I'm not a constitutional scholar so take this with a grain of salt. There's a better than equal chance I'm totally off the mark. As far as I can tell there's actually no provision, either in the constitution or codified elsewhere in law, that prevents... basically anyone from running for President of the United States of America, as long as they're a native-born American citizen. The reason the 'insurrection' thing is such a big deal is because under what we're currently referring to casually as 'the insurrection act', a provision which was hastily thrown together after the Civil War to stop Confederate military and political leaders from being elected to office after the War, an 'insurrectionist' may not hold any office of government; this is why Trump's team has been arguing that President is not an 'office' of the United States. However, as far as I can tell, there is no de jure prohibition on running for President as long as you meet the basic condition of being a native-born American Citizen, as the founding fathers naively presumed that anyone elected President would be a man of merit, integrity, and competence, and that this (or its lack thereof) would be obvious to the voters. There are de facto prohibitions on running for President, like the billions needed to fund a Presidential campaign, but very few de jure prohibitions. This probably has some rabbit holes to go down regarding things like whether a convicted and incarcerated felon has the right to run for office, and whether the necessity to engage in a campaign without interference would override a court-imposed jail sentence, but that's way out of my pay grade in terms of my understanding what America is pleased to call its legal and political systems.

I wish they all would do more of the dark Brandon and start hyping up what a bad ass Kamala is - remember her during the Kavanagh hearings? They need to start pushing that narrative hard or there is gonna be a problem for the whole world.

This was done tastefully & tactfully - nothing worse than a light joke some people might even make about their loved ones. I agree with you in general - especially because the waters ahead are so unpredictable & perilous - but I think this kind of ribbing is also about the fact that this show is a social commentary & always has been. Our memories of the pre Trump late night shows are so long gone that we don't remember how much crap these guys gave Obama (again, tastefully & tactfully) & every other POTUS since late night started. It's a fine line & I understand your impulse to say that - I think a big part of me agrees with you that even these jokes could be dangerous - but then a bigger part of me remembers that we should maintain the authenticity of our beloved institutions (and late night as far as I'm concerned is absolutely an institution) despite the temptation to become completely defined as the opposition - when the role of the institution in society remains necessary, social commentary as a whole should continue & ribbing on POTUS with some cheap shots here & there is part of late night canon lol.
