A law enforcement officer 👮♀️ falls under different laws. It’s a cop’s job to be there, and be armed, and take police action if necessary. That’s not your responsibility . This is why many states require you to retreat if you can safely do so. Even in a stand your ground state, they want you to defuse that situation by walking away. A punch isn’t necessarily enough for a deadly response. The suspect said his boy would shoot you, he shot the guy without the gun.

Maybe just have drove a few blocks down to get some distance and called 911 1st, explain what happened where im at then the USCCA hotline. We ALL have to be understanding on the situation, because remember. It's EASY to say, what we would do. Until, something like this happens to one of us. It's EASY, to say. ' I'd do it this way '. Yes, do I agree he should have stayed in the area, made his phone calls to 911 and USCCA and stayed in the area. Yes. Do I agree that on him making a decision to distance between him and the other guy, because a posabilty on that guy and others he posabilty could have known in the building he ran back into to come out and start firing on him. Yes, I agree on his decision to leave the area. This story right here, tho is why, ALL gun owners NEED to get a USCCA member.

Either that or they get severely less charges than a regular civilian. I'm not saying this is always the case in situations against cops but it's usually how it goes about 90% of the time.

The smartest thing he did was call USCCA to get immediate access to an attorney. By talking to him first and not talking to the cops his attorney could fashion his defense from square 1. His membership saved him from a life sentence.

Prosecutors should be required to prosecute cases anonymously and be prohibited from later associating their name with any outcome. Require an oath of secrecy in order to eliminate any career incentive to gain status through press, media or accolades. The only prosecutors on public record should be John/Jane Doe. It’s a selfless job (like being a monk or nun for the government) where someone should only be in ego-free service of the people.

A good friend of mine was defending himself and shot someone. While he was incarcerated during the investigation he lost his father to cancer and his grandmother that raised him from a heart attack. His woman left him and started seeing another man. How is being incarcerated innocent until proven guilty? It made me want to cry when he told me he would've been better off just letting the guy murder him. He now pays child support and barely gets moments to see his children. The system is great at getting to the bottom of everything but its truly sad that life doesn't stop while they do their investigation. As a man you take our home, our family,, our children... what is that? Thats worse then being incarcerated!! Now you can say any real woman would've done this or done that. But all that time spent incarcerated and her being lonely and doing everything on her own for the children. What's expected? He could of seen his father and got those last moments with him. But the system has bars for the innocent and the guilty. Stop saying innocent until proven guilty when you're treated like you're guilty all the way up to 12 jurys to decide after the trial and full blown arguments and friends and enemies testifying what kind of person he is. But a police officer goes home and sees his children and family. Gets to sleep in his bed and drive his kids to school and binge watch his favorite episodes with his woman. IT'S NOT INNOCENT UNTIL PROVEN GUILTY. If you're incarcerated thats where the guilty are. 🔥💯‼️🖕

Agree. But they think you are guilty if you do. Been in the same spot, but without firearm involvement. Got my car smashed and physically attack but was able to fend it off and lay the attacker on the ground. People knowing nothing rushing to attack me and "help" the "victim" made me realize I had to leave. Called the cops as soon as I was home (10 minutes later) still got indicted. Got off due to a witness since police did nothing to secure video evidence that was readily available.

I am a disabled veteran and was stalked by four men to be robbed one night when I was leaving a free bar poker tournament. As I was trying to leave one of the attackers punched me right in the face and was pulling back to punch me again as I was in shock and disbelief that this was happening. I reached for my gun and fired. A little 380 a ruger. I fired twice but I had four attackers. Both shots were fired at the lead attacker and by the time I redirected my focus on the remaining three attackers they had ran off and like this guy, got the hell out of there. The first attacker was shot twice. Once right through the heart, took out a lung and smacked up against a back rib and did not exit. The second shot went through the top of his hand and came out his palm and did a little burn out on his chest but landed on the ground. I to sat in jail until my case came up and the state never once got my side of the story, ever. At the end of the day the state charged ME with assaulting my attackers mainly my attacker that was killed. The state argued with a straight face to the jury that I had no right to defend myself and that I had committed a second degree (fear) assault and then argued as a result of the assault, the guy died which all but guaranteed a conviction. The state on appeal told the appellate court that had I brandished my gun that I could have avoided the whole thing. But that is exactly what a second degree fear assault is, brandishing a gun and making threats or demands at gunpoint. So without a predicate felony for second degree felony murder that the state admits never happened, I should not have been convicted of the second degree felony murder that requires a predicate felony. I joined the USCCA so that I could tell my story as I continued to fight my case and hoped I could find someone who could help me. My case has no downsides. I was not drinking, there was no provocation and no warning and as this guy points out, was punched out of nowhere. I faced four attackers. I have been to several USCCA events and talked with some of their lawyers, representatives, and have called a reference line because this would be a great case to take on because any attorney worth their salt could win this case if properly handled. At this point, I will probably just be requesting a refund of all my member fees that I have paid in so far.

Trying to clarify what you’re saying here. You were not a member of the USCCA when this incident happened, if I understand it right. You said you had joined them afterwards to try to get your story heard and see if you could get some help. But I imagine, the terms and conditions are you have to be a member at the time of an incident, to get access to all the benefits they offer…. Then at the end you employ your disappointed with them for not taking your case “on” and I’m gonna request your money back. Did they not explain to you that you needed to have been a member before this happened? Am I understanding this right? disappointed with them that they didn’t take your case on.

I get that cops have to do an investigation. I get that the legal process has to play out. However, how the hell does a prosecutor look at that video and say, “Clearly, he should be charged with murder.” Dude lost over a year of his life and didn’t get to graduate timely. He’s handling this better than I would. I’d be so bitter, it’d be preposterous.

Its then up to the magistrate to hear the charges, revise them & finalize them, THEN it’s up states attorney wether or not they wish to peruse the charges. In certain cases the swine will consult them as you mentioned but for the most part they are left to their own discretion.

I was assaulted in bank parking lot and if you’re on bank property and someone assaults you …. there should be different rules. That person is not there to bake you a cake or give you a massage. @@jamarcussimmons3044 a punch does actually give you the stand your ground defense. Think about it. If someone punches you and you don't use force after the first punch then what usually comes next? Another punch and more physical violence. If you were in that situation you would react the same. It's easy to say what someone should do in a situation like that when their sitting in their couch.

You have your lawyer you get brought into jail before holding you any longer than 72 hours you shouldve been able to speek with a judge with your lawyer present. And the following hearing should be a month later at most not years
