About the Copyright thing: Some copyrighted names will lose the copyright if the name passes into common language. Like, Dumpster used to be a brand of those big garbage bins, but it became an ingrained part of common language the lost the copyright. Even if cola wasn't a plant they likely would have lost the copyright to that specific word by now.

Indeed, Coca-Cola tried suing Pepsi for using the word cola on an ad like 10 years ago but it backfired cause its a normal word , not a brand, so they ended up dropping charges

Coke used to be copyrighted. What happened was that people started just calling all sodas "coke" whether they were colas or not and someone proved that the word had become common parlance and so Coca-Cola lost the copyright. That said "Superhero" and "Super Hero" are apparently copyrighted by Marvel and DC collectively... which is why indie comics use terms like "enhanced", "metas", "powereds", "talents", "peaks", or similar things. And the word "Tap" as it specifically refers to turning a card on its side in a game is copyrighted by Wizards of the Coast for Magic the Gathering, hence why other games say things like "Exhaust" or "Use"

15:00 - The drink cola (with a C) has flavoring derived partially from and kola nuts (with a K). I don't know why they're spelled differently - probably because of Coca-Cola changing it to a C to match initials (it looks nicer than Coca-Kola).

The reason why "cola" isn't copywrited because the company Coke forgot to. By the time they realized their error other soda companies already started calling theirs "colas" too therefore it was too late to copywrite it

Copyright and Trademarks Yes the U.S. is more strict about Copyright and Trademark but that's a good thing. That means whatever you create is protected as well. As a Apparel company owner/designer I know all my designs are protected. As far as Cola vs Ghost Hunters games those are 2 different situations. You cannot copyright generic terms like Cola because Cola itself is the generic term for a carbonated beverage and it can be flavored with ANY flavor, it's not specific to Coke-Cola. BUT Coke-Cola is a specific trademarked brand of Cola. It's like trying to Trademark/Copyright the word "What" You can't do that because it's generic and too many people and businesses use it everywhere so if you tried to the government will refuse the trademark. When it comes to Ghost Hunters game and the show, that's a bit different AND you must understand what "Suing" somebody means. To sue someone has no real restriction, you can literally sue someone for ANYTHING. The court can accept it or reject it on the basis of if they feel you have a case or not. So when a game is named "Ghost Hunters" and There's a show using "Ghost Hunters" even though "Ghost Hunters" may see generic, that term as a property was allowed to be trademarked by the network and people who have the show and if they feel you infringed on them they can sue (that doesn't mean they will win). The game is about ghost hunting, the show is about ghost hunting, maybe they feel they were trying to leech off their name or whatever. As I mentioned I'm a apparel company designer and owner, to stay safe from trademark and copyright, I always consult websites official and unofficial that track trademarks and copyright AND I never make something that uses the same term. Like I'll never make a "Ghost Hunters" T-Shirt or Hoodie for example. I'll just find a different word to use that I can do SEO research and bring traffic to the merch. Ghost Hunter would be ok where as Ghost hunters is not. You could also make something that implies Ghost hunting on the design and use "Ghost Hunters" in the title or description but not have it as the design itself. The problem is having "Ghost Hunters" on the product because they already have merch themselves that does it and copyrighted that for merch. They could try to still sue but it wouldn't go far if a shirt said "Snooping and Spooking" and the description said "Ghost Hunters lover shirt" as it has nothing to do with that trademark as a product at all and there's no room to argue that in court.

you cant really copyright something in the u.s. unless you can provide some proof that you created it. the term cola wasnt created by any one company its just something that people call soda just like well soda and pop in some of the northern states. you cant copyright a general word or term unless it pertains to something you own and you can prove you created said thing. so coke can copyright coca-cola and coke but not just cola because cola is something general used for alot of soda. there are also alot of offbrand soda companies that use the word cola in their drinks as well so yeah far too many people using the term for anyone to copyright it without any proof they created it.
