Indeed! Far too many people take pleas deals because they can't risk prison time or the expense that it would take for them to fight the charges. Prosecutors know that and that is why people are so overcharged in the first place. I am reminded of the grandmother that pled guilty to a drug crime for which she was factually innocent because she couldn't afford to go to prison as she cared for her new grandbaby. Zachary Wester, the disgraced former cop, was planting drugs on innocent people, falsifying reports, and testifying in court as a routine matter. He was found guilty of nineteen counts and order imprisoned for twelve and one half years. This grandmother was but one of his victims.

This hometown judge backed up his hometown prosecutor. He should've made him go to trial but because there are no witnesses there it's easy to figure out when they walked in what happened. This isn't even close to being an honest operation. The cops are dirty, the district attorney/prosecutors dirty and the judge allowed this to happen because he's in charge. There are a couple good things, eventually the charges will be dismissed and the second thing is the world is getting to see this.

I'm on the fence about going to trial in this situation. The prosecutor used the 1 excuse that nobody can avoid, emergency surgery. The judge should have followed up with what the surgery was to verify it actually was an emergency and who the witness is. If the witness was the cop and the surgery was a root canal, then the judge should have held the trial today because the surgery wasn't an actual emergency. The Trump trial in NY was recently postponed because 1 of the jurors had an appointment. Changing the trial date isn't a big deal unless it is specifically the prosecutor doing it to screw the defendant.

It doesn't matter even if Larry was putting on a show. It was a damn good one. Larry did a hell of a job for his client and promoted his services to potential clients in the process. That is show boating, that's called kicking ass and getting future business while you're at it. The prosecution whanted to get their way, knowing the judge wanted the case over with / done if he had to set another court date. Which for the prosecution was fine, but Larry wouldn't play ball. Larry took full advantage of the opportunity the prosecution and judge gave him. So, no, he didn't agree to another future date to appease the prosecution. The prosecution was forced to give in, knowing the judge wanted it closed. So yeah, I'd say Larry pissed in the prosecutors frosted flakes. Good job!

I know that money is an issue in a trail court, but the guy was *not guilty* of what he was accused of. A *pretrial diversion* is still technically a "victory" for the Commonwealth because the prosecutor doesn't have to hear a jury say _"Not guilty!"_ and have a loss on his record. ... Someone who is not guilty shouldn't have to agree to ANY terms!

These kind of delays should be paid for by the prosecutors and judge’s salaries when it is caused from their side. They can take a reduction in pay or reduction in retirement to pay for the delays. The cost should cover travel expenses, witness fees, hotels, and council pay. If our court system was fair, the judge would a lot this immediately. Our govt employees can pay out of pocket for their costs to citizens when the govt can easily send billions to other countries. Did I also see the prosecutor lie to the judge about a signed agreement. If so, the judge should ask for proof.. if no proof, immediate perjury judgement on the prosecutor. ;)

Agreed! Mr. Hendry is out upwards of ten grand or more (albeit some of which was from donations) for doing nothing wrong. As we know, however, the process is part of the punishment whether or not you have done anything wrong.

It seems like an ethics violation that the prosecutor even tried to press charges with a case so weak he agrees to this sham 'diversion' at the end. Kudos to the gent who refused to accept the plea deal! Those things are one of the major sources of corruption in the system; manifest injustice tolerated by all or nearly all in the name of efficiency.

Why would anyone accept a diversion agreement. As far as I can understand such an agreement is an admission of guilt. No one who is innocent should accept that. The outcome should always be a trial or a dismissal with prejudice.

It doesn't sound like he even lives in that county so if he just stays out of it for 6 months he's free and clear. If I'd been the judge I'd have given the prosecutor the choice to go to trial as scheduled or dismiss on the spot. The charges were so minor, it wouldn't have been that big a deal to do so.

I am curious about this “emergency health” situation. Maybe it was a real emergency. The judge said 1st May was trial day no more continuance, and the judge said we need to get this case tried or dismissed, so the onus is on the District Attorney to try the case if he cannot continue then he should dismiss the nonsense case since the only crime was arresting Mr Henry for doing a Legally Protected Activity under the very Law the entire nation was founded after ousting King George's rule, but the DA forgot to get his ego in check and dismiss with prejudice all charges.
