Both in self-defense, right? Justified? They were planning on killing Walt from early on before he caused the chemical reaction that killed Emilio...then Domingo was going to 'plate' him even though Walt was going to free him. Keep track of every life that gets taken in this show...lol

The season is so short because the writers strike happened before they could finish it, so they cut it short! (In retrospect it was the best thing that could ever happen to this show, because it made them change something about the series, and it turned out perfectly. Don't look it up before you're done watching the show though, for spoiler reason!)
