Sale & Purchase agreements contain descriptions of fixtures in a manner that is far too vague to be binding and always lean in favor of the developer. A simple example that we can take is, PARQUET/WOOD FLOORING. The developer will even show you the parquet and wood samples but the contract will say depending on availability and that the developer reserves the right to change the item and the decision of the developer is final. The floor ends up being not of wood but some synthetic tiles that imitate wood. This is only an example. The buyer is placed in a well decorated show house at the time of the signing of the sale and purchase agreement. He/she is all excited by the nice developer agent and the willing banker waiting with his forms. The promises are all that the buyer SEES in the show house but not the EXCEPTIONS that are hidden in the agreement.

why should developers pay when construction subcontractors were responsible for creating such defects?
