I have also watched a lot of these brothers' court appearances and not just the movie and I thought it was just the mom's side who wanted these brothers to be free but The father's sister also said he controlled the extended family and everyone was to scared to question him about how he disciplined his kids......None of them knew about the rapes though and I believe the extended family. The amount of stories I have heard from even people recently who knew of the family or worked under the father in previous businesses have never had a nice word to say about the dad.......I honestly believe he would have killed them had they not have killed him first.

I don’t think he said he “believed” him. There’s nothing to believe or not believe. The facts of the case are clear. The boys were abused. They also killed their parents as grown men. And they also spent the money. All of that is fact. And what he was saying is The Law. Under the law all family members no matter if they know the murders or not have a right to finalized sentencing. That’s the law. You have to change the law. If you want Uncle Milton’s rights not to be heard

I live here in California and I want them re-sentenced. I don't think life without the possibility of parole should be changed since we got rid of Death Penalty which I was mixed on.

@@jenniferhansen3622 That is probably why they are working so hard to get them out, meaning they feel a lot of guilt. I agree the should have done more, but I also understand it's blurry when it's your own sister who is the mother. I haven't really heard anyone from Jose side knowing about what was happening (but I haven't read the whole court case so I don't know).

All the expended family KNEW the father was vindictive to his sons but they didn't know about the rapes and I BELIEVE THEM. ......I am about these brothers' ages and I was never raped but I did grow up in a violent household and to anyone looking at my family they thought we were the perfect family. Their father was an EXPERT at manipulation and I can see how they wouldn't have known.

I couldn’t have been on that jury hearing how they were raised, that jury would’ve been hung. He’s not telling all of their story, missing key parts purposefully I think. Most of their family members saw the signs that they were being molested by their father, the mother knew and did nothing.

Yes the family member saw the signs. That put weight to the brothers statements. Recentencing them with second degree, consider their age when the murders happened. They have done more than 30 years, have behaved very well in prison and helped others. Release them.

The only evidence of molestation was testimony from their therapist that Lyle molested Erik. There was no credible evidence that the father molested them and they only came up with that story AFTER they were arrested and on trial for their lives.

In other interviews he did say that they well might have been abused, however, they blasted their parents off. And murder ist still a crime.

Law doesn't work like that. It's determined by precedents. This ruling would set a dangerous precedent that would have to be followed. (Although, I hope they do get released by way of a pardon that wouldn't have to include setting such a precedent)

@@tinabrunette2301 In the second trial the judge ruled that evidence of their sexual abuse couldn’t be introduced. This made it hard to mount a case of “imperfect self defense”. Surely there is some way for their case to be reviewed based on that? I am not a legal expert.

Amazing how he didn’t even answer her question. They did not prove in any way that the brothers were motivated by money. The exact opposite. He aslos didn't speak to the prohibition of the self-defense in the second trial. All he said was some family members don't want them out and California shouldn't get rid of LWoPP. So, just because a family member feels a certain way, and your politics are at play, you advocate for the withholding of justice???? I sincerely hope that this type of thinking backfires on him. Many, MANY people will turn a blind eye.

Well Hostin implied that the verdict may have been different if the jury had known about the sexual abuse. I think the jury did know about it. I was very young when this case was in the news, but I remember them saying that they put cinnamon in their father's coffee because it made his semen not taste so bad.

@blanegraham552 the first trial, where the brothers were tried separately, the judge admitted the Self-defense defense. Those resulted in a miss-trial. The second trial is where the judge refused the self-defense defense and left the defendants sitting ducks. It was a horrible application of justice and it was a very tone-deaf decision. People are just bloodthirsty and they don't care who they have to crucify to get it.

