Suleman Khan, a Khoja Muslim inherited a farm house from his father Salem Khan and started living in his newly constructed bunglow with his friend Suneel Kapur, who was working with him in a Tyme Cinema MNC at West Mumbai. Suleman was relocated to Italy, by his organization and decided to migrate there. In the farewell that was organized at that farm house for him where after consuming alcohol he declared before his friends that he was gifting the farm house he inherited from his father to Suneel Kapur, who smiled and gave him a hug with tears in his eyes. After that farewell party Suneel Kapur stayed back at the farm house with Suleman Khan till early morning and from there directly went to the airport for his shooting assignment scheduled in Switzerland. Giving instruction to a lawyer for mutation regarding farm house, Suleman boarded the flight to Italy but died in the air crash. His brother Raheel Khan sues for the possession of the farm house on the ground that the gift was not completed as per the provisions of Muslim law. Questions???? 1. Whether Suleman Khan was competent to Gift that property ? 2. Whether Gift was complete as per the provisions of Muslim Law ? 3. Whether Raheel Khan is entitled to possess the farm house and inherit it ? Sir please explain this

I need your advice that after my mom's death on 23-april-2021, my father wants to acquire my properties by misusing the Mohammaden Muslim personal law. He said after the death of wife husband is only care taker. There is no right of child and he send me a legal notice. And my mom transferred the ownership on my name by gift deed in 2017. So plz help and suggest how may i defend my assets from my dad who is living with another wife as a live in..

If husband does gift deed (Hiba) of currently residing house in his wife's name and is duly registered in Sub-Registrar office, but the wife has not accepted or taken possession formally/through writing, is the hiba still valid. Please note that husband and wife were staying together in the same house during the hiba, but due to marital disputes, wife got separated after 7 years of getting the gift, left the house, and husband revoked hiba stating that wife did not take posession and marital problems, is this revocation valid? In your first video, you have mentioned that it is not necessary to accept and take possession in case of husband and wife. If the hiba is valid, what happens if the husband and wife get divorced in future. Please clear my doubts brother.

Very informative video. Sir i have a question here. Once hiba is completed i.e. declaration, acceptance and delivery is done. Now after few years if the person who gifted died and his wife and children made a sale deed to some third person. Will it be valid sale deed? The possession is still maintained by the person donee.

sir mera ek question hai agar mere pas hiba hai aur mai makan par kabij b hua ab halat ye hai k jis makan ka hiba hai us par hum bhaiyyo mai kuch sammanit logo k apas mai sulah karane k baad un bhaiyyo ko mene makan ka hissa rahne ko diya. un bhaiyyo ne makan ko municipal board mai sab bhaiyyo k naam dakhil kharij karwa liya karib 30 saal se hum bhaiyyo k bich vivad hai . mai ye sochkar chup ho gya k chalo koi baat nahi magar ab wo us makan ka barabar batwara chahte hai.. aur wo court chale gaye. mujhe batao kya mujhe hibanama mai jisme oral hiba ka jikar b hai uske ek mahine baad hibanama b hai to kya mera hiba ka haq barkarar rahega.. mujhe aap sahi ray de. aapka ahsan mand rahunga thanks
