If I recall, this pond was built on a stream which brings up issues of water rights. Water rights are issued by the state, not the feds. For anyone thinking of creating a pond or lake, building it instream is a pretty bone head move since there are legal issues along with the incessant natural process of siltation that eventually fills ponds. It is much smarter to use a pipe to divert smaller volumes from a stream when water is needed (still requires a difficult to obtain instream water right) or consider a well for the water supply. Most of the waters we build across North America are now supplied by wells.

His land and he's paying his taxes on the land,and trying to control what he can do on it Boi I tell ya damn what can you do on your own land that you pay for with your blood sweat and tears, I mean damn, I'm glad he won his rights, but look at all time wasted when he could have been doing something with the family or working his property,damn the EPA! Congratulations to the property owner.

He told the EPA that the pond was an illegal immigrant and they backed off.

I wonder how much he spent on legal fees? For every person who fights for their rights, there are a hundred who don't. Those fines are so high that you only fight out of principle. No one would risk loosing everything you own and worked for your whole life and a lifetime of debt.
