Yeah! Represented myself against a Barrister. Ended up with injuction ( 2 towns) & section 91(14) Judge in conclusion said "they might consider giving me a job!" Main thing is my son is protected!

Unfortunately, barristers tend to have personal connections with the court administrators and are in a position to ‘influence’ them by some means. I have experienced Legal Advisors openly instructing magistrates on judicial decisions, rejecting documents, interrupting cross examinations and crucially, ensuring that no magistrate sits on more than one hearing (across 7 hearings in my case). This means that the incoming magistrate has to reply on the Legal Advisor to tell them what has happened so far in the case.

In my personal exsperience with Luton family court the judges know the barristers personally and even exchanged emails during the hearing. As far as I’m concerned it depends which court you up at to wether things will be done correctly and fairly

Everyone needs to remember Your solicitor the judge the CPS and opposition barristers are all work colleagues and simply sing and dance in court to try and win, you are never the best interest

Last year I left my ex partner and took our daughter with me because her mom kept going out drinking and then coming home and being aggressive...after I left I applied to the family court for custody of our daughter I still wanted my daughter to see her mom but I wanted custody until her mom sorted herself out...before we went to court though she got our daughter back by getting me arrested by lying and saying that I'd hit her 3 weeks before I left her...she lied loads to the court saying I'd hit her etc we did one hearing and then she went behind the courts back and started letting me have our daughter...I stopped going to the court hearings in the end because my daughter's mom had stopped drinking so I was happy withy daughter being with her...she was granted custody...I've been having my daughter every weekend from Friday until Sunday...6 weeks ago me and my ex partner had a arguement and now she's stopped me seeing my daughter again because she's using her as a weapon her excuse is I've hit my daughter...I've had to take her to court again my court date isn't until another 4 weeks though...this time around I recorded some of our phone calls were she's threatening me and also recorded other people threatening me on her behalf I've contacted the police there investigating it all...I'm worried about court because in my experience from last year if you mention anything that makes the court question if you've done anything to a child you don't get to see your child...last year they wouldn't even let me see my daughter in a contact centre...I can kind of prove that my daughter's mom didn't stop me seeing her because she thought I'd hit her because on the day we fell out she was telling me on whattsapp that I knew she didn't mind me having our daughter...it's really worrying as a man in the family court and it isnt easy

This is clever. I advise fathers in the US on how to overcome family court lawyers, the equivalent of your barristers. I tell them that most family court lawyers have below average intelligence, and they only make their arguments using cliches and marketing slogans, with very shallow thinking. And you can always defeat a lawyer with intelligent thought.

I do have a question on some appearances my lawyer has asked that a barrister represent while she sits there and also charges me an arm and a leg for her just being there. Could I ask that just the barrister appear and not her

You really can’t, my friend is paying thousands of pound for them and she is on benefits, she had to take out loans and sell her car, that’s why I am here, I just don’t see how they charge so much when they just guiding you they not allowed to do a lot of things

No one will help unless you pay them lots of money and even then there is no guarantee you will be fairly treated. I know through experience.

they got rid of that mckensie friend assistance as it was a pain for the legal lot as they were being forced to do their jobs........ also the family courts are in my opinion a joke and be very careful as they could well breach your sensitive information submitted to the courts to support your hearings......data breaches are against the law so get legal advice if they have shared your information without your permission. They appear to use breaching your sensitive information as a tool to discredit you.

I’d get trained legal help. If you can’t afford that, then get informed yourself at least. You and your children may live very difficult consequences while the court offers only the adversarial route, which as I’ve read in your link (given after I moderated my post and gratefully received) McFarlane reiterates the obvious point that Parental Responsibility rests with the parents and not the court. That should be a sobering awakening for the existing judiciary as well as the high conflict parents who often win their ‘anything but child centred positions’ having employed the silver bullet and other tactics, not because they’ve satisfied the seven broad headlines in the best interest factors of the Children Act, but that they’re simply good at lying and manipulating the judges discretion, just as they had probably done manipulating the parent who possesses the emotional maturity and unconditional love to co-parent in the child’s interests. This is going to be a mountain to read, but I will. From a quick glance it only seems to address the ‘separating families’ ahead of their first (and hopefully) only round of litigation. For those who’ve been in the system with high conflict exe’s for years and years experiencing new applications every 16 months or so, there seems (at quick glance) no relief, and at a time of COVID, with the court now more burdened than ever, no hope of judicial continuity, fact finding, or even in-person hearings. My district only uses telephone, no video to at least bring the personalities into court. The publication hopes, that if adopted (and a lot of it really addresses the adversarial aspect) that it may be implemented over a 5 to 10 year period. Do you think a litigant today, assuming they’re child focused and reasonable, could cite some of these principles to the average District Judges sitting today? You’ll see above I’ve stripped out my vent. I felt your video never took into account those of us who struggle with parallel parenting with vindictive exe’s as in those cases, the current FPR and CAP is not a good roadmap to ending future litigation. What is? Deference to the principle that McFarlane first used in the COVID Guidance and now in this : Parental Responsibility is with the parents and not the court. Very lastly, since you were in law enforcement. If a person is constantly accused with false allegations like stalking, harassment and the threat of violence, is there a route with the CPS (provided you have excellent refuting evidence and can show motive) to prosecute them with ‘wasting police time’ and ‘perverting the course of justice’? I know the evidence threshold is high, but assuming one has both the regularity of serious criminal allegations over years, as well as proof, wouldn’t this be a good approach in the correct jurisdiction with a high bar of evidence, rather than in the family court where ‘the balance of probabilities’ is not only a low bar, but is plagued by human fallibility in the form of discretion? Surely if these allegations can be ‘flushed out’ of family court, then the judges need only then apply the applicable law in line with the Children Act? Thanks for your reply and the link!

The Judiciary has published their paper stating that you don't need family lawyers and are actually telling people not to get family lawyers.
