You signed a bad contract, frankly it doesn't matter how long you've been with them you made a mistake. Even if they pinky promise to give you your 100-0 split it seems insane to have a middle man at all just because they give you a free lawyer, you wouldn't even really need a lawyer UNTIL a day like this when they'll take the free lawyer away if you try to sue them. Take them to Court immediately (you should have started the second you suspected anything being wrong really), accept no offer of payment because that only delays for them and resets the clock. If a company is on the verge of bankruptcy then you need to BE what bankrupts it. Be the last thing that GETS PAID not the first thing that DOESN'T. Get a legal letter out to them now, start preparing your case for the high court (I'm assuming you're owed over 10 grand) fast track it through the high court and send High Court Enforcement after them, when THEY inevitably get an offer of a "payment plan" tell them to recover assets if the company won't pay because it is just another delaying tactic. Then make a video about the procedure and taking them to Court so you can make money off it/possibly write shit off as expenses lol

As far as I understand contractual law. The company breached the contract when they didn't pay on time. Contracts go both ways and if I understand correctly if either party doesn't fufil on their part of the contract the contract is void. As someone who spends 40 hours a week arguing with solitons firms about them not paying our barristers when they are contractually obligated to for work already done. I’d seriously suggest getting a lawyer as this has got administration or liquidation written all over it. Ask about getting a letter before action sent as sometimes that get a reluctant company to pay up or start prepping for a small claims action. I’m having a very similar situation with a UK casting company I’ve been with for years and done extra work. I still haven’t been paid for work I did in May of 2023 and any work I did after that, and I was reassured that people would be paid from January onwards and any work I did after January I would be paid for straight away and it’s now been 6 months since then… and I still haven’t been paid. I’m having to take them for small claims court for over £700 of work and write them a letter of intent.

This sounds eerily similar to the michinima situation of old. In fact, almost entirely the same, except with different creators, including signing just-of-age, i.e. easily manipulatable, people. At least 2 of the creators I watch got screwed in the michinima situation and probably untold others.
