It's called "quasicriminal". Calif here...they tried to pull that on me in a lawsuit. Turns out Calif Constitution says there is Civil and Criminal law but no one understands what that means. (never the two shall intertwine). I got a paralegal to get my (new) attorney to put forth the argument and we got them to drop the case.

it's important to remember that laws are like this for a reason. they're over reactions to specific landlords being absolute cock guzzlers and putting tenants through inhumane treatment. the main justification for the criminality is that in these situations, the landlord is the one with the power and so the infraction on their part is always more serious... in theory.

I love your humor and videos, from South Africa, had tenants once that didn't pay for 7 years, only got them to leave because we stopped paying water and lights, never had tenants since, they broke our plumbing, roof, walls, windows, multiple threats to kill us (in front of police too), nothing we could do, system here is also pretty broken

The US isn't much better. I had to call the cops on a guy who outright threatened to kill me, including having people show up to back him up. The cops eventually show up just to treat me like garbage for "wasting their time" The cops then actively interfered in the *legal* eviction process by refusing to let the guy be served his eviction notice. He's months behind on rent. They said that the owner had to go to the court first, but court said that written notice needed to be given first. That cost me at least a day on getting him out

If you're a landlord that's dealing with this nonsense, you can just counter squat: Sit and wait until they leave the house, then enter and change the locks. When they arrive back, you call the cops saying you have a potentially violent trespasser. When the trespasser says they have a lease, you can ignore them because you are the only one with a working key. If the squatter tries to break in, call the police saying there is someone breaking and entering your home.

My tenant stopped paying rent shortly before the pandemic hit and rode it until they started allowing evictions years later. Afterwards, I sold the house. It was my only house. Being a small-time or single home landlord in a liberal city sucks. They keep adding more rules and fees, and you don't have a hundreds of units to amortize the cost over. What is left will be companies that keep hiking up rent to cover losses or more often, they remodel their units and charge such a high rent that only high middle-income earners can afford it, pricing out lower income renters. Normally, they'd just prefer to just select the best tenant looking at the whole application, but anti-racism laws are forbid humans from selecting subjectively, so entire income classes get screwed over instead.

So far the ONLY thing that seems to work is you write up a real lease to a friend or member of the family and they enter the apartment when the squatter is out and change the locks. when the cops come back they show the lease and have a key so the police cannot side with the squatter. This is a HIGH RISK though as there will be serious confrontation and squatters can have weapons/ . Also best if you hire private security to watch the property as the moment you leave the squatter will come back as they will be watching the property.

so if you find a squatter in your apartment, the only thing you can do is wait for them to go out, immediately swoop in and add locks/security to all entry points, then RUN LIKE THE WIND! as long as you aren't at the apartment if/when the cops rock up, that is just a crazy person screaming at a door with no rental agreement yeah? ^_^

The law in the UK is so simple and that is if you are not a tenant and the police is called and tell you to leave you have to leave no if's or buts. But if you are a tenant then it is a civil matter and you as the landlord would have to go to court to evict the tenant as they do have rights to a point, because If they get themselves cut off from the utilities it's not the landlord's responsibility to get you reconnected that is 💯 down to you. And as a tenant or squatter you cause any damage to the property like leaving the taps on, you as the tenant or squatter will be charged with criminal damage and as the tenant good luck trying to get back into the property. Bottom line is that the laws in the US need to be challenged to protect the rights of the landlord and tenants but nothing for squatters as you should not be able to walk off the street and take over someone else's property, and paying for a tenant utilities bill when they got themselves cut off is down to the tenant and not the landlord.

I can tell you don't have property in the UK. If a tenant wants to dig their heels in it can easily be a multi month affair. And just like in this video if they say they live there it's cancelled quickly become a civil matter if the police can't be arsed.

@@TheWebstaff But that is if a tenant has a tenancy agreement that is upto date and if that tenant has a tenancy agreement then yes you have to go through the courts to get them out. But what is happening in New York and other US city's is that squatters are walking into a property and claiming that they are tenants when they are not. If the same thing happens in the UK you as the landlord don't have to go to court to get rid of the squatters and if they don't leave they will be arrested their and then as most of what what used to be squatters rights under law has been rescinded by parliament so you as a landlord you don't need a court order to get rid off them. But if you have a commercial property like a warehouse you still have to to go to court to get rid of the squatters because squatters rights rules still apply🤬

This is why we can't have nice things. I assume these tenant-friendly laws and rules were enacted because of abuses by enough landlords to be worrisome. That's bad enough. That squatters have found a way to take advantage of such things and cause problems like Sunny reports stems from police indifference or laziness, carelessly written laws, and, unfortunately, the American desire to be free from the need for "papers." In general, this is a good thing, but the absence of standards for verifiable identification are causing as many problems as they are avoiding fascistic abuse.