@jodijodi-fq2eh the law of an imperfect self-defense is hinged on a subjection of constant abuse over the course of time. "Perfect" self-defense only requires two things: 1) reasonable believe immenent peril, 2) reasonable believe deadly force was necessary. Both of those conditions were met according to their testimony, and no proof is required. But even with imperfect self-defense, the penalty is not life. It is a max. of 3-11 years with the conviction of manslaughter, which they received. You all have to remember that these judges are only human and they OFTEN may huge mistakes in judgement. It's not because they went to law school and have had all this practice that their judgement is better than the common man. Moreover, the laws are also created and divided by judges with whom other judges do not simply agree. Such was the case of the superior court of California against the court of appeals rulings. From beginning to end, this case has been poorly treated and handled as an unjust head-upon-a-pike warning. I am disgusted with how this case has been handled in the USA. Their only saving grace here is that they are not people of color.

I think his position is based on the elaborate spending by the brothers after the murders. I don’t know the specifics. Nonetheless, I have great empathy based on their SA. I believe Kitty was targeted because they felt she didn’t protect them. 💔💔

The bottom line is this case was political in the 1990's and is still political today. Their second trial in which they were convicted 12-0 and sentenced to life in prison without possibility of parole was a complete joke. The Judge limited the sexual abuse testimony thus taking away any defense. Mr. Murphy makes a good point by saying the release of the brothers would open the door for the vilest of lifers to be released. Justice isn't the broad stroke of a brush. Justice should look at each case individually. To those who ask, why didn't they just leave? That it was premeditated. How can an 18-year-old male be raped? I cannot answer these questions. Because I had the best parents in the world. They loved, nurtured and cared for me. However, a first grader who is sexually, emotionally and physically abused up until adulthood may think differently than I. I believe they were horrifically abused in every way. They had no childhood and no adulthood. Almost 35 years in prison is enough. Justice for Erik and Lyle Menendez.

This guy is such a tool. The new resentencing law in California became a thing for a reason. Not *all* LWOP cases deserve to stay that way. The resentencing law focuses on age at the time of the crime (they were under 25), trauma an Individual experienced, rehabilitation and behavior/ disciplinary records behind bars. After 35 years, Erik and Lyle qualify for a new sentence because they meet all the criteria.. this specific case doesn’t mean all rapists, murderers and child molesters can be set free. You’re naive if you think that

They were never convicted with murder for financial gain because the prosecution couldnt prove it. They were given the incorrect sentence anyway, they should have never been given LWOP. It was just because the judge forced the hand of the jury and didnt allow the evidence of SA or more other options than First degree or not guilty.

They were sexually abused point blank, threatened by their controlling dad on several occasions that he'll kill them, that in itself is warning call. It was never for money, they were spending that on a daily basis. Kitty Menendez brother don't know sh*t about his sister, did he know that she overdosed on medication and was admitted to Hospital. He knows nothing about brothers and what they were going through, matterafact he never spend time with them at the house either on any given time. The trials was politically motivated, unfair and their was miscarriage of justice. The prosecutors spread the narrative that they did for money, and that it was greed and that's why they killed their parents; nonsense!!!!!!

There should 100% still be life without parole. You just need it to fit the crime. Resentencing this case doesn't automatically eliminate life without parole for everyone. If they boys had been convicted without the prosecutor blocking any evidence of the abuse I'd be fine with it. But the jury that convicted them didn't get to hear about that because of the prosecution.

Just one family member dont want them out. All 24 family members together have more rights than just one.The uncle was an abusive husband. His wife divorced him for that AND His son (who supported te brothers) dont even want to see him. The sisters of Kitty AND José are supporting the brothers. Even Jose's MOTHER defended her grandsons Until The end of her life. Most people support their release now , especially young people = current AND future voters. In the second trial the judge hampered the defense by refusing to allow testimony of the abuse. Therefore the brothers couldn’t mount a defense of “imperfect self-defense”-That they falsely believed their parents were going to kill them.This prosecutor is assuming that money was a motivating factor behind the killings. The Menendez brothers have always argued they killed their parents because they believed their lives were in imminent danger. He needs to remember that the brothers are victims of sexual abuse and NOT perpetrators of it.

Exactly. Jose and Kitty Menendez are not here to give their side of the story. What we do know is the Erik wrote a script about a son who kills his parents FOR MONEY about a year before the murders; Lyle got kicked out of Princeton for cheating, and both brothers were arrested for grand theft of $100,000 worth of property from their neighbors. The father was fed up and he threatened to cut them off financially and out of the will. The murders happened shortly afterwards.

