I once had an employer like this. Helped me out financially to get my license and legal fees taken care of when most would've fired me. We agreed on an amount withheld from my paycheck each week. It was paid off and I didn't even notice. When so many employers don't value their employees, it's a shame to disrespect one that does. This young man doesn't even realize what he had.

The kid blew a once in a lifetime chance to grow with a company and to have an owner who truly cared about him and his success. The kid will learn someday what a chance he blew... As a mom of a young adult and a teen, you pray that mentors show up in their lives who believe in them and see a bright future/possibilities, rather than the problems/issues plaguing the kid. All this young man had to do was give the plaintiff a chance to fix the insurance problem and stick it out in the job even if he was frustrated. He failed to see the good opportunity he was sitting in in several aspects: having an income and a solid job, financial backing, an employer who believed in him. Sheesh, this is a dream for many people.

The plaintiff obviously really cares about the defendant. I hope they can work out any problems between them and that he can be a father figure for him again in the future. I think the plaintiff would be a good influence. But there shouldn’t be any more loans between them. If the older man wants to help financially then he should only give money as a gift, or pay him for work that he performs, or let him work overtime. Unfortunately the loan (and no contract/receipts/other written records) got in the way of what sounded like a good family-type relationship. I wish them both the best. Also, I respect that the defendant didn’t just lie and say “Yes, I learned such & such from being being here at The People’s Court.” I think they all claim they’ve learned something from the experience, but then the next sentence that comes out of their mouth shows just how little they’ve actually learned.

Legally speaking, this could have gone either way... If the defendant could provide proof, that he made a concerted effort to fulfill his contractual obligation to pay back the loan and his attempts were met with a denial, on part of the plaintiff stating to "forget about it", on several separate occasions. Technically, he would have the right to argue an affirmative defense for reasonable or detrimental reliance. Detrimental reliance, or estoppel, is when one party indicates that performance is no longer required, and the other party relies on that, it can be a defense to the enforceability of the contract. Implied consent could also be argued, in which consent which is not expressly granted by a person, but rather implicitly granted by a person's actions and the facts and circumstances of a particular situation (or in some cases, by a person's silence or inaction). The defendant could have interpreted the plaintiff's denial to accept payment, and his inaction of attempting to reclaim the debt owed, and relied on the implied premise that the loan was forgiven. To be clear, in these particular facts of circumstance, I agree with the Judge's ruling but I have seen her go either way on cases in the past with similar facts and circumstances.

I've learned never to help an individual, friend, church member, family, with loans. Either its a gift, or I tell them they'll have to work things out with the bank or credit union. Even as an employer, any "advances" have to be cleared by the next payroll, and it is understood in the email or documentation of why it is going to be cleared. (In fact, my rule of thumb is, no advance unless your house is on fire, and you have nothing. But it will be cleared by the next payroll.) Harsh, but I'd far rather deal with it today, than 2 years from now. I've also observed that most of the time, if a mistake is in the employee's favor, I almost never hear from the employee, but heaven help if I deduct 1 cent over; the paystub is barely dry, and I already have a phone call.
