In fairness to them, if an aerospace fighter (capable of exiting the atmosphere under it's own power to intercept objects in space in close quarter) is developed, it'll probably be complex enough that the kind of people they tap for it are the F22 and F35 pilots.

as a german, I will try to explain. First, the laws on this were sharpened only a few years ago, and what they are doing now is just rolling part of that change back. The reason for this is mostly what you have mentioned, HLC, but there recently was a big example of this: A teacher learned that explicit material of a minor was shared, and then informed the parents, with proof, so that they can take this to the police and have it dealt with. However, as the law stands, the teacher is now guilty of distributing said material and faces jailtime. Now, obviously they acted with best intentions, and everyone, including the judge, is aware of that. However, unlike american law (from what I understand), here in germany you can't easily make an exception of the rule in such cases. Because the laws were increased those few years ago, the judge was not able to not pass a sentence on this teacher, despite not wanting to, because, the law standing as written, the teacher committed the crime of distributing said material, and that is a proven fact. Now, the idea of this chage (which, as i said, is mostly rolling back the changes made a few years ago), is to lessen the MINIMAL sentences, so that judges have more lee-way in such cases. It does not change anything about the maximum sentences, so anyone caught possessing or distributing said material for nefarious purposes can still be slapped with the same high sentence as currently. That is what this is about, as far as I understand it. I am not a lawyer or anything, so I can't really answer questions to the details though.

Makes a huge amount of sense. Still though, I feel like in grey areas like these, judges should have the authority to just use common sense and "house rules" like in DnD. If something is obviously nonsensical in the situation, just house rule it so it does make sense.

Thank you for the explanation. I hate legal stuff for this reason, it's usually opposite of common sense, but sadly it has to be this way thanks to losers constantly looking for loopholes and/or over-zealous police looking to bump their arrest numbers(a problem we face here). I've had computer techs tell me if you ever buy like a used laptop, and find similar material on the hard drive, DON'T report it. Just physically destroy the hard drive, because taking it to the police you are technically "in possession" of said material, and it's up to whoever you turn it in to whether or not they charge you. Also, this is one of the biggest reasons Americans don't support gun control laws, because instead of them being used against actual criminals, they tend to be used against law-abiding citizens more often. Just look at how many videos get posted of Glocks with switches on them, they're not getting visits from the ATF, or getting 10-year/$200k fines. You know who does? FFL's and law-abiding citizens over technicalities.

HLC-we actually had that EXACT problem here in the states. A neighbor of mine a few years back was sexting his GF(both 16 at the time) and one of the moms found it, long story short 2 teens get prosecuted by an overzealous DA over typical teen stuff and a soccer mom nearly gets 5 years in jail for notifying the other mom of all this.They all got off charges only because the prosecuting got his chin rearranged in the parking lot by one of the said dads(former Mob oddly enough). Laws protecting kids are good and all, but here in the states they are usually worded poorly or have vast overreach that doesn't just break the 4th, but takes a nuclear shit all over it as well. For example I work on PCs and despite there being laws to protect me if I have to report someone there are JUST as many that could easily have me shutdown, jailed or worse JUST for doing the right thing.

Personal story but in high school I dated a girl a grade below me. I was a junior she was a sophomore. We dated for a year and a half and on my 18th birthday her father called the cops on me for statutory when we were at a Dairy Queen. It was the dumbest mess out tiny town had seen. Really helped solidify why her parents got divorced and she only spent two weekends with him a month. Anyway it became a hugely stupid mess just because I was now an adult but it was fine for the previous 16 months. Sometimes the law is just not built with nuance.

I guess I am more confused why they are trying to make court cases over parties that are under 18. I understand the idea, it's bad material no matter who shares/possess it and the kids should be taught that. But this is the same deal as someone who just turns 18 dating the same 17yr old they were dating while they were 17 and the parent using that against them like @nicomorales1644's case. It just seems like a jerk move to try and get those kids labeled as offenders when they are doing it with people their own age (as long as they are consenting and their is no "forced" coercion.) But I digress, yes, if it is a problem someone should be made aware. It being the police seems like a bit of a stretch.

The point in Germany is that it clogged up our justice system. It's not decriminalizing it, it's setting the possible punishment low enough that the prosecutor can decide not to prosecute someone (as possession is already illegal, you'd also get in trouble for doing things like making a photo of it with your own device as evidence). For the purposes of the law, getting sent that stuff and your phone automatically downloading it is also enough btw. And considering the shit that children sometimes send each other, that is very iffy. Basically yeah, people that wanted to do the right thing ended up charged over it and there was nothing that the prosecutor could do about it. Now the prosecutor can actually differentiate between thode two things. Greetings from someone currently studying to be a teacher who had a seminar about that to protect ourselves from that.