Uh no...DA-elect Nathan Hochman said he will review the case and the facts including the confidential prison files THEN make a decision. He never said he wasn't going to re-sentence them. He has to review the case first. He's not even the DA yet.

What confuses me is how Erik Menendez could go to Dr. Oziel, confess to killing his parents, and yet never mention the alleged sexual abuse at that time. Hypothetically, if the father had some connection to the therapist even after his death, wouldn’t that have been the perfect opportunity for Eric to disclose the abuse as part of his confession? Instead, he only focused on admitting to the murders.🤔

What I think has been generally omitted yet extremely relevant to the Menendez case is the appreciation of Jose 's character style and what that subjectivity signifies. I think it's fair to conjecture that it's possible that, if given a structured interview determining personality organization and style, Jose could have likely been categorized as a malignant (psychopathic) narcissist. It's the dictator, cult leader...paranoid, aggressive, sadistic..."the quintessence of evil" (Fromm, 1964). This style very closely rides the edge of psychosis (meaning no distinction between self-other, not an understanding of interoceptive vs. exteroceptive origin of stimuli, delusional thinking/thinking that doesn't conform to conventional notions of reality). This style lacks any and all awareness, doesn't experience positive emotion, feels literally dead inside, and is amnesiac (lacks autobiographical/episodic memories of their life experiences). The only thing that keeps this character structure out of a total collapse of selfhood and a psychotic break is the delusional fantasy defense that they are the almighty, furious God of the universe. And, God simply doesn't get outed or convicted for ped**ilia against his own children (as Lyle had foolishly threatened); that's severely ego-alien. That threat sealed their fate and those two literally were de*d men walking. Since Erik had already had issues with a gang, the cover-up would have been beyond easy. And those two kids knew this because they grew up with this guy brainwashing, controlling, torturing, and threatening them for their entire lives. And, if one honestly believes that one is going to be k*lled imminently (which, for better or for worse, they seem to have), then it's an act of manslaught*r. The prosecution couldn't prove malice aforethought and the "they did it for money," "rich sociopathic brats" cheap media narrative was debunked with Jose's sister's testimony about his declaration to her of their disinheritance, several months prior. To watch their testimonies and see their physiological responses to recalling their abuse can only be determined as "acting" if you, the witness, are unconscious and apathetic (which is germane to the boomer generation writ large). They were convicted of first degree because the state simply couldn't lose after the OJ ruling, and the second trial was thus rigged accordingly. And all these years later, they're still getting trapped in political games with Newsom and Hochman's respective, selfish agendas. Some things never change.

I would like to see the Brothers released, I think they should be resentenced. I think cases should be looked at individually. After the Miller v. Alabama case, children could no longer be sentenced to LWOP. Children, although the brothers weren’t kids, can seek resentencing. Not all of them get it reversed, many don’t, depending on the severity of the crime.

Prosecution cherry picks. Never had a proof to start with, but defence case had. In doubt for innocence! And in this case its countless evidence including countless experts against people saying "i dont believe them", which is morally and legally not acceptable!!! I can’t even watch the entire interview-giving this idiot airtime on TV is infuriating. He wasn’t the one who endured this horrific situation. This man, who has the audacity to dismiss the experiences of someone who has been terrorized and threatened with death daily for over 15 years, during a stolen childhood and adolescence-and by their own powerful father, no less-thinks it’s “nothing.” Everyone reacts differently, and in cases of abuse at home, the chances of devastating outcomes are extremely high. Try going through even half of that and see if you wouldn’t consider suicide, break down mentally, or carry lifelong trauma. In my view, anyone who shares this kind of dismissive rhetoric is either a pedophile or at the very least, an enabler.

