Donating bone marrow is one of the most painful things a person can endure, which is why it's done under sedation. More than likely the little brother would've passed out from the pain alone (still possible even though it's not shown). This is by far one of the best episodes of the series. The parents reactions were realistic and well acted, but more so than anything the two brothers. There's a special bond growing up with a brother, and I think that anyone who has a good relationship with their sibling would've done the same, I know I would for my brother.

He wasn't a healthy kid or else it would have been easier, also he took his first answer which was yes. He knew he'd say no once he started because it's painful with sedation never mind without. The bigger problem isn't that he didn't get the kids permission it's that he didn't ask the parents who at his age have to be informed and asked. I know this ks a TV show, but technically the second bone marrow draw Forman did was illegal. Nick was fully lucid and he withdrew his consent after the first bone marrow draw. When that happens, unless the procedure is being done for the patient's benefit and stopping would do more harm to that patient, Dr Foreman was legally required to stop and yet he did not. Yes, prosecutorial discretion is a thing, and no prosecutor would likely charge Foreman criminaly, but Nick himself could sue (for the trauma caused by the 2nd draw) after he turns 18 and Forman would certainly be facing a disciplinary hearing for continuing a medical procedure (that gave no benefit to the patient) without the patient's consent.

Bone marrow transplants are rarely done directly nowadays. Most of them are about promoting the release of progenitor cells into the blood stream and then extraction of those cells from the blood. This does not need any pain medication, because it is basically a blood draw. However, when performing a bone marrow biopsy, they have to harvest the cells directly from the bone. That is painful. That is done under at least local anastesia, if not full sedation. Biopsy is not used for transplantation. It is a method of diagnosis. There is nothing contaminating about sedation though. Bone marrow is transplated in low volume, the amount of sedative transferred would be small, and moreover the kidneys and liver of the recipient have to work and remove/inactivate the sedative - otherwise the procedure will not be performed, because it would mean multiple organ failure is occurring and bone marrow is one of the many problems. Unless the dose of sedative used on the donor is not magically several times higher than the recipient would tolerate, it is better to avoid inflicting unnecessary pain.

I have to say, as a nurse, they might have been able to give one brother a spinal anesthesia and get the bone marrow that way. He'd go under but it would be better for pain control and easier to recover from. The biggest issue here is the ethics because a child may understand what is going on, but the pain that he'd go through for the bone marrow extraction is mentally scarring, especially on a young mind. The fact that Foreman didn't stop when the son said to is very disturbing, especially when bone marrow could be turned into stem cells, be fed into multiplying, and there would be more bone marrow there.

1. On the topic of the 1st bone marrow draw. Nick did consent to the first bone marrow draw. Dr Forman was legally in the clear for that. He might still face a disciplinary hearing though and his medical license might be temporarily suspended, but then, after a short break, he would then be allowed to resume practicing medicine. 2. On the topic of the 2nd bone marrow draw. Nick, who was fully lucid, withdrew his consent before Forman started the 2nd draw, but Forman proceeded with the 2nd bone marrow draw anyway. There was no consent from Nick, there was no benefit to Nick (only to his brother) and stopping the procedure would have done no harm to Nick (Doctors, in some cases, are allowed to continue a procedure after starting if stopping mid way through would cause more harm to the patient undergoing the procedure). In this case, what Foreman did was legally "aggravated battery with a deadly weapon", a felony in most states. Any valid defenses (eg self defense, consent, etc) to this charge are absent. Also, performing a medical procedure without the consent of a patient from which the patient gains no benefit would be a clear violation of Foreman's oath to do no harm and would likely result in Foreman receiving, at minimum, a long suspension from practicing medicine or an outright revocation of his medical license. He could possibly (depending on what the States/District attorney who gets assigned his case decides to do) even face multiple years in prison because what he did, once again, was legally "aggravated battery", a serious felony.

Wow...who's to say that Foreman lucked out on solving the riddle on what Matty had. If Wilson didn't spring up the word "suburbs" with Foreman saying "water pump", then they would have been going around in circles trying to solve the case. The fact that both clues didn't make sense together was probably a perfect example of subliming a breakthrough that didn't require House to have the answer for them. Poor Foreman must have been scarred for life for what he did, considering that it almost cost not one, but possibly two deaths in the midst of it all. It's probably fortunate that both of them survived because of him. Hard to believe that this diagnosis was set by what used to be a home that was originally a farm. What a confusing plot this turned out to be.

@FinalLugiaGuardian
@FinalLugiaGuardian 3 ай бұрын
What House did was completely legal. What Foreman did was not. 1) Dr House got the consent of the patient AND she never withdrew it during the amputation. ALSO even if she had withdrawn consent midway through the amputation House may have had the defense of necessity to save her life because the amputation was done to save the life of the patient (not for the benefit of another person) and stopping the amputation midway through would cause even more harm to her. 2) Dr Foreman was performing a medical procedure on a patient that was NOT for the benefit of the patient himself, BUT RATHER the patient's brother. He seemingly got the consent of the child patient and the parents and, because the procedure was not for the child's benefit, he did in fact need both parents and child to consent. HOWEVER, the child, who was fully lucid, withdrew his consent after the 1st bone marrow draw, but Foreman did the 2nd bone marrow draw anyway WITHOUT the patient's consent. THIS is point where Foreman broke BOTH the law AND his oath to do no harm. There was no valid consent. There was no valid claim of necessity (eg the patient would be harmed by the doctor stopping after starting). There was certainly no valid self defense claim. In Real life had a Doctor done what foreman did they would have been subject to a disciplinary hearing and would have likely had their medical license revoked. It is also legally possible the doctor would serve multiple years in prison for agravated battery: deadly weapon [Fl Statutes 784.045(1)(a)(2)].
