AIIMS NEW DELHI doesn’t follow gratuity act , AIIMS give s gratuity only after completion of 22 years but not 5 years !

Employers have made Gratuity a part of CTC, which they deduct every month, so basically taking money from us to not give us back if we leave before 5 years. Otherwise mera paisa mujhko wapis. Daylight robbery.

We were getting DA. But since last year due to Covid 19 we have not got any DA or increment . We were paid half salary since April 2020. We fought then we got balance salary from April till Aug 2020 in instalments. But since Sep 2020 we hv been getting 75% only! It is a 75 yrs old public school with heavy fees. They are getting fees but making lame excuses that parents are not paying fees. We , teachers are convincing parents to pay and they are paying too. Now the problem is that management has threatened us to fix our salary at 75% only forever.Uttarakhand State education system has been taking bribes from pvt English medium schools and has thrown our letters into the dust bin! I hv 2 yrs and 2 months more to go before retirement. Please guide. We hv not got any payslips since April 2020. They were giving us slips showing 50% salary as 100%. We refused to take and requested to amend but in vain.

If the worker is working in a company for 4 year , he should also come under gratuity act and eligible to avail .. For example if he works 4 yr 7 month then it will be counted as 5 yr . .so he definitely come under this act

Gratuity Act, 1972 was amended in 2009, and a TEACHER was made eligible for Gratuity and retrospectively implemented from 1997. PROBLEM : A TEACHER was appointed in 1962 and got retired in 2003. year 1997 makes him eligible for gratuity. How do count the No. of years of SERVICE? from 1962 0r 1997?

@@ravinaahuja922 I think, you are taking this as partnership, but if I'm not wrong then whenever someone is hiring a person to do a task, the employer - employee relationship is being set up there, Even though the person to be hired is on regular basis (ie. Until retirement or resignation) or on contract basis (ie. For a limited period of time). The difference, I think, is merely terms and conditions mentioned in the contract.

I worked in a company, I joined on 1:10:2015 ..they keep me in training for 2 years and from 1.09.2017 they given me permanent employment letter on roll and on 15/12/2021 I resigned.. My total experience is of 6 years.. But HR saying your training period will not be counted for gratuity you're not eligible for gratuity... Is training period not considered for gratuity eligibility?

Dear sir my uncle worked in an organisation for 17 year now they calculated graduity on only basic salary which is 35 percentage of gross salary in pay slip they mentioned basic salary is 35% of gross ,hra is 95% of basic salary and other special allowance..and graduity amount is very very less there is no mention of DA..can i file complaint against company ..

Suppose an employee has resigned and the monthly salary ( basic + DA ) is 10000 before resignation, employee served notice period of 40 working days, and last month is of the month of notice period and employee has worked only 15 days so now basic + DA is half of the total monthly basic + DA, now my question is which month can be considered as the last month for the gratuity calculations ? Before resignation or after resignation ?

I worked 18 years in the central govt. Due to some illness didn't attend office for 6 months on medical leave. But they did not sanction my 2nd 3months leave and sent it for a medical board. I missed the intimation since I was far away from my residence undergoing treatment. After 2 years I fully recovered and I contacted one known person in the ministry in delhi where my personal papers are handled. That guy demanted me 25000 (in year 2000) for clearing the service issues and agreed to transfer to somewhere else in another region. I felt something fishy and looked for another job. In 2017 i received a letter from the ministry thru the local office where I was working last time stating that " my absence from service is taken as deemed resignation" and not eligible for any pensionary benefits. I sent many letters requesting to return my service book and pf money (around one lakh balance in 1998) but they did not send me any reply or the pf money. What can I do? On what basis they are telling I am not eligible for any pensionary benefits? Does unauthorised absence without giving resignation qualify to deny pensionary benefits and pf amount? It is a very powerful department and can easily harass me so scared to fight with them. Looking for your advice on this matter.

Please check ceiling limit of gratuity is not for giving minimum amt. Its for getting benefit from income tax.. if your amt comes 24Lacs, 20 lacs exemption from income tax and 4lacs taxable amt. Please check again.

I need some advise. My father is retired army personnel who worked as OT Supervisor on contract basis for 10 years. Also if you could provide some literature where it is mentioned that GRATUITY is applicable on CONTRACT EMPLOYEE. He work for organisation for 10 years continuously. Contract is renewed every year. Also Employee is directly hired by company/trust and not through contractor. Organisation is Hospital run by Charitable Trust. But Hospital do charge patient for treatment. Jaise Pension payment ke cases mein old pay is updated as per the 6th n 7th Pay commission implementation n then pension is increase for govt. Retd. Employees! Same way kya gratuity Ka benefit nahin milna Chahiye? It's very necessary,, as seniour old retirees received lowest retirement funds with maximum gratuity Amount of Rs.1.00 Lakh (between 1996 to 2000) n Rs.3.40 Lakh (between 2000 to 2007 in BHEL)! Jabaki for higher pay grades with 30 years n above service,, calculated Amount of gratuity comes more than Rs. 5.00 Lakh - Rs.6.00 Lakh!

As per amendment dated September 2020 Some peoples are eligible to receive gratuity even if they are not compliting 5 years of service. Please confirm this pass in the parliament or not??
