In former Memphis Police Officer Preston Hemphill's decertification documents, it was stated that Preston Hemphill did not use his Memphis police department issued handcuffs, which were Peerless Model 801. It's not clear why he used his personal handcuffs and why he didn't have his department issued handcuffs.

Yes but they did the same to a teen days before. What saved him was neighbors coming out. The police are like a gang. The leader names the target and the rest attack. No questions asked. They do it all the time. Then they cover for each other. The 'Dom', captain, officials, absolved them.

I mean the bandage industry is a huge market so ppl buy them for play but.... keys are standard and not individual so if you purchase a set, you have a key that would unlock any hand cuffs that are the same brand. If the key goes unnoticed on a packed key ring and you are cuffed, you can release yourself and escape . 🙃

Don't understand why handcuffs or whether the cop/murderer's shoelaces were untied should eclipse the fact that these five cops senselessly continued to beat the victim till dead? That is the issue. All else makes no difference. The "can't see the forest for the trees" syndrome, is part of the reason why justice is hardly ever served. Nothing else matters at this point, except that the people, including the police psychologist that gave the recruitment the green light, should all lose licenses, jobs, retirement, the works. A life has been lost in a tortuous brutal way. Justice delayed by focusing on the "irrelevant" is injustice. Lawyers and judges and court cops make a ton of money in cases like this by behaving like vagabond snails. Let's all get a reality check. I see people are going crazy about a cop using personal handcuffs, I'm a retired federal agent and in 30yrs I've never seen anyone that didn't have their own cuffs, the standard Peerless police cuffs that most agency uses anyone can buy and has a universal key that fits them all. Most agencies including mine only issue you one pair which in some cases isn't enough. It's also not against agency policy as long as it's the same type of cuffs you're issued. We also carry extra magazines (our own) for our weapons because you never know what's going to happen. These guys make me sick to my stomach but this is a non-issue in this case.

@Dr MahaKok every officer carries multiple cuffs and they are approved. A lot of departments only issue one pair. As a former officer I have had to cuff 2 or 3 people in one event. Honestly it's not a Trying to do something Shady issue. I guarantee you that a majority of the police officers on the entire police force in the United States has 2 or more cuffs. This is not to justify his actions but This is Nit picky and leaders trying to cover themselves

As a sc so, I could not carry any item that I was not certified to carry. In sc, so(s) are not allowed to carry the rigid hinged cuffs. They are too small for most people They do not allow for movement of the arms while cuffed Etc... They are determined to be torture devices. As for firearms, the caliber must be 9mm, 40, or 45. I carried a 9x18 mak, cz75bd, and a Glickman copy of a glock copy of a glock copy (piece of shit gun). This is not a new idea. Only carry that you have either been certified to carry or what table of equipment - toe - the pd allows you to carry. I understand this absolutely.

I am a retired police officer, have viewed to video of the incident and found it disgusting how the officers WHO BEAT Tyre behaved, and agree with their termination and arrest. However, ONLY the officers who assaulted him should be charged with his death. The one that kicked him in the head, any who struck him after he was handcuffed and in custody. They need to NOT fire/charge officers who were merely present or did not have department issued handcuffs. Having said that. If an officer lied during the follow up investigation- fired.

In my opinion, the handcuff model number, or not having a department issued handcuff is an important piece of information that can be traced to a crime. If they had a successful handcuff Trye would he have been taken to jail or would he have been taken out in the woods somewhere in handcuffs hanging on a tree? In the latter case, it would be difficult to trace where those handcuffs came from and who placed them on him .

It is important if his motive was to use them in a crime . Him not using the handcuffs issued by the department would make it difficult to trace the dirt back to him.

I fail to see the big deal. So what? Cops sometimes hate the cuffs they are issued and buy their own. Sure, its a violation, but I've never heard of anyone ever making a big deal out of it. And you never bothered to give us your insights into the implications of this. What harm do you see in it? Hemphill only did two things that were borderline serious. He tried to tase a fleeing suspect (allowed in some cities, but not Memphis) and he might have lied about Tyre going for a fellow officer's gun. Neither of those had anything to do with the death of Tyre Nichols. In fact, if his taser had worked Tyre would probably still be alive.

All of your points are valid. I think that's why he hasn't been charged yet, and it's not certain that he will be. I think Hemphill is following his attorney's or representative's advice and being careful about providing additional info that could later be used against him. While the handcuffs and the taser issues were both Memphis policy violations, I definitely the taser violation of policy is definitely a bigger issue for him. I'm thinking of talking about that in a separate video.

@@mslegalista Memphis PD doesn't allow a taser to be used on a fleeing suspect. However, their justification for terminating him was far-fetched. There was no traffic at the time. He couldn't have hurt anyone esle by being tased. Memphis PD lied about those issues.

Brent, thanks for your comment. I thought the missing handcuffs were an issue. However, a couple of other people told me that police officers routinely have backup handcuffs that they use. I didn't know that was a normal practice to some extent. But then, the weird thing was...Memphis PD wrote up Hemphill for not having his regular handcuffs. So, then I was totally confused. Another person then said, they thought the PD was just using him not having the handcuffs as something else to add to make Hemphill look bad in the decertification. So, it sounds like...in most jurisdictions back up handcuffs aren't an issue, but Memphis PD still included Hemphill not having the handcuffs as part of the decertification documentation as a violation of Memphis PD policy.

This is not a big deal. A lot of cops do not use the department issued cuffs. I used my own cuffs as well when I worked the streets. This is just the department using this and all other means to greater justify his firing and decertification.
