I usually like this judge, but I found her pressuring the landlord to let them stay because of kids at Christmas gross. Don't put that on her, this is all the fault of those kid's parents sitting at the table knowing full well what they were doing the whole time.

The rules governing evictions are very specific. In cases of evictions due to non-payment, the landlord can't accept rent once the case is filed. If they do, the eviction starts all over again.

I stopped paying rent at a place once. For a few months, sewage backed up into our house because they didn't deal with the septic system. I lost it and stopped paying. The difference was that it was a mobile home. I owned the house, so they were damaging my property. Not only did I not have to pay the rent, but they ended up paying me 5k for damages...

In this case rent wasn't paid and there is probable evidence that a notice was posted to vacate, The woman even stated she saw the notice and left the house. Simply put you can't stay in a place as a squatter if you didn't pay the agreed rent. In this life there are things you must do Like PAY THE RENT. Didn't have to be homeless also if the rent was paid.

Yeh, I think the lawyer did a massive disservice to his client by not piping up at the end after they admitted to still residing at the property in order to demand that the rent owed should, in fact, be extended from the 4 months previously stated to 6 months since they were clearly still living there. Why are they asking any other question than, what's your rent and have you paid it? If the answer is no then they are out. If the place was inhabitable before moving in, why accept to live there. Court should've ended as soon as the judge got the answer to those questions

I've been renting properties for years and never had an issue (knock on wood). As andlords, we just need to set rules like always doing a background check, credit score verifiction, ask for references, obtain a security deposit and draw up a written leasing contract outlining the terms.

These 2 squatters are terrible. Squatters should have no rights. That rent should be amended since he admitted he was still living there which is the only reason the previous eviction was dismissed against him. He pretended to be in and out like a teetertotter to try to prevent the eviction from happening.

Bad situation. However, I feel the judge did not force the issue, she requested for the sake of the children. I like this judge. She seems to be a straight shooter and is not scared to call BS when she hears it.

There is no written contract, so technically the rent amount can change to anything after the second month.

Unfortunately the matter being litigated that day in court is the right of eviction and landlord repossession of the property. The judge cannot address rent or make the tenants pay, unless the landlords file that specific issue for the court to address.

Squater laws need to change to end this garbage...and at the same time lessons learned...dont let your buddy rent out your property to dirt bags...always get a lease, first and lasts and a sec deposit...always make a video of u showing the place to the client and make a list of all issues ..both when u rent, move in and move out..by both parties....always CYA..always put it in writing and send both email and texts stating the ntoice sent a copy of the notice and date sent...CYA. trust and old man who has learned a few lessons

Why did he only have to pay four months of rent when he still living there? The judge said that before she realized he was still there when she thought he moved out in September. He didn’t move out in September and should have to pay October November and December. It’s bullshit. Also it’s not the landlords responsibility to provide housing for the kids through Christmas. That’s the parents responsibility.

As a landlord, this one is driving me crazy! I have everything, I mean EVERYTHING written down and dated with times and names. Leases are signed and each section is initialized to prove it was read. Both parties get original signed papers, no copies. I would never have to say: ‘I think’, ‘I believe’ or the dreaded ‘ I don’t know’. I have receipts for every payment and the tenant gets one EVERY month, for both our sakes. No receipt, no money was transferred. Utilities must be in the tenant’s name so they are solely responsible for payments and how much they use. It is a business and needs to be run as such.

Notes to Landlords: Always have written docs, amendments, notices, etc signed and dated, and if no renter or lessee signs always have copies showing the date the notice was served. A small thing, but "oh, I don't recall exactly" just is not good enough. Saves a lot of trouble later.

I love how it's always so obvious that they never intended to pay rent. They use the smallest issue as a reason, but just ask them if they still have the money, and the answer would be no.

They probably don't work but if they did they would have saved quite a bit of money. Squatters have too nice treatment by law enforcement and courts. They need to be dragged out immediately because this is not not fair to home owners.