What he claims is FALSE. The new prosecutor stated that he would review all available documents related to the case. He did NOT say he believes they should remain incarcerated. Additionally, claiming that eliminating life imprisonment without parole "benefits" only murderers and child molesters completely ignores the purpose of prison: rehabilitation. Prison is not solely about punishment but also about rehabilitating inmates. Also, using the verb "winning" completely throws his argument out of the window. Please, we're not discussing Monopoly. What a convoluted answer regarding resentencing the Menendez brothers. I don't think it should have anything to do with anyone else asking for resentencing, or whether or not a family member wants them released. If these men are not being released to a family member then the family member's opinions should have zero influence. Imagine that, their resentencing vs. sitting in jail for the rest of their lives depends on the fear that other convicts will overwhelm the system with requests for their own resentencing. Ridiculous. Clearly the system doesn't work.

there are other prosecutors, judges lawyers, psychology experts who approve the release of the Menendez brothers for a reason Juge Daniel Leddy he mentioned: "I have long dissented from the majority view of Erik and Lyle Menendez. Watching the trial, evaluating the demeanor of the brothers on the witness stand, and reviewing court documents has convinced me that they were the victims of horrendous, protracted sexual abuse and that they killed their parents in the sincere belief that they, themselves, were about to be killed. Not that I was alone in supporting the brothers. In fact, their first trial ended in hung juries with a majority of the jurors voting to acquit them on murder charges. Moreover, there is no doubt in my mind that, but for the erratic behavior and highly questionable rulings of Judge Stanley Weisberg at the second trial, the brothers could well be free today."

Having a family member murdered changes your dna and you are never the same. It is a tough call on letting these guys out. I am a believer in second chances but the person who killed my family should never be let out. My neighbors were also murdered and left unsolved and all you have to do is type the town this happened and every crime junkie thinks they figured it out and it is ridiculous then come at my family and a couple other families and bully the people who might actually have some actual knowledge of the crime.

So I totally understand what they're saying about not wanting to change the law on not having LWOP Because they don't want rapists, child molesters and life sentences cases to blend to the possibility of those people getting out and having further victims, but I don't understand how you could keep these two brothers in jail just to keep that law in place. So they have to give up their lives because of everyone else? And then to tack on to it with you can't on a live someone if there is some kind of financial benefit to you in some way, well what if you're being abused and in fear for your life? Are you just supposed to deal with it because you're a trust fund baby, which is the parents decision and not by choice of the sons. So they were just supposed to deal with it because there was a financial benefit?? Seems like that law needs to be reworded and changed a bit. I just think that's kind of insane. And also with the whole spending of the money after the parents death, we have to remember that yes legally by law they were "adults"... But we all know that any of us who were 18 and 21 doesn't make you an adult by any means, it's just a number, I look back when I was 18 and 21 and no I wouldn't have committed murder but if I was being assaulted in that way by my own parents who were threatening my life and I couldn't handle it anymore and feared for my life, what I have made the same decision? Quite possibly, I think anybody who's been abused like that against their consent knows what a horrible violating thing it is, and to think that somebody is going to rub in your face that they're going to continue to do that to you and you have no choice of the matter but to deal with it I could see sending someone over the edge after years and years and years of it happening to them already and when they finally think they're going to get away from it they're told that's not going to happen. I can only imagine the fear and despair that the Young 18-year-old Eric must have felt. And then after he told his brother what was happening and his dad threatened their lives, I think they just snapped and couldn't take it anymore and were thinking like 18 and 21 year olds young adults they made some really rash decisions that I know that they would take back on a heartbeat and handle a different way, but at that time in the world these things weren't talked about, and I can only imagine how embarrassed they must have been to ever admit it to anybody, I think they probably hoped that nobody would ever find out what happened to them. I think that was their biggest secret when it really came down to it, I think they were okay with admitting to the murder but I don't think that they wanted it to get out about what their father was doing to them behind closed doors. I just think it's an incredibly sad case, but I think that they have rehabilitated themselves and done some great things with their time, and they also learned from their time and I think they deserve a chance at some freedom finally, freedom from what their father was doing to them and now freedom from being locked up for what they thought at the time was defending themselves. I'm praying for them That's for sure 🙏🏻🙏🏻🙏🏻