It makes sense, I think the big confusing aspect with most people is them not exactly understanding the difference between how Germany's Civil Law system acts compared to a Common Law system, like is used here in the U.S. In the U.S. Judges just have this sort of flexibility innately. But that's also because part of a judge's responsibility is to interpret laws in a common law system.

Under some state laws, if one of my students has taken an inappropriate selfie, I could be charged with possession even though I didn’t know what was on the phone, and didn’t have the power to unlock it. Regarding the change in law in Germany: Your understanding is generally correct. They want to lower the MINIMUM jail time in case of conviction from 12 month down to 3 month without touching the MAXIMUM jailtime. This is done so the process can be settled easier now because it is under the threshold of being a criminal offense and now is a minor offense. It is basically the same with drugs, you find them or get in possesion of them in a way that wasnt intended by you and bring them to a police station, you will automatically get investigated on illegal posession of drugs. It happened to me too after I joined an online secret santa and the dimwitt that send me a package put some speed in it. Point is: A criminal offense ALWAYS has to go to court. A minor offense can be closed before court. They want to speed up the justice system by enabling them to easier close those cases and use the freed up ressources for the real cases. It is not to lower the sentences in general.

Ideally, you don't. Air combat today is more like a long range jousting match... and in that respect, the F-22 has all the advantages. Able to poke almost any other aircraft without getting poked in turn. Only the F-35 is a close contender at this point in time

Regarding the "Child sensitive content" you understood quite well. The law at the moment criminalizes parents or teachers, who show the respective parents of the shown child the material to warn them. Not just an offense, but a criminal act with at least one year of improsenment (can be judged ob probation). The problem is, that the record for a criminal act regarding minors NEVER gets deleted, like other records like theft for example. Also the 1 year imprisonment is the limit to remove a person from state jobs, like teacher, police etc. So a few person got criminalized, because their first reaction was to inform the respective parent of the shown child in the "Child sensitive content" to make them aware of the situation their child is in. Now the law shall be changed to not criminialize those people, but still to punish those who share it for other (sick!) reasons.

It is not unusual no matter how well-intended a law is, there are always unintended consequences that pop up…. Such as that poor teacher and the parents. Thankfully the German government is working to unwind the situation. I do appreciate the explanation from the German citizens' posting. On the buoys. It wasn't towards Finland but rather towards Estonia. Basically Russia went out and removed the border demarcation buoys in the Narva river in blatant disrespect to international law a day or so after a memo was leaked by Russian media about the Russian state wanting to unilaterally change their borders with their baltic neighbours (memo only mentioned the Kaliningrad exclave to my limited knowledge). This move was either brilliant maskirovka trying to jerk around the west for caring about buoys, or an attempt by Russia to provoke the west by stealing land.

Intentions are indeed good based on what I've read...Buuuuuuuut I can unfortunately see a TON of potential exploitation of this now loophole to give adults the means send explicit materials of children. Should adults be punished for reporting their child having sexual minor material as they should? Many would say no, but it's not exactly a stretch to see how the true PDFiles would use that law to give themselves a barrier against potential prosecution.

Not hard to amend the current law, which is actually what they did. The issue I do have is their softening of the penalties for possession (Used to be 1 year imprisonment and a felony charge, now it's three months and a misdemeanor.) Again, I get why they did what they did. But the truth is they should have made parent-teacher/pastor/whatever clauses instead of reducing the sentencing.

Germany is not removing that law... they are modifying it because according to the articles, the majority of people charged are minors sending their own images. At this time, the minimum sentence is one year in prison which automatically makes it a felony no matter the circumstances. The modified law would have a minimum sentence of six months, removing the mandatory felony entry in the criminal records and allowing the courts more flexibility to account for the circumstances.

Maximum possible sentence remains the same btw, and the change to felony a couple years back was criticized for exactly this reason by professionals (Judges and Prosecutors)

When you're talking about legal stuff, usually VERY EFFING HARD. Everything hinges on wording, because you always have people looking for loopholes, and over-zealous police looking to enforce laws even when it isn't in the spirit of why they exist to bump their arrest numbers. Example of the latter, arresting a parent for reporting explicit material they found on their child's phone.

The short answer is it could be seen as disrespectful. The US was one of the largest contributing factors into NATO being formed in 1949. The US also supplies the most funding to NATO , last known estimates was the US gives about 22% of NATOs overall funding. There may also be an issue over the timing as implications for public attention and engagement, as many people might be focused on holiday activities rather than legislative matters.

Germany is not decriminalizing it. The current law has a mandatory sentence of 1-10 years which automatically makes it a felony due to the minimum sentence. That minimum is reduced to six months to give the courts more flexibility to account for circumstances and close cases at the lowest punishment without felony entry in cases of minors, or involuntary recipients, being charged.
