My thing is, anybody would have just assumed it was allowed because like he said there were other graves with headstones. So I can’t necessarily say that it’s his fault for not checking because he saw other headstones there and thought it was allowed which naturally anybody would’ve thought so his issue needs to be taken with the cemetery people.

It's not the maker of the stones responsibility to make sure the cemetery you use allows headstones. They just make them and deliver. Bad situation though. I feel bad for men too.

True. However, the ground needs to be a certain temp when installing the headstone. The maker should have definitely called the cemetery to find out when they could install. In doing so, she would have found out that it wasn't allowed.

I feel like this is on both of them. My family is only buried in a few cemeteries. All of them are private but only one isn’t a church cemetery. After the death of a relative we decided to bury her in the non-church one. I asked my aunt where the family had bought the headstones for my maternal grandparents years back. I called the headstone place and they said they would like to help me but they are no longer allowed to install in that cemetery. Come to find out the cemetery had been sold since my grandparents’ deaths. So then I called the cemetery and found out that as part of perpetual care they don’t allow for headstones that don’t come from specific companies they contract with. So you have to order your headstones through the cemetery. So the sons should have called the cemetery and this lady should have also called to see if and when she would be allowed to install a headstone in that cemetery instead of just showing up on private property. How did she even know if the ground was dry to install a headstone if she didn’t call ahead and didn’t know where it was? I have had somewhat similar situations in my job as a photographer. People will ask me to photograph their event at a venue. I make a point to ask them if they asked the venue especially if it’s a casino if it’s okay for me to take photos on the premises or I call the venue MYSELF to make sure because I know the people asking me to come obviously aren’t the owners.

Yeah, the defendant fulfilled the contract. The plaintiffs did not do their homework before they ordered the headstone. They should have contacted the cemetery and found out any restrictions on grave markers before they placed the order.

They are two adults. It’s assumed that the customer has permission to have a headstone before they go to buy one. It’s like going to a travel agent to book a flight abroad then complaining that the travel agent didn’t tell you that you’d need a passport. Her contract was to provide a headstone to their specification - which she did. She needs to be paid for her labor and materials. Probably in future she should gets something in writing just to protect herself. But these two grown adults can’t blame her for them not doing their homework and checking with the cemetery first. It’s sad, but nothing to do with her.

I think they prefer the ones set in the ground so that they use riding mowers to cut the grass. With headstones, the job becomes much more complex, with push mowers and edgers used on the headstones.
