Lucid explanation Mam 👌👏🏼 I have a question. Can a employer terminate an employee after the resignation? After 9 days of resignation, company issued a termination letter. Is this act by Management tenable in Court of law?

Yes, the Company can terminate the employee who is serving notice period, provided they have a valid reason for termination and it has been carried out in a professional manner. There should be a proper proof in case of integrity issues and proper documentation of counselling notes in case of performance issues.

But there was no notice period invovled. On resignation day only was last working day. In this case?

So, did they declare termination on the last working day or after the employee left the company?

Infact they pressurized to resign saying that employee is terminated. After resignation, they refused to issue relieving order & notice period salary. They orally told that employee terminated & employee insited to give in writing. Hence, management issued termination letter. In labour court, company has claimed that employee has voluntarily resigned & subsequently after insistence of employee, management issued termination letter. Is that possible to issue termination letter like that? Will such termination order pass the legal scrutiny in labour Court?

You should consult a lawyer with all the details of the case. What is the actual incident and what documents do you have and what are the charges that company is pressing.
