Grandparents don’t have any official legal rights (at least here in the states). She can ask for visitation, but she’ll be at the mercy of the mom’s discretion.

@ericamartin7238 with her son dead she can get rights in the courts. Rights aren't inherent but given through family court. Even for estranged parents. Many parents aren't fit to have rights or be with the child unsupervised. This is why judges make the decision.

@@ednaatluxton4918 Hi - I didn’t say she couldn’t get rights, I said that she doesn’t have official legal rights, i.e., any entitlement to see the child. The rights you are discussing are contingent on the mother being unfit. Assuming the mother is fit (while she is wild, we have no reason to believe she is unfit based on the information we have), grandma doesn’t automatically get rights because she applied for visitation. The mother’s wishes are the number 1 factor that judges consider when it comes to visitation to her child and determining what is in the best interest of the child. I only commented because your comment came across like grandma could just go to court and get rights to see the child, so I wrote to clarify that it’s not necessarily that easy because she doesn’t have an automatic right to visitation like her son would. P.S. I’m a lawyer :) Disclaimer: I am not providing legal advice, simply engaging in a conversation.

In my state the grandparents can have legal rights of their grandchild if their child has passed away and if the mother/father isn’t fit (or if something’s wrong.) also I see it a lot in my state the grandparents of the deceased parent gaining the parental rights from that side .🤔🤔yk each state has different laws pertaining to these type of cases 🙁

What is the point in learning who is the father. If the mother does not plan to get child support. Not that the child is just a check. should know their parents. I don't understand how a father's family helps support a child, but the father does not have a job unless, he is incarcerated or disabled or mentally ill but if receiving any government support. 2nd case - The defendant says if the child isn't the plaintiff's son's child, she doesn't want anything to do with the plaintiff at all. And, even if the test proves the child is the plaintiff's son's, she still doesn't want anything to do with the plaintiff. I'm saying, if the child is the plaintiff's grandchild, she had better find a way to let the child have time for a good relationship with his Grandma, or there will be some bad feelings coming from her son towards her later on!!! Child, you can rant & rage all you want. But in the end, you're going to only hurt your relationship with your son. Then you'll really regret what you said in this courtroom & how you acted! You're only making matters worse!!! It's time to become more mature!!! Thank you to the Judge for gently pushing for the Grandma to be able to see her grandchild, & to the editor of this video for allowing us to watch the precious moment!

I think she knew he wasn't the father and if she was in an abusive marriage, she wouldn't have said it to anyone. I wonder how the PLANTIF'S and her mother's life was all those years .
