Hello mam! I have few doubts while applying for gratuity. I worked in an engineering Institute since July 2002 till 5th aug 2020. In between I had on leave of 8 months in 2004 for maternity and then from 2008 to 2011 for PhD. But Institute has presented my continuous services in affiliated univ., national council of technical education and national board of accreditation. So are these breaks caused break in 5 years?

@@AapkaPaisa madam I am eligible.... Suprim court ka ek case hai....Supreme Court rendered under the provisions of the Industrial Dispute Act in Surendra Kumar Verma vs. Central Govt. Industrial Tribunal,[(1980) (4) S.C.C.433)], it is enough that an employee has a service of 240 days in the preceding 12 months and it is not necessary that he should have completed one whole year’s service. As the definition of continuous service in Industrial Dispute Act and Payment of Gratuity Act are synonymous, the same principal can be adopted under the act also and hence an employee rendering service of 4 year 10months 11days is considered to have completed 5 years continuous service under sec.4(2) and thereby is eligible for gratuity."

@@sk-ov2rb Hi Sangita, hope you are doing good. Since you have quoted a judgment basis which you have mentioned the number of total years, month and minimum days needed to get gratuity. May I kindly ask you, based on your question that you had completed 4 yrs and 8 month, were you able to claim gratuity from your organization/establishment and did they approve of the formula that you presented basis the court judgment? And, if a company mentions in its policy, that every employee has to complete at least 5 years of continuous employment, then, can the employee quote the same Judgment and sections you have presented to the company and will they be open to discuss it and if not, then, does this judgement gives a private organization employee to appear before any court? Your help and inputs regarding the same will be really appreciated, as I understand you have done great research before putting the information, and your guidance and experience with real examples in your case, or any recent case, or articles will be really helpful. My cousin brother was employed as retainer ship basis (on PF only 10 % tds deduction every month )in a Pvt company for nearly 8 years WITHOUT any gratuity benefit after leaving the company .the said employee discharged only regular duties like follow up of payment office work from 9 am to 5 pm daily with 30 minutes break for lunch as mentioned in the terms clearly plus tour expenses all reimbursed with train ticket s . Employment was continueos without break for 8 years and the remuneration ie retainer fee was below Rs 20000/ per month credited to bank account every month after receipt of attendence sheet through the computer company website . For initial few years say 6 years non stop my freind was paid bonus ie one month fee every year . Then they stopped such payments without giving any reasons and after 8 years continueos service he no renewel of contract of retainer fee and stopped payment without any gratuity benefit s please clarify . Please note that it was not professional or legal duties performed it was only office duties performed like others without any benefits no PF NO medical nothing . Hence my

Hi Narayan A company can't employ a person on retainership for the regular job. The nature of job should be consulting or irregular. Thus, in this case, your comapny has violated the rules. However, on paper It had ticked all the requirements of retainership. So now, if you want to be considered as a regular employee, you have to file a case with the labour commissioner. That is the only way. I am not expert in labour matters. It is better to consult with an advocate.
