Yes that driver. Anyone not intoxicated could have missed that child or stopped or at least veered off course or even got on the breaks hard and minimized the impact.that said it is my opinion that the driver was either deliberate or intoxicated and the way it looked when leaving it didn’t appear like an intoxicated driver.

I guarantee you, that driver didn't see the child because of the blind spot on the left side of the windshield. Your view is obstructed by the left stanchion of the windshield. I have almost hit cars head on in a turn, because I never saw them
