Like your videos, but as a RN case manager,when someone is in an accident their adrenaline is high so this is not always the case that the people feel pain the same day , usually within a week or 2. That is facts.

Emily Lee: I agree that adrenaline can mask pain. That said, insurance companies like to argue that an injury wasn’t caused by an accident if the claimant waited a while to get medical treatment.

I was hurt on the job from repetitive motion I was sent to the hospital and the jobs doctor and primary care doctor bc my shoulder acjoint tear I was then told not to return to work for two weeks I later received a call saying I was being moved to a different shift bc my position had been filled but I couldn't work the new shift due to not having a sitter and still being in pain I was forced to resign

Have a question for you from oregon... my 14 yera old son was hit on his bike in the crosswalk a week ago and broke the humerus on the right side. Orthopedic surgeon said no surgery and the drivers insurance excepted 100% responsibility with a 50k policy limt, we have 100k on our policy... what would you expect for compensation, and could we go after our insurance for compensation?

Thank you your video was very informative, my question if you can offer advice or knowledge was involved in a auto accident one year ago vehicle was totaled at other drivers fault had left neck and shoulder pain was hesitant to get any type of surgery so I did physical therapy with no improvement I finally opted to do a rhizotomy on my neck and just had shoulder arthroscopy surgery just done this week, was wondering if waiting so long had hurt my case since I was hesitant to do surgery? And the initial doctor visit didn't document my shoulder pain only my neck which I had to go back and get another doctor visit which wondering if that hurt my case? They did a MRI was positive for bulging disks low back, scoliosis in neck, AC joint separation and tear in rotater cuff. My attorney informed me they are filing for the case to be increased to 200k the insurance company did send me a low ball offer of 7.5k before surgery which doesn't even touch time I missed from work and other expenses I endure and pain, sorry for the long story it's just be a headache of an experience

My experience has been that doctors are conservative in their treatment. They will often send a patient for physical therapy before considering surgery. It may be months before the doctor decides it is time to do surgery. That might cause the delay.

I'm sorry to hear that you were injured and that you needed hardware put into your body. I don't know how much you'll get because they are so money variables in every case. I primarily handle personal injury claims, although some of those cases involve people who are injured by a third party while the injured person was working. I'm sorry to hear that you were rear ended by a semi. However, since you are suing, I assume that you have a lawyer, which is good. The following events typically increase the full value of a personal injury case: 1. Taking an ambulance to the hospital. 2. Getting surgery. This includes, but is not limited to, a subacromial decompression (acromioplasty). A subacromial decompression is an operation on the shoulder. It's used to treat a condition called shoulder impingement. I'm sorry to hear that you were hurt. I practice in Florida so my answer only applies if the car crash happened in Florida. In claims where another driver hit the rear end of a car that my client was in, and there is bodily injury liability insurance, uninsured motorist insurance, or a self-insured defendant, with the injuries that you've described, I've generally been able to get a settlement for my client. As a NY attorney, I can tell you that, generally speaking, you have three years from the date of injury to file a claim. But, explain all of the facts to an attorney licensed in New York to get the exact amount of time.

Hashish Senju: It depends, in part, on how much insurance would've been available. I think if his uninsured motorist insurance policy limit with USAA would've been $30K, they would've paid it. In my client’s particular claim, I highly doubt that the uninsured motorist company would’ve offered anywhere near $700K. For starters, he didn’t have surgery.

Hashish Senju: In my client's particular case, it would've depended (in part) on whether he had any medical treatment for his shoulder before the accident. Since the policy limits were only $25K in his case, we didn't gather his pre-existing (if any) medical records for his shoulder. Thus, I don't know how much more of the $700K USAA would've offered if he had labrum repair surgery and PT sessions. I'd like to think that USAA would've offered over $100K though. My husband got injured by a Budget Rental Truck Door (the bk sliding door) and he settled at $2,000.00 BUT the check ONLY said (on the stub part) that that amount was ONLY for injuries for him but didnt clarify the injuries. The likelihood is that your husband signed a release, and may no longer be able sue. But, without seeing what he signed, I cannot tell you for sure. This is a "dirty trick" insurance companies use to get you to settle. JZ has some good videos in his series that talk about this.

I'm with NR&S out of cleveland and I pulled my shoulder out while lifting a 50 lb. propane tank and now my shoulder pops and hurts all the time the doctor told me I could go back to work a week later and I told my boss no so I had no choice but to quit and the BWC in ohio will not pay you nothing if you quit your job so its been 16 months now and the stress of this is so bad its unreal so now I see yet another doctor for the stress to be honest I would not wish a work injury on anyone thank you for the information.
