody else seem to think she JUST MAY get off.

Sadly, she'll be just fine. No jail time no matter what the jury does. E.H. is also incorrigible because AFTER she did the SEC thing and was ordered to not become a CEO ever again, she was "caught" doing it again trying to raise cash for another startup. Personally, when she gets through all of this, she'll become a New York Senator. I'm being serious. Right after Hillbag2000 got caught stealing $250,000 worth of W.H. furniture, she was elected Senator from New York..

Martha Stewart seems to be the only individual with an ultra high-profile to see the inside of a prison. Nobody else around 2009 faced the financial music. Financial crimes are expected of men. That's just playing Hardball. A woman, albeit unfairly, sticks out like a sore thumb.

I'm getting ready for the wrist slap heard 'round the world, tbh. Yeah - no confidence she'll be treated like the usual criminal, if convicted. I suspect she'll be given a yellow safety vest and told to pick up litter for 6 months. MAX. That'll rehabilitate her for her legal indiscretions, surely.

Gibson Guitars - Yep, I think you're right. I can feel it already. The Force is powerful on this one, Luke. I simply don't see her doing the Orange is the New Black dance. Even if she's convicted, the judge will stay serving her sentence until her appeals are exhausted in 2031, and then put her under house arrest for 6 months.... because, you know, it would be cruel and unusual punishment to take away a suckling baby from its maternal teat, and then a young child away from his mother in his formative years (unless you're poor, black, fat, or ugly). The only good thing about her being found not guilty is it will force all the Hollywood movies in pre-production about her to have to re-write the entire script in order to avoid a defamation lawsuit.

At first the aspect of white collar versus blue collar put a bad taste on this for me but anyone is entitled to defend them self when convicted. Also if no one was physically threatened should be taken into consideration but I dont think miss holmes can make that claim. As a former chronic alcoholic and heroin addict I think she might have a hard time making a substance abuse claim however it is suprising how many people in elite circles are able to hide their involvement in that behavior. From what I've seen I thought medical care in prison was pretty good mainly because theres the threat of law suits which prisoners can file. I read your on line biography and I hate to say it but I just don't believe you were ever unable to discern right from wrong. However I admit that in the world of finance things aren't always black or white. I hope that dosen't smack of racism.

@@WhiteCollarAdviceOfficial - Like your channel (and your org), but I have to agree with the doc on this one. No way she invokes a drug disability if she's convicted. It would literally have to be manufactured out of whole cloth and would be vigorously contested by prosecutors. Besides, she doesn't need to. She's a reasonably attractive young, white woman. They're exempt from all laws and life consequences, just like they are exempt from registering with the Selective Service by way of birthright. This jury will likely be hung or vote not guilty. These 3 women jurors who were dismissed are a random sample of the jury pool in this case and show a frightening screen capture of just how stupid the average juror is. Dumb jurors will always convict anyone who the prosecutor wants unless they 'like' or identify with the defendant in some way. This is how EH - a brand new mother, young, reasonably attractive, white, dresses nice, magazine covers, etc - wins her case. These type of jurors are simply incapable of assimilating all the evidence of a complex case into a rational verdict if it goes against their "awe, I feel sorry for her" intuition. Instead, they vote to acquit if they 'like' the defendant and vote guilty if they don't like the defendant. I bet you the court-issued notebooks of all the jurors have the doodlings of a patient in an insane asylum (along with baking recipes, of course). They'll vote to rubber-stamp whatever EH's lawyer spews during closing argument even though the prosecutor won this case hands down with a monumental salvo of damning evidence that transpired over a period of 10 years and shows EH lied every way from Sunday to her investors about material facts in order to keep her gravy train flowing. You don’t know that. She’s capable of alleging sexual and mental abuse, so she’s perfectly capable of trying to manipulate the system by saying she had substance abuse problems, surely?

@@internetpolification - Remember, the drug addict defense is only something she can offer in mitigation of her sentencing during her pre-sentencing process. It won't weigh in her defense of guilt or innocence at trial. And she really can't invoke the battered women defense by Sunny "Svengali" Balwani because (1) he won't testify for either side on the 5th (2) there is no compelling evidence her attorney can present that demonstrates she was a battered woman in any text message or anywhere else let alone that she was some kind of dragged-by-her-hair-caveman-style victim for the 10 years Sunny was at the company (3) EH will never take the stand because the prosecution would rake her over the coals and knows she's really a coward when confronted on all her lies (check out her SEC deposition, which shows what a complete coward she is in her answers) (4) EH's megalomaniacal behavior both pre-dated and proceeded Sunny's involvement with the company (5) turtleneck Blondie gave way too many over-the-top on-air interviews where jurors can see she was clearly the captain of this ship and running her mouth with all sorts of butchered Steve Jobs life aphorisms - e.g. "First they call you crazy, then you change the world, and then you go to jail." That defense is just a last ditch head fake to scare the bejesus out of the government in the desperate hope to get them to offer her some kind of last minute plea bargain (or influence the jury pool). That defense was never ready for prime time and ain't gonna be invoked. Even if she's convicted (unlikely), the judge will stay her sentence until her appeals are exhausted in 2031, and she'll never do more than a Martha Stewart sentence. If the 3 jurors who got cut from the team are any indication of the rest of the brain trust on this jury, they'll probably come back with a NG verdict in 30 minutes and then give interviews to the press about how there was no evidence she did anything wrong since she once organized a fund-raising dinner for Hillary Clinton. I'm actually surprised Christopher Wray hasn't already fired the FBI agents who investigated this case (after all, jails are only for Trump supporters).
