Its a great character scene. Hagen has already had his life saved by Maximus in the arena twice in the same battle (getting him out of the chariot's path, and winning the fight). But now he knows Maximus likely commanded troops who killed his brethren. But when the food comes out, and Juba thinks it may be poisoned, Hagen decides to test it anyway, because he's already come to respect Maximus as much as he does. Then engaging in humor afterwards.

It is possible that it may run deeper than that too. Hagen is the one who said "i served with you at vindobona" Vndobona was a battle in the Germanic conquest. At that time captured German soldiers sometimes served as auxiliary troops so it is possible Hagen was captured served as an auxiliary then was cast aside by the roman military and was made a gladiator.

There is so few laughs n the film. This scene is so deep. Even the reluctance of Maximus to laugh himself is brilliantly played. In less than a minute we know men who might have faced off against each other on the battlefield are willing to die for each other. Watch the mischievous look and n the eyes as he reaches the spoon towards Maximus’ bowl. He knew his friend would fall for it.

The crowd loves Maximus because they love victories - both in the arena and from his past as a Roman General. Commodus can't just kill him with poison or another way 'out of sight' because the crowd will still love him after death. They would have never seen Maximus lose. (Commodus even says something like "I will not make a martyr of him" at another point in the movie). Maximus has to die visibly, and in a fair/respectable way by losing in combat, so that the crowd sees him lose & stops loving him as a great victor. This will 'kill' his name.
